An Albuquerque man is in jail after being accused
of raping a 1-year-old. His girlfriend is also in trouble in connection
to the crime, police said.Albuquerque Police Department
investigators said this is one of the worst child abuse cases they've
ever seen.On Wednesday afternoon, they arrested the man who's
accused of this horrific crime and said they are especially concerned
because he wasn't supposed to be around that child in the first place.APD
said Ralph Maestas raped a 1-year-old child, leaving that baby
traumatized with severe injuries."It's disgusting. It's awful,"
said neighbor Rosemary Pacheco.Pacheco lives just feet away from
the apartment on Charleston Street Southeast where police said the
suspected abuse happened in September."I was stunned," Pacheco
said.Investigators said Maestas sexually assaulted the baby in
front of two young kids who were living at this residence. Neighbors
said they had no idea this was going on."I never, never in my
mind (knew)," Pacheco said.Maestas' girlfriend, Kacee Kline, is
also under arrest. Police said she found the baby in a pool of blood the
day after the incident and didn't immediately get her medical
attention."(She) decided not to call for help, not to call the
ambulance because at this point she was concerned about the bill, the
financial status," said APD spokeswoman Nadine Hamby.It turns out
the Children, Youth and Families Department took all three children
from the residence the week before for neglect, but gave them back under
strict conditions that Maestas wouldn't be around them."I'm
angry at her for letting them back in," Pacheco said.Officials
with CYFD said they monitored the situation and never got reports he was
here until after the horrific crime supposedly took place.That
baby is still recovering from multiple surgeries. The other two kids are
in protective custody.Both Maestas and Kline are in the Metro
Detention Center facing a long list of criminal charges.APD said
they heard Maestas was charged as a juvenile for a similar crime in
Valencia County, but the district attorney couldn't confirm this because
juvenile records are sealed.

ALBUQUERQUE (KRQE) - A Belen man is being held without bond after police charged him with raping girlfriend's 1-year-old so badly that she needed extensive surgery to repair the damage.

Ralph Maestas, 23, is charged with rape, kidnapping and child abuse.

Police said the rape actually happened back in September in Albuquerque. However, they didn't put out a warrant for Maestas until May when then baby's older sister told her therapist she'd seen him raping the little girl.

The child's mother had recently been charged with child neglect and just got back her three children from CYFD.

She told police she put her child in the bath tub when she was bleeding instead of calling 911 because she didn't want an ambulance bill.

ALBUQUERQUE (KRQE) - First he rejected a plea deal for an accused child rapist, and now the judge has dropped another bombshell taking himself off the case entirely.

District Judge Samuel Winder recused himself Friday but didn't say why.

On Wednesday Ralph Maestas was set to plead no-contest to rape and child abuse charges as part of a plea deal that would give him a prison sentence of up to 30 years.

Winder, however, rejected the deal without explanation.

Maestas was set to go to trial in October, but that date will have to be pushed back until a new judge can be assigned to the case.

Maestas now faces a potential life sentence if he's convicted.
