Springfield IL ----The retrial of a 24-year-old Springfield man accused of beating his
girlfriend’s 23-month-old son got under way with jury selection Monday in
Sangamon County Circuit Court.
Anthony Mines of the 1400 block of South Fourth Street was charged with
aggravated battery to a child, punishable by 6 to 30 years in prison, after the
child suffered bruising, rib fractures and a head injury on Jan. 29, 2009.
Mines’ first trial in December ended in a hung jury.
Opening statements and testimony before a jury of eight women and four men
are scheduled to begin this morning.
Springfield police said Mines was watching the toddler and two other
children, ages 4 and 6, after their mother left for work about 5 a.m.
Mines allegedly told police the toddler was fine all day long. Just before
noon, he said, he took the 6-year-old out to catch the bus, and when he went
back inside a minute later, the toddler was playing with the 4-year-old in a bedroom.
Mines went to his bedroom next door. When he went into the other bedroom 90
minutes to two hours later to wake the children, he said he found the toddler
lethargic, unresponsive and having trouble breathing. His eyes were rolled back
in his head, Mines reportedly told police.
Mines told police he had to wait for the 6-year-old to get home from school
and then took the injured boy to St. John’s Hospital about 45 minutes after finding him.
Mines told police the 4-year-old said the boy had been jumping on the bed —
which police said was a mattress on the floor — and struck his head on a pink
plastic Halloween bucket.
The physician in charge of treating the toddler at St. Francis Medical Center
in Peoria said the extensive injuries he suffered “would not be consistent with
a fall onto a Halloween bucket,” according to a police report.
Mines was arrested Feb. 10.
Associate Judge John Childress is presiding over the trial, which is expected
to conclude by midweek.
