Bail remained at $25,000 Wednesday for a Gardnerville Ranchos man
accused of fracturing his 3-month-old daughter's skull and leg.
East
Fork Justice Pro Tem Paul Gilbert refused to lower the bail for
Jonathan P. Flagg, 31, who is charged with felony child abuse or
neglect.
Flagg's lawyer, Derrick Lopez, said his client couldn't afford to post bail.
He asked that the amount be lowered, or that Flagg be released on his own recognizance.
“Mr.
Flagg has never failed to appear for any of his court appearances. His
home is here, he has lived here virtually his entire life,” Lopez said.
Lopez said Flagg would live with his grandparents.
“His
child is here, obviously the source of the charges against him, but if
he ever hopes to have a relationship with her, he would have to appear
in court,” Lopez said.
Prosecutor Erik Levin opposed the request.
“He
(Flagg) has got a prior felony conviction. This is a serious charge, he
has two prior convictions for child abuse. I think the bail is
appropriate,” Levin said.
Deputies were called to Flagg's residence Oct. 19 after he said the baby fell off a bed.
Investigators were contacted after medical personnel concluded the injuries were not consistent with a fall.
According
to the sheriff's report, the baby, who was born July 15, had two skull
fractures, a fractured leg, bruising and other injuries.
Deputies said Flagg appeared to be under the influence of a controlled substance.
After he gave them permission to search his residence, officers found 20 hypodermic needles, drug paraphernalia and marijuana.
Flagg reportedly told deputies he had used methamphetamine on Tuesday.
He has had eight prior contacts with law enforcement since 2000.
Flagg
was sentenced in 2004 to one year in Douglas County Jail after he
pleaded guilty to two gross misdemeanor counts of child abuse and
neglect involving injuries inflicted on a six-month-old baby boy.
The
child suffered bite marks, skull fractures and other head injuries. The
baby's mother — Flagg's then-girlfriend — was sent to prison in
connection with the crime.
In December 2007, Flagg was ordered to
serve nine months in Douglas County Jail for punching a man in the jaw
during a fight at a Stateline night club.
In December 2009, he
was ordered to serve 34 months in prison for failing to repay $1,600 in
bad checks and using methamphetamine in violation of his probation on
the check charge.
He was eligible for parole after 12 months.
Gilbert set another hearing for Wednesday, and confirmed a preliminary hearing for Nov. 4.

The mother of a 3-month-old girl who suffered two skull fractures and a
fractured leg is to plead guilty Tuesday in district court to
allegations that she was unable to protect the infant because of her
drug use.
Allisha Haltom, 25, waived a preliminary hearing Friday and is to plead guilty to child abuse, endangerment or neglect.
In
a plea agreement with the district attorney's office, Haltom will not
be charged with causing substantial bodily harm. Two drug charges are to
be dismissed after she enters her guilty plea.
“Her drug use prevented her from caring for the child,” said Kris Brown, Haltom's attorney.
The
baby's father, Jonathan P. Flagg, pleaded not guilty to felony child
abuse or neglect. He is set for trial March 19 before District Judge
Dave Gamble.
The baby was hospitalized Oct. 19 with two skull
fractures, a fractured femur and other injuries. She was released to the
custody of Child Protective Services.
Shortly after Haltom's
arrest, she was charged with possession of a controlled substance, and
using and/or being under the influence of a controlled substance,
heroin.
Deputies reportedly found heroin in her clothing when she was taken into custody.
The
criminal complaint stated that she continually placed the baby in the
care of Flagg knowing that he was physically abusing the infant or
knowing that the abuse was likely to happen.
East Fork Justice Tom Perkins set a Jan. 18 date for dismissal of the drug charges.
Prosecutor
Tom Gregory said Haltom faces up to six years in prison. Both sides
have agreed to recommend a sentence of 12-30 months.

OMG...this couple was convicted of similar child abuse charges on a prior baby not to mention they are drug addicts. How did they have another baby without DHR knowing about them? This baby should have been taken away at birth and they should sterilize both abusers.
