A teacher at the five-year-old's south Memphis school noticed the child could barely walk. Police say the girl suffered severe bruises, lacerations and a swollen left leg.
The principal called police. Officers responded, and the girl was rushed to the hospital.
According to court documents, when staff members asked the little girl what was wrong she told them, "she was whipped by her mother, Jennifer Banks... everyday with a belt and a wooden ruler."
Police say Banks blamed co-defendant Kenon Pack for "whooping the victim." When questioned, she told investigators she only gave her daughter "love taps."

The 8-year-old girl will remain anonymous because she is a young victim in the case, and with beanie baby in hand, she took the stand.
The girl's mother, Jennifer Banks, and her mother's boyfriend, Kenon Pack, are accused of abusing her for months in 2010.
Prosecutors say the couple made the girl lean over a bench, while they repeatedly smacked her backside with two homemade weapons, a ruler and handle wrapped in tape, as well as a belt, two pieces of wood, and tape turned into a makeshift whip.

Prosecutors say the little girl was beaten for anything and everything, especially as she was potty training. If she had an accident, they say, she had to hold crates of books. A second accident resulted in a severe "whoopin'" the girl told the jury during a difficult day in court.
The 8-year-old girl will remain anonymous because she is a young victim in the case, and with beanie baby in hand, she took the stand.
The girl's mother, Jennifer Banks, and her mother's boyfriend, Kenon Pack, are accused of abusing her for months in 2010.
Prosecutor: When you moved in with Kenon, did anything bad start to happen?
Victim: Yessir.
Prosecutor: What started to happen?
Victim: The next day he started whoopin' me."
Prosecutor: How old were you?
Victim: Five.
Prosecutor: Did you have your clothes on when you got a whoopin'?
Victim: No sir.
Prosecutor: How often would you get these whoopin's?
Victim: Almost every day.
Prosecutors say the couple made the girl lean over a bench, while they repeatedly smacked her backside with two homemade weapons, a ruler and handle wrapped in tape, as well as a belt, two pieces of wood, and tape turned into a makeshift whip.
Investigators found the girl at Le Bonheur Children's Hospital in critical condition with old, new, and infected bruises on her backside that eventually required skin grafts.
"At some point at the hospital she was upgraded or downgraded to critical, which is not good and that was due to internal bleeding," said Lt. Carl Ray, Memphis Police Department.
Defense attorneys do not argue the girl was abused, but their question is, who did it?
Pack blames Banks. Banks blames Pack. Both Jennifer Banks and Kenon Pack face 15 to 25 years in prison if convicted as charged.
The trial will resume Thursday morning.

(WMC-TV) - A Memphis couple is on trial for punishing a little girl. Officers say they beat her with paddles.
The victim was just 5 years old at the time. Prosecutors say the girl's mother, Jennifer Banks, and her boyfriend, Kenon Pack, whipped her almost everyday for just about anything.
Eric Carlisle, a Memphis Police Department crime scene officer, was called to 2439 JoAnna Drive on December 20, 2010. He collected a piece of evidence, which was belts attached to a wooden handle.
Prosecutors describe it as a weapon used to smack the backside of a 5-year-old little girl's legs nearly everyday.
The couple was arrested and charged with aggravated child abuse after the little girl's school principal from Alcy Elementary noticed the girl having difficulty even walking. She called the police.
If Banks and Pack are convicted as charged they each face between 15 and 20 years in prison.
The principal testified tearfully as she described the student's injuries. The paramedic who treated the girl described the injuries as significant, which resulted in the girl going to Le Bonheur Children's Hospital where she was first downgraded to critical condition before ultimately making a full recovery.
The young victim, now 8 years old, lives in another state with other family members. She took the stand to testify Wednesday.

Prosecutors say the little girl was beaten for anything and everything, especially as she was potty training. If she had an accident, they say, she had to hold crates of books. A second accident resulted in a severe "whoopin'" the girl told the jury during a difficult day in court.
Jennifer Banks and her boyfriend, Kenon Pack, , accused of abusing Banks' daughter for several months in 2010.
8-year-old-testifies-against-own-mother-in-child-abuse-case]The victim, who is now 8 years old, bravely took the stand Wednesday to testify against her own mother.
Prosecutors say the pair used homemade weapons to repeatedly "whoop" Banks' five-year-old from early fall 2010 until December 2010, when the girl's teacher, nurse, and principal at Alcy Elementary School noticed the injuries on the girl's backside.
"It is our opinion and the doctor's opinion at Le Bonheur that had it not been for the teachers and the principal at Alcy Elementary that she would have died that night," said Prosecutor Eric Christensen.
Paramedics and doctors testified the girl lost nearly two-thirds of her blood and was downgraded to critical condition for nearly a day before ultimately recovering at Le Bonheur Children's Hospital. She required skin grafts to repair her injuries and has permanent scarring as a result of the abuse.
The girl currently lives with other family members in a different state.
Both Jennifer Banks and Kenon Pack face 15 to 25 years in prison. Defense attorneys plan to argue for the lower end of the sentence.
"Kenon has medical conditions that we've addressed with the court in the past and those medical conditions would cause a lengthy incarceration to be especially hard on him," said defense attorney Claiborne Ferguson.
Prosecutors say whatever the ultimate sentence may be, at least the little girl is now safe.
"She's going to school like she should be. She's not in harm's way," said Christensen. "And these people can't harm her anymore. So for us that's the real victory."
The little girl is now living with family members in another state.
The sentence hearing is scheduled for January 24, 2014.
