Police investigate 11-month-old's fractured skull leading to her death
Posted: 09/15/2010
MANATEE COUNTY, Fla. - Manatee deputies are investigating after an 11-month old died from head seizures Tuesday, authorities said.
On Monday night, deputies responded to a call on Manatee Avenue West about an 11-month old girl that was unresponsive.
The first investigation led authorities to believe that little Payton Nash had a possible medical seizure.
But when the baby was taken to Manatee Memorial Hospital, a skull fracture was discovered. The child was then transported to All Children's Hospital in critical condition, and pronounced dead Thursday.
Detectives said that since the investigation began, there have been inconsistencies between the stories of the child’s mother, 19-year-old Windy Nash and her live-in boyfriend, 19-year-old John Morico.
In the last interview, Morico said he tripped with the child in his hand, accidentally falling on her.
Morico has been charged with Child Neglect with Great Bodily Harm, the mother is not currently charged.
The investigation is ongoing with the possibility of additional arrests and charges.

Man Who Fell on Baby,
Killing Her, Now Charged
with First Degree Murder;
from Grand Jury Indictment
On Thursday, Sept. 22, 2011, a Manatee County Grand Jury returned an indictment of First Degree Murder, in that Morico "...unlawfully and feloniously and from a premeditated design..." caused the death of Payton Nash, 11 months old, on Sept. 12, 2010.
MANATEE COUNTY, Florida [NMT] -- The Manatee County Sheriff's Office has charged John Thomas Morico, 20, formerly of 3807 Manatee Avenue West, Lot 11, Bradenton, with First Degree Murder in the death of his girlfriend's 11-month-old daughter on Sept. 12, 2010. New evidence in the case caused a grand jury to indict Morico for 1st Degree Murder.
As NewsManatee earlier reported, on Sunday, Sept. 12, 2010, at about 8:40 p.m., EMS and the sheriff's office was called to 3708 Manatee Avenue West regarding a "medical issue" with a young child (See NewsManateearchive.com).
The baby girl, Payton Nash, 11 months old, lived at lot 11, but had been taken to a neighbor's residence.
An injury had occurred to the child and she was transported by EMS to Manatee Memorial Hospital where she was seen by a doctor. It was determined that the child had a skull fracture and was bleeding in her brain, the report said. The child was then transported by Bayflite medical chopper to All Children's Hospital in St. Petersburg.
The child was unresponsive while at All Children's Hospital and at 3:35 a.m. on Tuesday, Sept. 14, 2010, the child was pronounced dead.
On that day, while at Child Protection Investigative Division of the sheriff's office at 5651 Manatee Avenue West, Bradenton, an interview was conducted with John Morico.
He said he was carrying Payton in his arms as he entered his residence. He tripped over the corner of the pantry that is connected to the entryway. He lost hold of her, he said, and came down upon her, forcing his elbow into her head with all of his weight as he was falling, the report said. He said when he fell on her she made a noise he could not describe.
The child began a distressful cry for about 5 to 7 minutes, he said. Then she fell silent and was placed in the bedroom by her mother, Windy Nash, presumably to go to sleep.
Morico said about 10 to 15 minute later he told his girlfriend and the mother of Payton, Windy Nash, that he had fallen on top of the baby with full force. He then began watching a movie with Windy, then exited the residence to have a cigarette. While attempting to light the cigarette, he asked Windy to go inside to get him a lighter. Windy went inside to do so.
After Windy went inside, she ran out with the baby. That is when EMS was called by the neighbor.
After his statement, Morico performed a reenactment of the incident for detectives, using a plastic lifelike doll.
Morico was originally charged with Child Neglect Resulting in Great Bodily Harm. Then the charge was upgraded to Aggravated Manslaughter.
Since the investigation began on September 12th, 2010, detectives have determined there were inconsistencies with the stories of the child’s mother Windy Nash, 19, and her live-in boyfriend, Morico, according to Dave Bristow, spokesman for the sheriff's office, who spoke to NewsManatee on Tuesday.
Court documents revealed there were two prior incidents when Payton was injured by Morico. In both incidents, which occurred two and three days prior to the last incident, they resulted in head injuries to the child. Prosecutors intend to use these two prior incidents and the final incident to show Morico’s intent to injure, which ultimately led to the death of the child.
The State Attorney's Office presented the evidence in the case to the grand jury, which has now determined there is sufficient evidence to indict Morico on a charge of First Degree Murder.
Morico was charged on Sept. 23, 2011, for the First Degree Murder charge.
He remains in the Manatee County Jail without bond.

Manslaughter charge filed against Bradenton mother
May 16, 2012 at 11:53 a.m.
MANATEE COUNTY - A mother whose boyfriend is imprisoned
because of his role in the death of her child now faces a criminal
charge in the girl's death.
Windy Nash
Manatee County Sheriff's Office
Manatee County Sheriff's detectives have arrested Windy Nash, 21, formerly of Bradenton and most
recently of Cambridge City, Ind., on a charge of aggravated manslaughter of a child.
On Sept. 14, 2010, Nash's 11-month-old daughter, Payton Nash Moistner, died from a
head injury. Investigators say they later learned that the fatal injury
was one of several head injuries the infant had received over a two-week
period.
After most of those injuries, the child received no medical attention, detectives say.
Nash's live-in boyfriend, John Morico, was convicted on a manslaughter charge
in connection with Payton's death. The 20-year-old man is serving a 10-year prison sentence.
Morico claimed that he tripped while holding the infant, causing him to fall on her and fracture her skull. He said the girl cried for several
minutes and, after she stopped crying, he placed her in her bed.
After Nash returned home, Morico told her he fell on the girl.
Nash ran out of their trailer home with the unresponsive baby to a neighbor, who called paramedics.
At Bayfront Medical Center in St. Petersburg, doctors determined that the
child was bleeding in her brain. She died two days later.
Investigators now say that they have evidence of five incidents of Payton suffering
head injuries during a roughly two-week period, including the fatal
injury she received on Sept. 12, 2010.
On Aug. 30, 2010, Nash moved from Indiana to live with Morico and his mother. After her arrival with
the baby, detectives say the following happened:
•
A stroller fell on top of Payton in the living room, causing her eye to
be swollen shut. Morico's mother insisted her son and Nash take the
child to an emergency room.
• A wooden chair fell on top of the infant, again injuring her head. No medical treatment was sought for the girl.
•
Morico indirectly struck the infant while having sex with Nash in the
bathroom. Morico was lying on the floor when he sat up, striking a door
that hit Payton's head — causing the infant to fall backward and
possibly hit a bed frame. The girl again received no medical attention.
•
Nash took a shower with her daughter after returning from the beach and
Payton fell in the tub, hitting her head again. The girl again received
no medical attention.
Detectives say Nash is criminally liable because she was aware of her child's previous injuries and did not protect her child.

Finally this bitch has been arrested.
I think she moved thinking all would be forgotten and she was home free. The long arm of the law reached out at long last and she is where she needs to be, in jail.
I can't find anything on the murdering boyfriend but according to this article he is in prison for the death of this poor baby.

I agree Twink. I hope they lock this POS mother away forever. Not likely, but that's what she deserves. She had total disregard for the poor baby who was tortured until she died.
