Equusearch asked to help find missing Florida mom who was on People's Court
HOUSTON (KTRK) -- From Natalie Holloway to Caylee Anthony, the local organization Texas Equusearch has lead the search for some of the world's most high profile missing people.
There's another call for it's help. This one from Orlando, Florida, but the group's founder, Tim Miller, is hesitant to go there.
The family of Michelle Parker released home video of her carving pumpkins with her children in Orlando just weeks before she disappeared. It was around the time Parker made an appearance on the TV show People's Court where she appeared with her ex-fiancee, Dale Smith.
On, Tuesday Smith's attorney contacted Texas Equusearch asking for help in the search.
"I got contacted today and the ex-fiancee wants me to come out there, wants to go ahead and expand the search, actually wants to be out there with me," Texas Equusearch founder Tim Miller said.
Police believe Smith knows something about what happened, but his attorney, Mark Nejame, says reaching out to Equusearch was at his client's request.
"He is specifically requesting and asking for a full scale search team to come into central Florida, headed by Tim Miller, the foremost searcher in the United States from Texas Equusearch, to help find her. What guilty person would do such a thing?" Nejame said.
Nejame is a high-profile Orlando attorney who once represented Casey Anthony's parents.
Miller says he's been hesitant at times to go back to Florida because of the Anthony case. Equusearch has a pending lawsuit against the Anthonys, alleging Casey Anthony committed fraud because she knew her 2-year-old daughter was dead and not missing, while Equusearch turned down other requests for help.
But Miller says this request comes down to a 33-year-old mother of three.
"No matter what people are saying we've got one fact: we've got a lady that's missing, so let's do everything we can do to see if we can get her located," Miller said.
Miller says he will be talking to Orlando police Wednesday morning and could be in Orlando by the end of the day.

An emergency custody hearing to determine who will care for Michelle Parker's children is scheduled for this morning at 10:30 in Orange County.
The Department of Children and Families removed her twin toddlers from their father's care Tuesday, a day after Orlando police named Dale Smith II as the sole suspect in Parker's Nov. 17 disappearance. The 3-year-old twins were placed in protective custody.
Officials removed the twins after they were interviewed by police, but it's not clear what was gleaned from the toddlers, if anything.
On Tuesday, Parker's family hired Morgan & Morgan to represent them. Attorneys could hold a press conference today, said lawyer Matt Morgan.
Smith retained high-profile attorney Mark NeJame shortly after police named him as a suspect.
NeJame insisted Smith has no knowledge of Parker's whereabouts and is not responsible for her disappearance, he said Tuesday.
NeJame held a press conference Tuesday to deny Smith had anything to do with Parker's Nov. 17 disappearance — or her death, if that is the case.
Investigators have not indicated they think the woman is dead and declined to comment on NeJame's suggestion that she might be.
"Statistics sadly suggest that when someone has been missing for 12 days that there has been a homicide," NeJame said. "One never wants to give up hope … but after 12 days when there are no signs and no indications, it suggests that someone is no longer with us."
No matter what happened to Parker, NeJame said his client is innocent. Smith, 40, did not attend the press conference at the lawyer's office.
Smith was the last person to see Parker when she left their 3-year-old twins at his home around 3:13 p.m. Nov. 17. Smith immediately took the children to his parents' home, arriving at 4:30 p.m., NeJame said.
His lawyer told reporters it wasn't "physically possible" for Smith to kill Parker, dispose of her body, dump her car and drive their children to his parents house in 72 minutes.
He did not say whether Smith remained at his parents' house after arriving.
Late Tuesday the Department of Children and Families removed Parker's 3-year-old twin toddlers from Smith, who had been caring for them with his parents. An emergency custody hearing is scheduled for this morning.
Police investigators have interviewed the children several times, but it's unclear what has been learned.
Also Tuesday, Parker's family retained the Morgan & Morgan law firm to represent them.
"We are going to help navigate them through the legal process," lawyer Matt Morgan said. "They are unfamiliar with what they are going through and we will offer guidance and advice."
Anyone with information about Parker's disappearance is asked to call Crimeline at 1-800-423-8477

Authorities search lake for missing mom; Children returned to father
Michelle Parker missing since Nov. 17
ORLANDO, Fla. -
Authorities on Wednesday are searching an area near Lake Ellenor in south Orange County for a missing Orlando woman, and a judge has decided to return custody of her children to their father, the only suspect in her disappearance.
More than 30 people from the Orlando Police Department and the Orange County Sheriff's Office are searching the area near Lancaster Road and Orange Blossom Trail, not far from where the last ping on Michelle Parker's phone was registered.
Dive teams and search crews on boats searched the lake while K-9 units helped searched the ground around the lake. The search area is less than two miles from Smith's father's house as well as where Smith works.
Police have not said what prompted the new search.
The Police Department officially named Smith, 40, as a suspect in Parker's disappearance on Monday.
Tuesday, the Department of Children and Families took custody of the couple's boy and girl twins from Smith, but a judge dismissed DCF's petition to place the children in protective custody for custody and returned the toddlers to Smith.
The judge said there is not probable cause sufficient enough for him to sign the petition and Smith is not an imminent risk to the children.
The judge said that if the children had witnessed anything regarding the disappearance of their mother, they would have said something when they were interviewed by investigators on Tuesday.
Smith recently retained prominent Orlando attorney Mark NeJame, who has previously represented the Anthony family and Tiger Woods. Parker's family is represented by Matt Morgan of Morgan and Morgan.
During the hearing, NeJame cited that there is no history of abuse

Parker Custody Hearing: Judge Decides In Smith's Favor
DCF Says Children At Risk With Smith
ORLANDO, Fla. -- A judge ruled in Dale Smith's favor at an emergency hearing Wednesday to decide the custody of his and Michelle Parker's two children.
The Department of Children and Families removed the children from Smith's care as police continued to call him the prime suspect in Parker's disappearance.
The Parker family wanted the children to stay with them as investigators continue to search for the missing woman.
Attorneys for DCF argued the children are not safe with Smith. They cited a history of violence against women he was involved with as evidence of a "significant future risk" to the children.
DCF's attorneys argued that the children should stay with Parker's family instead.
Mark NeJame, Smith's attorney, argued there wasn't any evidence the children are in danger by staying with Smith.
Ultimately, the Judge decided to rule in favor of Smith, pending any developments in Parker's disappearance.

Michelle Parker missing: Suspect Dale Smith keeps twins
Judge rules missing Michelle Parker's twin toddlers will go back to their father, Dale Smith — the suspect in her disappearance.

As authorities stepped up their search for Michelle Parker, a judge this afternoon ruled that the suspect in her disappearance — Dale Smith II — can keep their twin toddlers.
Less than 24-hours after the 3-year-old boy-girl twins were taken by the Department of Children and Families, Orange Circuit Judge Thomas W. Turner said the petition to remove them from Smith's care was "premature."
"I don't believe there is probable cause to grant the petition," Turner said at the conclusion of a 45-minute hearing at the Orange County Juvenile Justice Center on Michigan Avenue.
The twins, who were temporarily turned over to Parker's mom Yvonne Stewart, will be returned to their father today, DCF spokeswoman Carrie Hoeppner said.
Investigators from the state agency filed a shelter petition because they believed the children were in imminent danger of being harmed by their father due to his history of violence with women, including their missing mother.

After listening to DCF detail Smith's run-ins with the law, former addiction to a hallucinogenic drug, his dishonorable discharge from the military, the completion of a lengthy prison sentence on drug and domestic violence convictions and allegations from Parker's eldest child that Smith attacked their mother in front of all three children – Turner determined the toddlers belong with their father.
Parker's sister, Lauren Erickson, cried during the part of the hearing and left before court was adjourned.
After the ruling Stewart hugged Smith and whispered in his ear.
"I told him that I want to see my grandchildren," Stewart said with tears in her eyes. "It's going to be OK."
Stewart and her family spent Tuesday evening with her grandchildren for the first time since Parker vanished on Nov. 17 after dropping the twins off with Smith.
While the hearing was underway, Orange County Sheriff's Office joined the search for Parker at Lake Ellenor. The Sheriff's dive team, an air boat, a pontoon boat, two personal watercrafts and a K-9 unit were at the lake.
Around 11:30 a.m., divers suited up before jumping into the lake, off Oak Ridge Road and Orange Blossom Trail.
A police spokesman said they have not received any specific information that prompted the search. The area is being searched because it is in the general vicinity of the last signal from Parker's iPhone.
,
On Tuesday, Smith's attorney Mark NeJame held a news conference to deny Smith had anything to do with Parker's Nov. 17 disappearance — or her death, if that is the case.
Investigators have not indicated they think the woman is dead and declined to comment on NeJame's suggestion that she might be.

ORLANDO, Fla. —
There are new developments on Wednesday in the case of missing Orlando mother Michelle Parker. An intense search for Parker is under way in Lake Ellenor and in a wooded area near Oakridge Road. Also on Wednesday, during an emergency hearing, a judge ruled that Dale Smith Jr., the prime suspect in Parker's disappearance, will keep custody of their two children.
Tuesday, the Department of Children and Families took the children into protective custody. However, on Wednesday, the judge said there wasn't enough evidence to remove the children from Smith's care, but if more evidence comes forward, the court will revisit the issue.

Re: MICHELLE PARKER -33 yo - Orlando FL
ORLANDO, Fla. – A body found on the side of a road in south Georgia is not missing Orlando mother Michelle Parker, police said Wednesday.
A truck driver found the body Wednesday afternoon on the side of Interstate 95 in Camden County, Georgia and alerted detectives, myFOXorlando.com reported.
A spokesman for the Camden County Sheriff's Office said they were aware of the search for Parker, but did not speculate on the identity of the body -- believed to be a white female.
However, the Orlando Police Department issued a statement Wednesday evening saying the body was not Parker.
"The body that was found in Georgia IS NOT Michelle Parker. I do not have any details concerning the identity of the deceased," Sgt. Vincent L. Ogburn Sr. said, without elaborating further, according to online news site First Coast News.
Camden County Sheriff Tommy Gregory said the body had been there for some time.
The coroner's office will conduct an autopsy to determine the cause of death while investigators looked into a possible homicide, Gregory said.
Meanwhile, authorities in Orlando intensified their search for Parker by sending a dive team to Lake Ellenor, 13 days after she vanished.
The Orlando Sentinel reported that police had not received any specific information to lead them to the lake but were sweeping the area because it is near where Parker's iPhone last transmitted a signal.
Authorities from multiple jurisdictions were using boats to conduct a grid search of Lake Ellenor, while officers were sweeping the neighboring area on foot, myFOXorlando.com said.
A K9 unit was also searching a wooded area near the lake.
Earlier Wednesday, a Florida judge ruled that Dale Smith, the main suspect in the disappearance of his ex-fiancee Parker, could retain custody of the couple's children.
The 33-year-old mother disappeared on Nov. 17 after the airing of an episode of "The People's Court" on which she and Smith appeared to settle a dispute over a $5,000 engagement ring.
Parker and Smith are the parents of three-year-old twins. Smith had been caring for their children since Parker's disappearance, but on Tuesday the Florida Department of Children and Families placed the children under the protective custody of Parker's mother Yvonne Stewart.
At an emergency custody hearing Wednesday morning, a state official told a judge that Smith had a history of abusive relationships with women and could endanger his children, the Sentinel reported.
The state official detailed Smith's past addiction to a hallucinogenic drug and his convictions for drug possession and domestic violence.
However, Orange Circuit Judge Thomas Turner said an order to remove the twins from Smith's care was "premature."

Bar where Michelle Parker worked holds fundraiser
SANFORD --
It was one of the first signs of her disappearance. Missing mom Michelle Parker didn't show up to work at The Barn night club the night she went missing, and it was at that moment loved ones knew something had gone terribly wrong.
Thursday night, managers at the The Barn night club threw a fundraising event to help the family in their efforts to find Michelle Parker who's been missing for two weeks.
A Thursday night is one she would normally be there working.
Her co-workers wanted to help Michelle's family out and make sure each one of the hundreds of people there know more about her disappearance, see her picture and hopefully help get her back home.
“We had bartenders take different routes to work just to make sure she wasn't stranded on the side of the road,” said The Barn manager Erica Thims.
Thims would often bartend right beside Michelle. She said she spoke with Michelle at work just a few days before she was last seen.
“Nothing out of the ordinary for her, she didn't seem upset about anything, or anything was bothering her,” said Thims.
Eric Thims, another manager at the bar, said he'd seen Michelle's ex-fiancé in the past, but never saw anything out of the ordinary.
Since Michelle's disappearance he said he’s paying much more attention to his employees’ well-being.
“Just making sure everybody is safe getting were they need to go, some of them even call in after they get home letting us now they got home fine,” said Thims.
“We miss her so much, the last couple weeks every night that we're here that she's supposed to be here it's just not the same, it feels like you're always waiting for her to come to work and she's not,” said Erica.
Investigators said they have been to the bar and spoken to co-workers.
Thursday night, co-workers of Michelle and bartenders from other bars, who also know Michelle, worked in rotations to raise money that will be donated to the family.
Night club managers are also planning several other events.
Friday, a silent auction will be held starting at 7 p.m.

A line of searchers head into a wooded area around Lake Ellenor in the search for Michelle Parker.
Michelle Parker search goes into Friday as family gets ready for benefit
ORLANDO --
A benefit tonight and Friday will benefit the children of Michelle Parker, the mother of three who disappeared two weeks ago. This as the case gets some high-profile help.
Tim Miller, the founder of Texas EquuSearch, is expected to join the search effort Thursday.
EquuSearch has notably helped with other high-profile cases, including the searches for Caylee Anthony and Natalee Holloway. The group's Florida division has already begun assisting Parker's family.
On Nov. 17, Parker, 33, dropped off her 3-year-old twins two weeks ago with their father, her ex-fiancé Dale Smith II. Parker has not been seen since then, and Orlando police have called Smith their prime suspect, although he has not been arrested or charged in the case.
A judge ruled Wednesday's that Parker's twins can stay with Smith. The family fought for custody of the twins, but a judge ruled that there was no evidence that Smith might be violent toward the children. He has a history of domestic violence toward Parker.
During an interview with CNN, Parker's sister, Lauren Erickson, described her family's relationship with Smith:
It's been very up and down, just like their -- his relationship with Michelle. Obviously, she's my sister -- we're sisters. We talk, and of course I'm going to, you know, not like the person who hurt her in the past, in whatever way it may be.
I think with the whole hug thing that happened, those grandchildren, that's still their father. And if, God forbid, if this comes out and everybody points the finger one way, and then it turns out it wasn't him and we lose those kids forever.
We still need to have a good relationship there, and everything like that. She just wanted him to know that in her heart of hearts, that she's really praying for the best outcome for all of us for this.
Trying not to break down, Parker's mother Yvonne Stewart explained it came as she fought to protect Parker's twins.
“In this country, grandparents have no rights," Stewart said. "Even though I've raised them for three years, and this is what they know. They want to be with their brother, he doesn't understand any of this and I'm like 'you have to do what they say right now' and it's tough.”
Stewart got to spend time a little bit of time with the twins before she had to turn them back over to Smith.
For now, she hopes they are in good hands with their dad, as she returns her focus to finding her daughter.
“I feel sorry for Michelle,” Stewart said. “I feel sorry for her. Don't feel sorry for me.”
Parker's boss never filled her position.
The missing woman's family and local celebrities will take turns tending bar at Parker's workplace. The benefit starts at 7 p.m. at The Barn in Sanford. On Friday at 7 p.m., The Barn will also hold a silent auction. Proceeds from both nights will go to the Parker Children Trust Fund.
Meanwhile, search crews are back out Lake Ellenor, where they began searching Wednesday, looking for clues in this case.
Officers used machetes to fight through heavy brush. appearing to search in the area around the lake like a grid. There are also dozens of officers on foot and on horseback.
It also appears these crews will be back Friday as well.

Suspect In Michelle Parker Case Collides With Cameraman
Volunteers joined Texas EquuSearch at Lake Ellenor, where Michelle Parker's cellphone signal was last detected two weeks ago. Authorities said the search yielded no new clues.
Investigators expanded the search area for the 33-year-old in and around Lake Ellenor on Thursday. Crews scoured the woods and water and checked Dumpsters. Parker's mother, Yvonne Stewart, said she believes her daughter is still alive.
"I know you guys might think I'm in denial, but I know they're just not going find her in the lake. They're just not," Stewart said.
Parker's co-workers at the Barn in Sanford are trying to help her family get by.
Friends, family and co-workers put all the conflicts in the case aside on Thursday to raise money for the search and help her kids. The huge turnout showed how much Parker is loved and missed.
"No one wants to fill her spot; we just want her home," said Barn manager Erica Thims.
Co-workers said Parker worked at the Barn until she vanished two weeks ago, and now, they are taking turns at her station and donating their tips to help find their friend and support her three small children in her absence.
"We miss her. Every time we walk through the door, it's a reminder. But you come in with positive thoughts and hope very soon, she'll be standing right where I'm at," Thims said.
Meanwhile, video footage has surfaced of Dale Smith, who is Parker's ex-fiance and the prime suspect in her disappearance, knocking down a TV news photographer on his way into court.
Officials with the Department of Children and Families said they'll review the footage in their investigation into whether he should have custody of the couple's children.
"We have concerns about the potential for violence or reaction with the father," Department of Children and Families spokeswoman Carrie Hoeppner said.
The photographer said he's leaving his options open, including pressing charges against Smith.
From one angle, Smith can be seen entering court Wednesday before being awarded custody of his children and colliding with the freelance cameraman, knocking him into a metal sign.
Another angle showed Smith apparently throwing his body toward the cameraman, who suffered scrapes to his arms, a cut leg and elbow pain.
After video of the incident aired on national TV, the Department of Children and Families announced it's looking into whether Smith's behavior presents a risk to the 3-year-old twins he had with Parker.
"I continue to stand firm on the petition. We really felt we presented a background of violence -- still a potential threat," Hoeppner said. "Unfortunately, it was not brought to our attention beforehand."
The photographer involved in the incident said he planned to go to a doctor to assess the extent of his injuries. He said he'll decide then whether to press charges against Smith.
The search continues for Michelle on Friday.

Michelle Parker: Mom begs media not to print pictures of grandkids
Michelle Parker’s mother made a plea to the media this morning on NBC’s “Today.”
“We thank you,” Yvonne Stewart said. “The one thing we do want to ask you, all the media, we appreciate everything you’re doing for us. Please, please, don’t print pictures of our grandchildren.”
Parker disappeared two weeks ago today, and Orlando police have identified her former fiance, Dale Smith, as the primary suspect. Local news stations highlighted that the search for Parker would expand today.
On “Today,” Stewart talked about hugging Smith after a custody hearing Wednesday on the twin children of her daughter and Smith. “This is such an emotional experience, and it’s going so fast,” Stewart told NBC’s Savannah Guthrie. “I just wanted to let him know that we can help with those babies and we want to.”
Stewart told WESH-Channel 2: “I was compelled to just look that man in the eyes as a mother who is searching her heart out to find her daughter. Just tell us where she is, so we can bring her home.”

Michelle Parker: Mark NeJame blasts polygraphs, ‘trash TV’ on ‘Today’
The saga of missing mom Michelle Parker is gaining frequent attention on national television.
NBC’s “Today” provided an update this morning: Parker’s 3-year-old twins have been taken away from their father, Dale Smith. He has been identified as the primary suspect in Parker’s disappearance. Parker’s mother is caring for the children.
Prominent Orlando attorney Mark NeJame, Smith’s attorney, told NBC’s Matt Lauer that protective services gave no reason for taking the children. In what NBC billed as an exclusive, NeJame dismissed reports that Smith was the last person to see Parker.
“He’s not the last person to see her,” NeJame said. ”We know from a timed video from a neighbor that she pulled into his place at 3:18 that afternoon. At 4:30, he was at his father’s place. If you run a timeline on this, it’s physically impossible for him to have done what is being suggested. … In an hour and 12 minutes, he was supposed to, with the children present, have met her, killed her, disposed of the body, gone clear across the town, dropped off one vehicle, scraped off all the lettering on the vehicle, brought the vehicle back and then ended up at his parents.”

Michelle Parker missing: Her youngest children don't know she's disappeared
The Texas EquuSearch search-and-rescue team joined volunteers this morning in the ongoing search for Michelle Parker
SNIPPED:
Despite a lengthy criminal history and documented violence between Parker and her ex-fiance, an Orange County Circuit judge ruled Wednesday that the children were not in imminent danger by being in Smith's custody and ordered the children be reunited with their father.
Stewart took care of the twins for nearly 24 hours and said Thursday the children seemed healthy and happy.
However, before reuniting with the children, Parker's family took care to remove missing person posters and T-shirts with Parker's face on them. When the children asked for their mother, Stewart told them she was at work.
"It breaks my heart," she said.
The children have lived with Stewart and her family on-and-off for most of their lives and have bedrooms at her home. They wanted French fries and chocolate milk, so the family took them to McDonald's.
Once home, the twins played with their new Chihuahua puppy their mother bought for them recently and then got ready for bed.
The next day they were returned to their father, whom they are not accustomed to spending so much time with, Stewart said.
"It was heart wrenching because they were happy to be with us. I really know Michelle would want them to be with us," Stewart said. "I think we are going to work out some amicable grandma visit time."
Also Thursday, the founder of search-and-rescue group Texas EquuSearch arrived in Orlando to begin aiding in the search Parker at the request of the prime suspect.
Tim Miller planned to meet with his one-time lawyer Mark NeJame, who is also representing Smith, and requested to meet with Orlando homicide detectives who are conducting the investigation into the 33-year-old's disappearance, he said.
A police spokesman said detectives do not plan on meeting with Miller.
Earlier this week attorney NeJame said his client asked for Miller's help after Smith, 40, was named the prime suspect in Parker's disappearance. Smith has not been charged.
Miller and his search group came to Florida twice in 2008 to look for missing Caylee Marie Anthony, whose remains were found by a utility worker in December of that year.
Searchers from the Orange County Sheriff's deputies and EquuSearch volunteers resumed their search of Lake Ellenor, off Oak Ridge Road near Orange Blossom Trail, Thursday. Parker's iPhone last 'pinged' in the general vicinity on Nov. 17, the day she vanished.
Police declined to say what, if anything, was recovered.
Parker was last seen dropping off the twins with Smith at his home on South Semoran Boulevard around 3:15 p.m. Nov. 17. A message sent from her phone around 4:30 p.m. that day said she planned to go to the Waterford Lakes area. Her family became worried when she failed to show up for work at The Barn in Sanford that night.
Police found her Hummer abandoned the following day at an apartment complex in southwest Orlando.
The Orlando Sentinel hosted an on-line chat with more than 300 people Thursday. Members of the public posted questions about the investigation and gave their theories about how Parker may have disappeared.
Anyone with information about Parker's disappearance is asked to call Crimeline at 1-800-423-8477.
