DYLLAN MICHALSKI - 1 yr -(2009) Pasco FL

Bernard Michalski placed his two small sons in a water-filled bathtub and left the room for several minutes.

Then he slipped into the bedroom that March 30 afternoon for some alone time with his girlfriend, Lauren Roe, according to the Pasco County Sheriff's Office. While Michalski tried to get his girlfriend to have sex with him, he could hear the boys — ages 2 and 1 — turning on the water at least twice, authorities said.He yelled at them to stop.

When he checked on the boys a few minutes later, the sheriff's report said, he found 1-year-old Dyllan "face up and unresponsive." Paramedics swarmed to the scene, but it was too late to save him.Dyllan, who had just celebrated his first birthday, was taken off life support and died the next day. An autopsy determined the cause of death was drowning.

It took months for authorities to investigate and confer with the Pasco-Pinellas State Attorney's Office to determine whether someone would face charges in the case.

On Wednesday, Dyllan's father was charged with aggravated manslaughter of a child and child neglect. Michalski, 22, of 7801 Fox Hollow Drive, is being held without bail at the Land O'Lakes jail."Sometimes, it takes a while to ensure that the case is ready to move forward with all the evidence and information we have," said sheriff's spokesman Kevin Doll.

Roe's mother, Theresa Griffiths, 41, said Wednesday that Michalski made a mistake when he left the boys alone in the bathtub on that spring afternoon."I go to bed dreaming of my grandson as he drowns, and I can't reach him," she said.Griffiths urged other parents to learn from the tragedy and never leave their small children unattended in the tub."I don't want anyone to endure the pain that my entire family has," she said.

But she also wonders whether Dyllan's death could have been avoided. The state Department of Children and Families had previous involvement with the family, although the details of those cases were not available Wednesday evening.

Griffiths said the cases involved Roe's care of the boys, and she said DCF should have done more to follow through.

No charges have been filed against Roe. She told detectives that she turned down Michalski's advances on March 30, according to the report, because "she does not like to have sex while the kids are in the tub."Griffiths said her daughter has gone through counseling to deal with Dyllan's death. And two months ago, she said, Roe and Michalski had their third
son.

Port Richey man charged in son's drowning

NEW PORT RICHEY --
A 22-year-old man was charged today with aggravated manslaughter of a child and child neglect in the March drowning of his 1-year-old son, the Pasco County Sheriff's Office said.

Bernard Stanley Michalski, of 7801 Fox Hollow Drive, Port Richey, was being held without bail in the Land O' Lakes Jail this afternoon.

A sheriff's report said Michalski was giving his 2- and 1-year-old sons a bath on March 30 when he left them unattended for several minutes. When Michalski returned, he found his son Dyllan face up and unresponsive; there was about an inch of water in the tub, records said.

The child was taken to Bayonet Point Hospital then All Children's Hospital in St. Petersburg, where he died on March 31, records said. An autopsy performed by the Pasco-Pinellas Medical Examiner concluded that Dyllan had drowned.

According to the sheriff's office:

Michalski told investigators that he put the boys in the tub, then left for a few minutes while he tried to persuade his girlfriend to have sex in the bedroom. He heard the boys turning the water on "at least two times," and he yelled for them to stop.

Michalski's girlfriend told investigators that she scratched his back when he laid down next to her, but refused to have sex because she "does not like to have sex while the kids are in the tub."

The report does not say if the girlfriend is the mother of Michalski's children.

Yes think is Dyllan Michalskis father. My son passed away March 31 2009 at 3:50pm. He passed away in his mothers and my arms. If you think for one god damn second i would try to have sex with her while my children where in the bath tube your sadly mistaken. My son Dyllan was my world. I went to prison for this bullshit to get away from Lauren and her crazy family. While i was locked up Ms. Lauren Roe had our 3 Children which had been removed from her care and placed with my mother. My oldest son came out and said while daddy had been gone i have been played with and when we got all 3 kids checked out they were all Molested. I do know who it was my oldest son had told me. Im getting full custudy of the 3 children cause their mother oh miss only does right is showing her true colors. I LOVE MY CHILDREN AND IM RAISING THEM. Evan after I went to prison for my sons death im still a more suitable parent for the other children of mine. Now with all the shit they talk and everything else you read up on. You can see that the Bitch of an ex lied on me. I never once tried having sex with her while the kids where in the bath tube. That dumb bitch called me outta the bathroom to get her a drink. Then SHE asked me to rub her back which i did for a few min. then i went back into the bathroom and found my child. THIS IT THE DAMN TRUTH IF YALL DONT LIKE IT I DONT CARE. IT WAS ONLY LAUREN AND MYSELF IN THAT HOUSE WITH OUR CHILDREN. She dont wanna say the truth but i sure the hell will. I SPENT 3 YEARS IN PRISON AND I STILL GOT 7 LEFT ON PROBATION. I went to prison yes and i was a damn man about it im not going to run with my tail tucked between my legs like she did. What happen with our son was both of our faults and im the only one who was a grow up about it and not a child. What does it matter if you were having sex or rubbing her back?  You still left a little baby alone in the bathtub.  A totally avoidable death.

First off none of my kids were molested your whore mother made that up and it was proven by CPI as for dyllan being your son no he wasn't you did not care about him one bit I was the one up with him at night scare to go to bed because I didn't know if I was going to wake up to him dead.when he went in for his heart surgery I took care of him when he came home dressing his wound and giving him sponge baths and feeding him mean while you're telling everyone you didn't get close to him because you knew he was going to die yes what a great father you are that's why your facing 20 years right now because you were out getting vagina instead of taking care of your children so you know what Mitch screw you and your lies you never cared about any of MY kids you used them just to get attention like you did dyllan you were never a father please just leave my son alone and let him rest in peace
