ROBERTO FORTIN Jr - 7 yo - Miami FL
Poster's Note: Four years ago this "father" was arrested and convicted in the death of his then 9 month old son. This child was about 5 at the time and should have been removed from the father's custody at that time.
A father and stepmother are accused of ignoring a young boy until he weighed
just more than half of what the child should weigh.
Roberto Fortin and Yoselin Aguiree are charged with one count of child neglect.
Jail records show both were being held late Monday night in the county
jail. It was not immediately known if either has an attorney. The
30-year-old Fortin told a doctor that his son wasn't breathing properly.
The arrest report says the doctor noticed that the boy was severely
malnourished and weighed about 40 pounds, which was nearly 30 pounds
under what a normal child his age should weight. The boy's age was not released.
The Miami Herald reports Fortin pleaded no contest in 2006 in the
death of his 9-month-old son who drowned in a bathtub.

Poster's Note: So, let me see if I have this right... She's been convicted of beating up an elderly person
and he has a prior for manslaughter (OF A CHILD) and they're out there raising kids. Nice placement DCF!
A Miami woman charged with child neglect after ignoring her
7-year-old stepson's illness was released from jail early Tuesday,
authorities said. Yoselin M. Aguirre, 31, and the boy's
father, Roberto Fortin, 30, were arrested on Sunday and charged with one
count of child neglect. Aguirre was released from jail early
Tuesday on $7,500 bond, a jail spokeswoman said. Fortin, who had the
same bond, remained in Dade County jail.
The boy weighs only about 40 pounds, just more than half of
what doctors said he should weigh, and on several parts of his body his
skin was missing, authorities said. He remains in extremely
critical condition at Miami Children's Hospital, said Detective Willie
Moreno, a Miami police spokesman. ``He was extremely
malnourished to the extent you could see the impressions of his bones,
and he had lesions all over his body,'' Moreno said. "It's unthinkable.
It's incredible that his own parents did not treat him sooner.''
Aguirre also has a 4-year-old son who lived with the couple. That
child is in the custody of the Department of Children & Families,
Moreno said. Police say Fortin took the boy to Miami Children's
Hospital on Sunday, telling the doctor the boy wasn't breathing
properly. The child weighed about 30 pounds less than he should have.
A police affidavit did not give the boy's age. Some media sources speculated
that the boy was 7. Fortin told police that he had been monitoring his son and "thought
he would get better,'' the affidavit said. He also said his son suffers
from autism and ADHD. The boy's stepmother, Aguirre, told
police she knew the boy was sick but she didn't get help for him because
he wasn't her biological son, the affidavit said.Aguirre also told police that she
home schools the boy. Both father and stepmother have had legal troubles before.
Aguirre pleaded guilty in 2007 to aggravated battery on a person 65 or older.
She was on probation until July 2008. Fortin was placed on probation after he pleaded no contest to
aggravated manslaughter of a child in his 9-month-old son's death,
according to records with the state's corrections department.
In that case, Fortin told police that on March 28, 2005, he placed son
Alejandro in the bathtub. He turned on the water but did not close the
drain. Fortin walked out of the bathroom, lay down in the bedroom and
fell asleep. After he awoke, he found the baby under water. He called 911 and began CPR,
but Alejandro could not be saved. The 7-year-old boy had been removed from his father's care in 2005,
following Alejandro's death, and placed in the care of his paternal
grandmother. In 2007, a Broward judge granted the father
custody after a home study was completed, said Lissette Valdes-Valle, a
Department of Children & Families spokeswoman. "When
the situation occurred the child was removed, but he was returned after
the father complied with his case plan,'' Valdes-Valle said. She said the family had a history with DCF,
but under the law could not give more details. There will be a dependency court hearing
in the coming days to determine who will care for the boy.

Re: ROBERTO FORTIN Jr - 7 yo - Miami FL
Tom, this is outrageous! As well as letting him raise a child he was being "home-schooled". There needs to be some serious investigation into this homeschooling. Kids are slipping through the cracks. It's an ideal cover for abusive parents to hide their kids from society. All kids home-schooled should be checked on by teachers/authorities periodically at the parents expense IMO.

Yes, the local Board of Education should be monitoring these kids at least a few times a year to check on academic and social skills progress. I can certainly understand why, with the atmosphere is some schools these days, that parents might prefer home schooling but there should be a system in place that provides for periodic interviews and observation.

Re: ROBERTO FORTIN Jr - 7 yo - Miami FL
A Miami man prosecuted for killing his 9-month-old son five years
ago now is accused of severely neglecting his older son, whom police say
is 7 but weighs just 40 pounds and is missing skin from several parts
of his body. After the drowning death of baby Alejandro in
2005, Roberto Fortin lost custody of his older son, Roberto Fortin Jr.,
for two years. But the boy was allowed to return home, where he wasted
away, winding up Sunday at Miami Children's Hospital. He remained in
critical condition Tuesday. ``He was extremely malnourished to
the extent you could see the impressions of his bones, and he had
lesions all over his body,'' Miami police spokesman Detective Willie
Moreno said of Roberto Jr.
"It's unthinkable,'' Moreno said. "It's incredible that his own parents did not treat him sooner.''
Fortin is being held in the Miami-Dade Jail, charged with one count
of aggravated child neglect causing great harm. The boy's stepmother,
Yoselin M. Aguirre, 31, was arrested on the same charge. She was
released from jail Tuesday on $7,500 bond, a jail spokeswoman said.
Police say Fortin took his namesake to the hospital Sunday, telling a
doctor the boy wasn't breathing properly. The doctor noticed the boy
was ``severely malnourished,'' an arrest affidavit said. Fortin
told police that he had been monitoring his son and "thought he would
get better,'' the affidavit said. He also said his son is autistic and

she pleaded guilty to aggravated battery on a person 65 or older,
according to Miami-Dade court records. She was on probation until July
2008. Roberto Jr.'s birth mother, Ann Santana, remarked, "I'm disgusted.'' She said she had lost
custody but now plans to fight to raise her son. The family
lost their baby son Alejandro on March 28, 2005, when Fortin was caring
for the infant in their Davie home. Fortin told Davie police he placed
Alejandro in the bathtub and turned on the water but did not close the
drain. He walked out and fell asleep in a bedroom, investigators said.
After he awoke, he found the baby under water. He called 911 and began CPR,
but Alejandro could not be saved, police said. Fortin pleaded no contest to aggravated manslaughter of a child and
was placed on probation. A judge granted him a withhold of adjudication,
meaning no criminal conviction appears on his record. Roberto
Jr., the older son now in the hospital, was placed with his paternal
grandmother, said Lissette Valdes-Valle, a Florida Department of
Children & Families spokeswoman. Two years later, in 2007,
Fortin won back custody of his son after a court-ordered home study
determined that the father had ``complied with his case plan,''
Valdes-Valle said. Fortin lives with Roberto Jr., Aguirre and her 4-year-old son in a Miami apartment.
