WEST SPRINGFIELD - Police continue to probe the suspicious
death of a baby boy early Sunday morning in a Riverdale Street hotel.
"We are still looking into it," Officer Thomas A.
Guindon, a detective, said Monday. No arrests have been made, he said.
Police received an emergency call at about 3 a.m. Sunday
for a child needing medical assistance at the Clarion Hotel,
1080 Riverdale St. Information about exactly what was wrong
with the child was not available.
The Associated Press reported that the boy's mother,
Erica Luce, told WWLP-TV that she found her son covered in
cold water and lying naked next to an air conditioner on full blast.
Luce claimed a stranger broke into her room while she was
in an adjacent room talking to a friend. She did not respond
to several telephone calls from The Republican on Monday.
Guindon declined to comment on the report.
An ambulance responded and the child was taken to Baystate
Medical Center in Springfield, where he was pronounced dead, police said.
Police believe the boy was only a few months old.
The child was with at least one parent when the request for
assistance was made, police said.
The child's mother has been a resident of the Clarion
Hotel for at least a few days. Police said she is from Western Massachusetts.
On Sunday, Detective Michael D. Reed labeled the death suspicious.
The Hampden district attorney's office declined to comment Monday.
The Clarion Hotel and Conference Center has 262 rooms and
is the largest West Springfield lodging member of the
Greater Springfield Convention and Visitors Bureau, a bureau
spokesman said. In West Springfield, the bureau has 10
member hotel and motel properties, with a total of about 952
rooms, the spokesman said.
The spokesman noted that about 90 percent of the hotels and
motels in West Springfield are members of the bureau.

Re: ETHAN LUCE - 3 Months (2010) - West Springfield MA
WEST SPRINGFIELD – The mother of a 6-week-old boy found dead on Jan. 24
in a room at the Clarion Hotel and Conference Center in West
Springfield was arrested Thursday on involuntary manslaughter charges.
Erica Ashley Luce, 22, was arrested at police headquarters and
arraigned in absentia in Springfield District Court, police said. An
innocent plea was entered for her, and she was released by the court on
her own recognizance, police said.
A pre-trial conference is scheduled on March 19. Luce is being
represented by Erica E. Cushna, a Springfield-based public defender.
Cushna said that the infant’s death has been a “tremendous loss” for Luce.
“I hope people will reserve judgment, until the evidence is presented,” Cushna said.
An investigation into the death of the infant, Ethan Luce, showed that
he died from injuries, including several skull fractures, inflicted by
his 3-year-old brother, Sean Luce Jr. The state Department of Children
and Families was granted legal custody of Sean on Jan. 25.
The baby was rushed by ambulance at around 3 a.m. on Jan. 24 to Baystate Medical Center where he was pronounced dead.
Hampden District Attorney William M. Bennett said at a press conference
on Jan. 29 that Erica Luce would likely face negligence charges for
having left the boys alone in the hotel room for a period of several
hours. At the same press conference, Police Chief Thomas E. Burke
indicated that more serious charges might be lodged.
Neither Bennett nor Burke could be reached for comment on Thursday.
Mayor Edward J. Gibson said that he knew previously, through the police, that the involuntary manslaughter charge was possible.
“Although it is a sad case, I do support the charge of involuntary
manslaughter from the information that I’ve been given,” he said.
Gibson praised the Police Department for its work on the case.
“I know the outstanding job done in this particular case,” he said. “As
difficult as it was, I know (the police) worked very hard on it.”
The state police detective unit assigned to Bennett’s office also participated in the investigation.
The baby, whose death initially was termed “suspicious” by police, had
been at the hotel for about two weeks with his mother and brother. The
family, which was homeless, was placed at the hotel on a transitional
basis through the state Department of Housing and Community Development
until a more permanent setting could be found.
“The autopsy revealed the child died from multiple trauma, including
several fractures to the skull,” Bennett later said. “Obviously, there
aren’t going to be any criminal charges against the 3-year-old child,”
Bennett said.
An account of the incident given to investigators by the 3-year-old corroborated the medical examiner’s findings, Bennett said.
Burke said that there were “a number of assaults,” during the three-hour period in which the boys were left alone.
Erica Luce told the news media that she found her son covered in cold
water and lying naked next to an air conditioner, which was turned on
full blast. She claimed a stranger broke into her room at the Clarion,
1080 Riverdale St., while she was in an adjacent room talking to a
friend.
Burke said the investigation found there was no credibility to the
scenario presented by the mother about what happened to her baby. He
said the probe determined that she left the baby in an unstrapped car
seat on the bed in the hotel room.
He said that when she returned three hours later, the room was in
disarray, and the baby was on the floor and not breathing. He said that
the investigation was difficult for his officers, many of whom have
children.
He said that there were indications that Erica Luce was in a room next
to hers that was occupied by Springfield gang members, when her baby
was killed.
“She was next door, but the cast of characters was incredible,” Burke said.
Burke said he was angered to learn that 28 rooms in the 262-room
Clarion were rented by the state housing-assistance program. He said he
planned to research the possibility of a city ordinance to somehow
address the issue of using hotel rooms as residences for the homeless.
Hotel and motel rooms, he said, aren’t set up for apartment-style
living. He said it’s also dangerous, because it creates potential for
increased occurrences of pedestrians trying to cross heavily-traveled
Riverdale Street.

Re: ETHAN LUCE - 3 Months (2010) - West Springfield MA
The mother of an infant found dead in a
West Springfield hotel room, in which they had been staying as a part
of a program to house homeless families, pleaded not guilty to charges
connected to the child's death Wednesday in Hampden Superior Court.
Erica Luce, 22, appeared in court wearing black clothes and with her
hair combed over her face. She stood behind her attorney during the
hearing with her face turned away from members of the media and news
cameras while her lawyer entered a not guilty plea on her behalf to a
charge of involuntary manslaughter.
Luce was able to remain free on her personal recognizance Wednesday,
which was imposed during her district court
arraignment held in absentia. However, she was ordered to remain
in a Respite Program and only have supervised visits with her 3-year-old
son, Sean Luce Jr., through the state Department of Children and Families.
According to law enforcement officials, an investigation determined
Luce had allegedly left the 6-week-old baby alone with her 3-year-old
son, who is thought to have caused the injuries that killed the child. The baby had
suffered skull fractures, according to investigators.
Luce had been living in the Clarion Hotel in West Springfield as part
of a state-run program that had allowed homeless families immediate
housing in hotels. Local politicians have since criticized the practice
in the wake of the child's death, as well as other problems involving children.

Erica Luce gets five years probation in baby's death at hotel
March 02, 2011
SPRINGFIELD - The once-homeless mother of the 6-week-old Ethan Luce, who died in January 2010 after being left alone in a hotel room with his older brother, pleaded guilty Wednesday to reckless endangerment of a child and was sentenced to five years probation.
Erica A. Luce, 23, had faced a charge of involuntary manslaughter in Hampden Superior Court but under an agreement between prosecution and defense, that charge was dropped. She was allowed to plead guilty to the charge of reckless endangerment of a child.
Judge Constance M. Sweeney accepted the agreed recommendation and sentenced Luce to the term of five years probation. As a condition of probation she must continue mental health counseling at Behavioral Health Network and remain free of alcohol and illegal drugs.
Luce has been free on conditions while the case was pending.
The baby, whose death initially was termed "suspicious" by police, had been staying with his mother and brother at the Clarion Hotel & Conference Center in West Springfield for about two weeks.
They were among homeless families being housed in area hotels and motels by the state. The case was among several that focused attention on the state's program for housing homeless families in such circumstances.
An investigation into the death of Luce's infant son, Ethan Luce, determined that he died on Jan. 24 from injuries, including several skull fractures. An investigation by the office of former Hampden District Attorney William M. Bennett concluded the baby died as a result of injuries inflicted by his 3-year-old brother, Sean Luce Jr.
The state Department of Children & Families was granted legal custody of the older child on Jan. 25, 2009.
As a condition of probation Luce cannot seek custody of Sean during the five years. She can only have supervised visitation with Sean as arranged by the state agency. Luce told Sweeney her grandmother in Rhode Island is taking care of Sean now.
Assistant District Attorney Karen McCarthy said Luce put Sean in the double bed wearing a diaper and pajamas. She fed Ethan and put him in the car seat in a diaper and one piece pajamas.
Luce told Sean she was taking a shower and shut off the television and lights, except the bathroom light. She waited near the door for 10 minutes for Sean to fall asleep.
Shortly after midnight Luce went to a next door room to watch television with the woman staying there, McCarthy said. Luce, prior to falling asleep in the other woman's room next door, heard a loud bang but thought it was a different room than hers and did not check.
Luce awoke at about 2:45 a.m.and went back to her room and noticed powder spilled in the hallway to the door. Luce found all the lights and the television on and Ethan lying naked on his back on the floor near the foot of the bed with his car seat upside down next to him.
The baby was cold, wet and covered with powder and juice was spilled under him. Luce saw Sean sitting naked in a chair by the bed watching television, McCarthy said.
Luce had known Sean was hyper and had anger issues and she was concerned about his jealousy of the baby, McCarthy said.
“The 3-year-old would get agitated when the baby cried. The defendant had been told by family members not to leave the older child with the baby,” McCarthy said.
Luce said Sean kept repeating “I am very sorry,” which she said he does when he does something wrong.
McCarthy said Luce had no prior criminal involvement with the courts.
Erica Cushna, Luce's lawyer, said Luce had had mental health problems and had been hospitalized several times before Ethan's death.
“Some things I think are worse than dying your honor, and I think that one of those things is losing your own child and having to deal with the aftermath of that," Cushna said.
Hampden District Attorney Mark G. Mastroianni said after the plea, "We evaluated how appropriate the prior charges were, the manslaughter charges, to the facts and circumstances of the case. And these are very, very difficult facts and circumstances."
"We thought in the interests of justice, taking into consideration the entire facts of the case, the mental health history of this young woman before this incident and after, and the circumstances under which it occurred, the most appropriate charge to address what happened that night were the endangerment charges," Mastroianni said.
