The paternal
grandmother of two small girls summoned deputies to her house on Feb.
26 after finding them tied up on a bedroom floor, one of them - a
4-month-old - with a sock stuffed in her mouth, a Riverside County
prosecutor said Tuesday.
Deputy district attorney Philip Greenberg said that as of last week,
the two girls remained at Loma Linda University Medical Center where
they were taken for treatment of injuries to their heads and faces.
"Child Protective Services is finding a suitable placement for them," Greenberg said.Greenberg's
comments came after a brief court hearing at which Superior Court Judge
Richard T. Fields set a March 24 arraignment date for the girls'
biological father, Jeremiah Eugene Scott, who was arrested after the
girls were found in a Jurupa home northwest of Riverside.
Scott, 23, is charged with seven felony counts including torture, child abuse, corporal punishment and cultivation of marijuana.
Greenberg said the preliminary investigation determined that Scott
and the girls' mother, whom he identified as Erica Henry, had been
staying at the Rockridge Road home with his mother, Carmen Florence.
Family members have identified the children as Miah Scott, 18-months-old and Jasmine Scott, 4-months-old.
Scott's attorney, Gregory Silver of Long Beach, asked Fields for a
continuance saying he had been unable to meet with his client before
Tuesday morning's hearing.
Scott, who was seated separately from other inmates, spoke only once
at the hearing, answering "yes" when Fields asked if he agreed to have
his arraignment continued.
Silver said after the Riverside courtroom hearing that he had been hired by Scott's father, Maurice Scott, to represent his son.
Jeremiah Scott's first court appearance had been delayed three times since last Wednesday.
On Wednesday deputies said he was not transported because he was in
a "safety cell," which is used to house inmates who pose a danger to
themselves or to others.
On Thursday he was hospitalized and on Monday his appearance was delayed because he had not been cleared by a doctor.
Greenberg said Scott was hospitalized for treatment of sickle cell anemia, a genetic blood disorder.

Carmen Florence, the children's paternal Grandmother is a hero. When faced with the choice of doing what's right for these poor wee children or protecting her son she didn't hesitate and called the police on her son.

A Riverside County judge Tuesday again postponed the preliminary hearing of a Riverside County man accused of beating his young daughters, tying them up and stuffing a sock in the mouth of a 4-month-old to keep her quiet.
Judge Richard Fields' action comes nearly 11 months after Jeremiah Eugene Scott was arrested. His daughters Miah, then 18 months old, and Jasmine, then 4 months old, were found bound on the bedroom floor of the Indian Hills home where Scott and the girls' mother lived with his mother and stepfather.
Indian Hills is a neighborhood in the unincorporated Riverside County community of Jurupa.
After a conference with Fields and prosecutor Michael Carney on Tuesday, attorney Gregory Silver said that the judge had set a Feb. 15 date to either hold the frequently postponed preliminary hearing or consider a plea agreement in the case.
"This case is getting old," Silver said.
Scott, 23, is charged with two felony counts each of torture, child abuse and inflicting corporal injury on a child.
He also is charged with one count of cultivating marijuana.
He has pleaded not guilty to all charges.
On Feb. 26, deputies were called to the home after Miah and Jasmine were found by their grandmother. Investigators said that in addition to being tied up, both girls showed signs of having been beaten. Jasmine was found with a sock jammed in her mouth.
Scott had fled the home before deputies arrived. He was arrested 20 minutes later, still in the neighborhood north of Limonite Avenue.
It was the second consecutive day deputies had been called to the Rockridge Road home. On Feb. 25, deputies responded to a disturbance call stemming from an argument between Scott and Erica Monique Henry, the mother of the children. The deputy stood by while Henry waited for a ride.
Henry was arrested in May and charged with two felony counts of child abuse.
The investigation into the incident involving Miah and Jasmine revealed that Henry had her parental rights taken away in a case involving a previous child.

Man Accused Of Whipping, Tying Up Tots Faces Torture Charges

RIVERSIDE (CBS) — A Riverside County man accused of whipping, beating and tying up his young daughters while growing marijuana in his bedroom will stand trial on torture and other charges, a judge said Wednesday.
Jeremiah Eugene Scott, 24, could face life in prison if convicted of two counts each of torture, child endangerment and corporal injury to a child, as well as one count of cultivating marijuana.
Riverside County Superior Court Judge Ronald L. Taylor found there was sufficient evidence to proceed to trial following an hour-long preliminary hearing and scheduled a post-indictment arraignment for March 9. Sheriff’s Investigator Amado Layos testified that last Feb. 26, deputies were called to Scott’s mother’s house in the 7300 block of Rockridge Road to investigate a report of child abuse.
When deputies arrived, they discovered the defendant’s 4-month-old daughter Jasmine and 2-year-old daughter Miah bound with tape around their hands and legs, lying on the floor of his bedroom, according to Layos.
Jasmine had a sock stuffed in her mouth, as well, he said.
The children’s mother, 24-year-old Erica Monique Henry, had left them in Scott’s care while she went out, according to the deputy.
The defendant allegedly flew into a rage when Miah dropped a French fry into his drink, prompting him to drag the toddler by the ponytail from his car into the house, Layos said.
Scott’s mother and stepfather witnessed the act and called the sheriff’s department after they found the children tied up in his room, the deputy said.
Scott slipped out of the residence but was arrested a short time later when deputies spotted him walking in the area.
According to Layos, a pediatric physician at Loma Linda University Medical Center examined the children and reported that both had whip marks on their backs from a belt or extension cord, strangulation impressions on their necks, lacerated lips and bruised eyes. Deputies seized a half-dozen marijuana plants from Scott’s bedroom closet, according to sheriff’s officials.
Henry was originally charged with two felony counts of child abuse, but ended up pleading guilty in December to a misdemeanor count of child endangerment and was sentenced to parenting classes.
The children are now living with relatives.
Scott’s attorney, Greg Silver, argued that the torture charges were excessive, telling the judge that they were designed for a more severe allegation, such as “someone pouring gasoline into an open wound and causing further injury.”
Deputy District Attorney Michael Carney responded that one necessary element to allege torture is evidence of a defendant seeking revenge.
“Mr. Scott did what he did for a vengeful purpose,” Carney said, referring to the French fry incident. “It doesn’t make sense to me that someone would do that. But that’s what happened that day.”
After considering the children’s ages and the circumstances, Taylor agreed.
“Why didn’t the defendant pursue some more traditional form of punishment?” the judge said. “The evidence indicates the defendant lifted a child off the ground by the hair and walked with her suspended (over 90 feet). The children were bound with tape, and the youngest had a sock stuffed in her mouth. The people have met their burden.”
Scott is being held in lieu of $1 million bail at the Robert Presley Detention Center in Riverside.

During a walk-through of the house, deputies found the defendant's two toddlers "bound, gagged and left on a bedroom floor," said sheriff's Sgt. Steve Brown, adding that both children "had visible injuries about their face and head."
Scott, who had slipped out moments before deputies arrived, was located in the neighborhood and arrested without incident, according to Brown.
The children were taken to a hospital and treated for injuries that did not appear to be life-threatening, the sergeant said.
There was no word on the whereabouts of the mother of the girls.
