Day 7 begins with twelve retained potential jurors:
1340 - Male - middle age, white married w/ 7 yr old; manager, seems to want to be on jury
1232- Male - works for St. Pete times delivery - married w/kids no health/religious issues. Some impact on family, but wife could handle it. Not a gadget guy.
1129 - Male - hardship for work - insurance compliant analyst - only paid for 15 days - could use vacation - single - 60's
1398 - Female - volunteer counselor - retired - married - allergic to fragrance, trip north 29th June planned (tentative) - does not like interstate driving - 70s
1312 - Female - no hardship closing for home, can be accommodated. In divorce proceedings. Wedding at end of June. Not important enough to attend. Nobody to take care of. Works at hospital, would be reimbursed for Jury Duty
1019 - male - African American, no hardship, no financial, medical, family, employed IT, employer won't hassle for time off, thinks he will be paid
1055 - female - 20s - no hardship, has family, no children, husband no objections, student on summer break until August
1319 - female - hardship. Doesn't want to judge. Feels religious beliefs prevent her from serving. No financial, medical, family issues prevent her from serving. (African American)
1407 - male - no hardship. Unemployed, lives at home. Goes to school.
1251 - Female - exp. hardship; is an elementary teacher - school ending but not at end of year yet; is a DROP retiree - needs to get paperwork done
1429 - Female - no hardship; has no computer!; retired; only med is diabetic
1119 - Male - no hardship; no financial hardship

1426 - Male - has no hrdshp; sounded young; will be paid by work; no medical concerns
1159 - White male in his 30's, married, wife employed, one child.
3397 - Male - exp hardship; is a trader for Raymond James; paid by work; had back surgery last fall needs to stand and walk frequently
The Defense has exercised two (2) peremptory strikes. State had used two (2).

Bozo for the duhfense, move to excuse for cause; DP - mitigating factors of age and mercy, presumption of innocence.
State objects to excusing for cause, Court will define law as to age. Juror not closed minded and willing to follow law. As to presumption of innocence, she stated she can assume innocence.
Judge Perry as to DP and mercy, no instruction on mercy. Dealing with presumption of innocence, question is asked, juror said yes as he understood, juror stated no opinion.

Judge does not believe she has an opinion.
Defense found her open and honest and thinks she was candid in first response.
State believes Court cleared that up - no initial opinion from pre-trial publicity. She recognized Mr. Baez and Burdick states he did not put forth a negative opinion.
Bozo says it could have been him or Mason, clarifying point. No positive publicity.
Judge sites opinion on equivocal or conditional answers. I this case the juror had no equivocation. Challenge denied. Peremptory strike?

Defense moves to challenge for cause - physical hardship. Gave answers Judge wanted to hear. He stated issues with difficulty concentrating because of discomfort.
Judge asking did either side challenge his excusal for cause in the first round.
Defense says yes, they did, but he demonstrated today his discomfort. Also claiming his statement that there was no doubt defendant was involved.
Judge asking did anyone question what her involvement was?
Bozo said no. But client is offering plea of not guilty, not somewhat involved. DP position on following rules was I'll try to. Vague word. All "i'll try's rises to exclusion for cause.

Not a disqualification. what he'll do here is pretty much the same as he does every day. Publicity - he said he couldn't say she was guilty, my job is to give presumption of innocence. Judge asking about peremptory strikes.
Both sides wish to do so in the morning.
Judge will bring in 3 or 4 more PJs for the morning. After questioning, the Judge will ask them to exercise some challenges. He can not force them to do so. He will have staff notify the 17 plus others to be here.
Then he will bring in the first 12 to be sworn plus extras as alternates. Then he will decide if he needs more alternates. One peremptory strike allowed for each added alternate.
He originally wanted 8 alternates but they will have what they will have.
See you at 8:30 AM!
