Witness: Casey ‘pretty happy' after disappearance
By Emily Cassulo and Brandon Hamilton
Excerpt:
Orlando, FL — The first-degree murder case against Casey Anthony will continue after Chief Judge Belvin Perry denied a motion for acquittal presented by the defense. Testimonies from the defense will begin Thursday at 9 a.m.
Around 11:15 a.m. Monday, Perry took the stand and introduced several cases which he used as the basis of his denial of the defense’s motion for an acquittal.
“The key argument is whether or not is if there is one or more single act that leads to the abuse or death,” Perry said. “In this particular case there is more than a single act.”
He said several pieces of evidence, like the duct tape and presence of chloroform, led to his decision.
“Considering the evidence in the light most favorable to the state and reviewing all of the evidence and considering the test that has been laid down by the Florida Supreme Court, the defense motion for judgmental acquittal as the counts one through seven are hereby denied,” Perry said. “These are strictly questions for the jury to decide.”
