Both FOUND SAFE, in garbage cans?
Dayton police searching for two young children missing since Sunday
night say two men found them alive in trash cans outside an electric
company.
Dayton police Lieutenant Brian Johns says the
2-year-old girl and 8-month-old boy were reported missing by their
mother, who said her boyfriend took them after the couple argued.
Johns says the man was intoxicated and refused to tell police where the children were.
They were found Monday after one of the men heard crying. He says they
were covered in mud and sweating. Dayton Police Chief Richard Biehl
says the children were in the cans for about 13 hours.

This wasn't the first time
The Montgomery County Prosecutor’s Office has approved four felony
kidnapping charges, three counts of domestic violence, two counts of
endangering children, one count of tampering with evidence and one
count of inducing panic against the man who placed two young children
in a trash bin.
If convicted of all charges, Tommie L. Johnson Jr. faces up to 52 years in prison, according to the prosecutor’s office.
DAYTON - The man who police said confessed to taking two children
from his girlfriend’s home and dumping them in a city-issued trash bin
had taken them from the home before.
Officers responded to the children’s home in the 3900 block of
Palmerson Avenue in December after their mother, Alisha Whitehead,
called police to report a domestic violence incident.
Whitehead, 27, told officers then her boyfriend, Tommie L. Johnson
Jr., 39, took and walked the children to his wife’s house, according to
a police report.
Whitehead said Johnson hit her in front of their then 17-month-old
daughter Ashonti Johnson. A domestic violence packet was completed and
Johnson was arrested on charges of public intoxication on Dec. 11.
Ashonti, 23 months old, and her 8-month-old brother, Tommie Johnson
III, were taken from their home again on Sunday, July 26, by Tommie
Johnson Jr. after another domestic violence incident in the 400 block
of North Cherrywood Avenue, according to police.
Johnson dumped the children in a trash bin where they sat in filth
and mud for as long as 13 hours before being found by two electricians
Monday morning, Chief Richard Biehl said.
Johnson and Whitehead have had numerous experiences with police.
Johnson has been arrested at least eight times since 2003 on charges
related to domestic violence, public intoxication and assault.
Whitehead was arrested in June for soliciting an undercover Dayton
police officer in the 1400 block of Cherrywood Avenue, according to a
police report.
Whitehead offered to perform a sex act on the officer for $20, the
report stated. Whitehead told the officer she did not prostitute often,
but needed money to feed her children.
She also said she had a drug problem and smoked crack, the report
stated. She pleaded guilty to a prostitution charge in Dayton Municipal
Court on July 7.
Ashonti and Tommie have been removed from Whitehead’s home and placed in foster care by Montgomery County Children’s Services.

Re: ASHONTI and TOMMIE JOHNSON - 2 yo / 8 mos - (2009) Dayton OH
A half-century in prison is the potential penalty for a father who
confessed to dumping two children in a trash bin, according to charges filed
Tuesday, July 28, by the Montgomery County Prosecutor’s Office.
Tommie L. Johnson Jr., 39, faces 52 years of imprisonment on 11 counts: four
felony kidnapping, three counts of domestic violence, two counts of
endangering children and one count each of inducing panic and tampering with
evidence.
Johnson’s daughter, 23-month-old Ashonti Johnson, and her 8-month-old brother,
Tommie Johnson III, were found alive by two electricians inside a
city-issued trash bin Monday morning behind a building at 902 E. Second St.
The children had been in the closed bin for about 13 hours, police said. They
were treated at Dayton Children’s Medical Center and were said to be hungry,
but in good health. They’re now in the custody of Children Services, and
will remain there, according to Juvenile Court.
Their mother, Alicia Whitehead, said after the hearing that she believes
Johnson wanted to kill the children.
“He started drinking and doing bad things,” she said. “Then he ran off with my
kids.”
Whitehead added that she’s comfortable with Juvenile Court Judge Nick Kuntz’s
decision to keep the children in the care of Children’s Services, although
she said she’d eventually like to have custody.
First, she said, she intended to complete programs for drug abuse and domestic
violence.
“My babies will be safe now,” she said.
Johnson said while being led to the Montgomery County Jail on Monday that he
put the kids in the bin, but intended to retrieve them.
Police said he took the kids Sunday night from a home at 420 N. Cherrywood
Ave. after a domestic dispute with Whitehead.
It wasn’t the first time Johnson had left with the kids. In December ,
Whitehead, 27, called police to report a domestic violence incident and said
Johnson left with the children.
Johnson walked the children to his wife’s house, according to a police
report. He was arrested the next day on charges of public intoxication.

A prosecutor's assistant says an Ohio man accused of putting two
children in a trash bin has been found guilty of attempted murder and
other counts.
An executive assistant to Montgomery County Prosecutor
Mathias Heck Jr. said Tuesday that Tommie Johnson Jr. pleaded no contest
Monday to attempted murder, kidnapping, domestic violence and tampering
with evidence.
Authorities say Johnson put the 8-month-old boy and
2-year-old girl in the trash after a dispute with their mother. Police
say two electricians rescued the thirsty, hungry children July 27 after
they had been in the bin about 13 hours.
The assistant says a judge found the 39-year-old
Johnson guilty on all counts and will sentence him April 28.

Dad sentenced for dumping kids in trash
Tommie Johnson, Jr. will go to prison for 17 years
Updated: Wednesday, 28 Apr 2010, 5:55 PM EDT
DAYTON, Ohio (WDTN) - The man who threw two children into a trash can will be heading to prison.
A Montgomery county judge sentenced Tommie Johnson, Junior to 17 years in prison.
Johnson pleaded no contest to charges against him earlier this week. Those charges included two counts of attempted murder and four counts of kidnapping.
Police say Johson took his girlfriends 23-month old daughter, and 8-month old son and threw them into a dumpster. Those kids were in that dumpster for 13 hours.
In court on Wednesday afternoon, Johson broke down and cried, saying he was sorry, and asking for forgiveness.
Part of the crime was caught on tape by surveillance cameras behind East Second Street, in Dayton.
The children were found when two electricians in the area heard them crying.
Authorities said Johnson took the children after a domestic dispute with their mother, and threw them into the trash.
Montgomery County prosecuters said, it's ironic this sentencing takes place during Child Abuse Awareness and Prevention Week.
Prosecuters said, Johnson's tears and apologies come a little too late in the case.
"Those tears were for the benefit of the court today, since he was caught, but having worked this case when he had the opportunity to tell them where the children were, he led them on wild goose chases all over the area," said Assistant Prosecuting Attorney Erin Claypool.
"Today the defendant mentions he's sorry it was a grave mistake that he made, well it was not a mistake, it was intentional act. Sorry is too late," said Montgomery County Prosecuter Mat Heck.
Prosecuters said both of the children were now in foster care, in Montgomery County.

Too bad that dirtbag didn't get 50 years. He certainly deserved it. I hope the mother never gets the kids back either. She's had plenty of chances to be a good mom but never will. I hope the children are placed in a loving, caring home. Poor things had to sit in a dumpster all day. It's a miracle they lived.
