"Those mitigating factors are: age, lack of maturity, lack of impulse control, history of sexual abuse, suffers from insomnia and nightmares, lack of parental guidance, mother and father failed to protect her as a child, verbally and emotionally abused as a child, taught poor coping skills, taught to project false appearances, used as a decoy or pawn by parents and a scapegoat for parental misconduct, good conduct in school, above average grades, sports, loved Caylee and Caylee loved her, good detainee at jail--" Finnell cited as mitigating factors until Perry cut her off.


Judge Perry disallowed Finnell following this line of questioning concerning specific mitigating factors..

Judge Perry has decided that at the rate they're going,they will finish only 2-3 more today. Tomorrow he will impose time limits.

as of 4:30 or so - juror #3 is still being questioned - penalty phase - finnell questioning.

The defense is challenging the 3rd PJ of the day, #1129, for cause based on pre-trial publicity, DP and LE bias.

LDB for the State responding; PJ stated he can set aside preconceived notions of guilt or innocence.

Response by Bozo for Defense; citing case law, close cases should be resolved by release for cause.

Judge denies request for cause on LE bias or DP. Also denies challenge for cause on basis of pre-trial publicity.

Per Bozo; Defense reserves the right to back strike. (Peremptory strike)

4th PJ of the day, #1398, retained. No challenges from State or defense.

5th PJ of the day, #1152, excused for hardship.
