Mason man charged with child pornography at West Chester day care

FBI agents arrested a Mason man Thursday on charges he photographed himself molesting children at an in-home day care run by his mother.

Andrew F. Keith could face decades in prison if he is convicted of the 117 federal charges of producing, possessing and transporting child pornography.

Federal prosecutors said the charges date to at least 2002 and involve three known victims, all young boys. Agents are investigating whether other children could be involved.

“We are concerned there may be other victims,” said Fred Alverson, spokesman for U.S. Attorney Carter Stewart.

FBI agents arrested Keith, 27, at his home in Mason, where he lives with his mother.Keith is accused of molesting and photographing the children at a home in West Chester Township that he also shared with his mother. His mother, Teresa Bailey, ran an unlicensed day care in the home.

Keith has since moved to Mason with her and he was arrested at her apartment Thursday morning.

The indictment accuses Keith of abusing the children in 2002 and 2003. The photographs described in the indictment show the children in various sexual poses and, in some cases, show Keith performing sex acts on them.

Keith’s mother said her son was abused as a child and has suffered for years from the effects of that abuse.

“I took him to counseling. I took him to church,” she said. “We’re sorry for the victims and I’m sorry that my son’s a victim.”

She said she “suspected something was fishy” about her son’s behavior while she was running the in-home day care. She said her son would not discuss his problems in detail, but he told her he was sick and needed help.

At some point, she said, he told her he liked little boys.

A man at the apartment who identified himself only as Keith’s stepfather said the abuse charged in the indictment “wouldn’t have happened if he wasn’t there in the situation with the kids.”

“He wouldn’t go to playgrounds,” he said.

All of the federal charges relate to child pornography and not to the accusations of sexual abuse, but Alverson said additional state or federal charges could result from the continuing investigation into Keith’s activities.

“That hasn’t been ruled out,” Alverson said.

West Chester police said they also are investigating the case and are asking any parents who believe their children might have been at the day care to contact them. They said the day care operated from 2002 to 2006.

“We don’t know if this was a small operation or a large one, as far as the number of kids the mother took in,” said Sgt. Matthew Tombragel, spokesman for West Chester police. “Hopefully, it wasn’t a lot.”

He said no one else has been charged and police have no evidence indicating Keith’s mother knew abuse may have been occurring at her day care.

Magistrate Judge Stephanie Bowman ordered Keith held in jail until at least next week, when he will appear in U.S. District Court again for a detention hearing.

Assistant U.S. Attorney Christy Muncy told Bowman that Keith should remain in custody because he is a threat to children.

“He represents a significant risk to the community,” Muncy said.

Alverson said authorities learned of the photos when Keith traded them over the Internet with someone in South Carolina.

Parents dropped their children off for day care every weekday morning at Teresa Bailey's house, expecting her to provide the safe environment she promised when they hired her.

But the house described by federal prosecutors Tuesday was more dungeon than day care.

They said at least three young boys were sexually abused by Bailey's son in the home and several others have come forward in recent days to claim they also were molested.

"They should have been cared for. They should have been watched over," said Assistant U.S. Attorney Christy Muncy. "Instead, they were touched in ways no child should be touched.

"Authorities painted a grim portrait of life at the in-home day care Thursday and, for the first time, accused Bailey of turning a blind eye to the abuse her son, Andrew Keith, is accused of committing in 2002 and 2003.Keith, 27, is charged with 117 counts of producing, possessing and transporting child pornography.

Bailey is not charged with a crime, but Muncy told a judge Thursday she knew what her son was doing.

Muncy said Bailey continued to run the day-care operation and allowed her son to be in the house "knowing her son was a pedophile."

Bailey could not be reached Tuesday and her husband left the courtroom without comment.

She told The Enquirer last week that she "suspected something was fishy" about her son's behavior while she was running the day care. She said her son would not discuss his problems in detail, but he told her he was sick and needed help.She said Keith was abused as a child and suffered for years from the effects of that abuse.

"We're sorry for the victims and I'm sorry that my son's a victim."

Keith is charged with abusing three boys, photographing the abuse and then sharing the photos with others via the Internet.

Prosecutors say the photos show the children in sexual poses and, in some cases, show Keith performing sex acts on them.

Muncy said several new accusers have emerged in the days since Keith was charged, although she would not say how many. "We're not just talking about three kids that this man abused. It is numerous," she told the judge. "If you let him out, there is no child that is safe."

A spokesman for U.S. Attorney Carter Stewart said the case remains under investigation and more charges have not been ruled out.Keith's lawyer, Richard Smith-Monahan, asked the judge to consider releasing him into the custody of his mother and step-father.

But Muncy said his mother provided inadequate supervision when she ran the day care, which closed in 2004, and she can't be expected to do better now.

Magistrate Judge Stephanie Bowman ordered Keith held in jail without bond, saying she was concerned that living in his mother's apartment building potentially would give him access to children.

The judge also asked jail officials to do a psychological evaluation of Keith because he has indicated he might attempt suicide.

Police arrested the former operator of an in-home day care in West Chester Township on Friday on charges of failing to protect children from being molested by her son.Police charged Teresa Bailey, 54, with two counts of child endangering after raiding her Mason apartment early Friday.

The arrest comes two weeks after FBI agents arrested her son, Andrew Keith, on 117 federal charges of producing, sharing and possessing child pornography.

Federal prosecutors say Keith, 27, abused at least three boys in 2002 and 2003 while they were in his mother's care at her West Chester home.

They say Keith photographed himself sexually abusing the boys and later shared those photos with others over the Internet.

The charges against Bailey, who has since moved to Mason and no longer operates a day care, accuse her of failing to act when she knew or should have known her son was abusing children.

"At this point, we don't believe the mother was involved in the molestation herself," said Sgt. Matt Tombragel, spokesman for the West Chester police. "But she was aware of it and failed to act. She continued to have those kids in this environment."

Tombragel said police searched Bailey's apartment Friday morning and expected to also search a storage locker she rents. He would not say what, if anything, police took from the home Friday.

Man to plead guilty to molesting boys at mother's day care

A West Chester man has agreed to plead guilty next week to molesting boys at his mother’s in-home day care and sharing photos of the abuse via the Internet.• Andrew Keith’s plea deal with federal prosecutors includes an admission that he abused and photographed young boys from 2002 to 2003, traded those images with others and collected at least 600 photos of child pornography on his computer.

He was charged earlier this year when authorities traced images to Keith from a computer belonging to another child pornography suspect in South Carolina.

As part of the deal, prosecutors agreed to drop most of the 117 federal charges of producing, sharing and possessing child pornography.

But the remaining 17 charges still carry potential 20-year sentences that could keep Keith in prison for the rest of his life. He is scheduled to formally plead guilty Monday before U.S. District Judge Sandra Beckwith.

Prosecutors say Keith, 27, abused at least three boys while they were in his mother’s care at her West Chester home. They say many of the photos show Keith abusing the boys or posing them in sexually explicit positions.

Keith’s mother, Teresa Bailey, 54, is charged with two counts of child endangering that accuse her of failing to protect the children from her son. Unlike her son, who faces federal charges, Bailey is charged with felony counts in state court.

A Mason man pleaded guilty Monday to charges of abusing boys at his mother's in-home day care.

Andrew Keith, 27, entered the plea in U.S. District Court in Cincinnati before Judge Sandra Beckwith. He faces 30 years to life in prison.

Federal prosecutors say Keith abused boys at his mother's home in West Chester Township, photographed the abuse and then shared the photos with others via the Internet. Prosecutors say the abuse took place between 2003 and 2004. They say they caught Keith when police found the images of abuse on another suspect's computer last year.

A West Chester man deserves to spend the rest of his life in prison
for molesting boys at his mother’s in-home day care and sharing photos
of the abuse over the Internet, federal prosecutors say.
Prosecutors
told a judge this week that Andrew Keith, who pleaded guilty to child
pornography charges in May, is a serial child abuser who would harm
others if ever given the chance.
“He
used his mother’s day care as a personal hunting ground for victims,”
Assistant U.S. Attorney Christy Muncy wrote in her sentencing memorandum
to the judge. “Keith produced child pornography. He traded it. He
collected it.
“Andrew Keith represents an undeniable danger to society.”
Keith
faces at least 30 years in prison when he is sentenced in January. But
Muncy asked U.S. District Judge Sandra Beckwith to sentence him to the
maximum 80 years, essentially a life sentence for the 27-year-old Keith.
Keith’s attorney could not be reached for comment and has not yet filed his sentencing recommendation with the court.
Keith
admitted in May that he abused and photographed at least three young
boys from 2002 to 2003, traded those images with others and collected
600 photos of child pornography on his computer. Prosecutors say he
obtained many of those images by bartering with other pedophiles over
the Internet, swapping his images of abused children for theirs “as if
they were baseball cards.”
Many of Keith’s photos show him abusing the boys or posing them in sexually explicit positions.
Keith’s
mother, Teresa Bailey, was charged with two counts of child endangering
that accuse her of failing to protect the children from her son. Unlike
her son, who faces federal charges, Bailey is charged with felony
counts in state court.
Keith
also could have been charged in state court, but police and prosecutors
are increasingly choosing to use federal child pornography charges when
possible. That’s because federal sentencing rules are tough and
pornography cases often are easier to prove than abuse cases that
require the testimony of young victims.
The number of child pornography cases in the federal courts has climbed from about 940 to 2,250 in less than a decade.
The
length of sentences also is on the rise, with 65 percent of those
convicted last year receiving at least five years in prison.
Prosecutors
say Keith deserves much longer because he is “not representative of the
typical child pornographer.” He found and abused his victims, they say,
and then subjected them to a lifetime of pain by putting their photos
on the Internet.
They
say he also threatened one of his victims, prompting the boy to falsely
accuse a neighbor child of abusing him instead of Keith.
An
evaluation of Keith found that he had been abused as a child, but
prosecutors say that does not minimize the harm he has done or the
danger he poses.
“There is significant need to protect the public from further crimes of the defendant,” Muncy wrote.

Sentencing delayed in child porn case

CINCINNATI — Sentencing for a Mason man convicted on 17 child pornography counts in federal court has been delayed indefinitely.

Andrew Keith faced 117 counts on charges he molested children at his mother’s West Chester Twp. home day care and then sent pictures out over the Internet. He plead guilty to 17 of the charges in May and was scheduled to be sentenced Tuesday, however Senior Judge Sandra S. Beckworth recused herself on Monday, delaying sentencing.

Assistant U.S. Attorney Christy L. Muncy has asked the court to sentence Keith to 80 years in prison. The minimum sentence would be 30 years behind bars.

The guilty plea agreement stated Keith swapped 15 photographs he had taken of himself sexually assaulting a minor male child with an individual in South Carolina who was under investigation for trading child pornography.

A federal investigation found he had taken sexually explicit photos of more than one child, and other images possessed by Keith included images of children as young as infants being sexually abused.

“The total number of images is well in excess of 600,” according to a statement released by the U.S. Department of Justice.

On Wednesday, a federal judge sentenced Andrew Keith, 29, of Mason,
Ohio to 80 years in prison for molesting boys at his mother’s in-home
day care and sharing photos he had taken of the abuse over the
Internet. Keith plead guilty to 15 counts of producing child
pornography and one count each of transportation and possession of child
pornography.

Fox 19 reports
that Keith traded 15 photographs he had taken of him sexually
assaulting a child with an individual in Las Vegas, Nevada who then
traded them with an individual in South Carolina who was under
investigation for trading child pornography.

The FBI searched Keith’s home, a storage unit, and all of his
electronic devices and found more than 600 images of child pornography
in his possession. Some of the images possessed by Keith included
images of children as young as infants being sexually abused, Fox 19 reports.

Prosecutors say Keith obtained many of those images by bartering with
other pedophiles over the Internet, swapping his images of abused
children for theirs, reports Cincinnati.com.

“Keith continued to exploit children by trading hundreds of sexual
abuse images he took with others,” said U.S. Attorney Carter M.
Stewart, according to a report by WLWT News 5 NBC.
“Because Keith used these images as a means of currency to receive
other images, the photographs are forever in the stream of commerce.
They can never be removed from the world wide web.”

According to Cincinnati.com,
prosecutors said Keith used his mother’s day care as a “personal
hunting ground for victims” and he routinely photographed the boys while
he abused them.
