A 21-year-old Cape Girardeau man was charged Wednesday with first-degree
assault for allegedly causing brain damage and fractures to his
7-week-old infant.
If the baby dies, Cape Girardeau County Prosecuting Attorney Morley
Swingle said, Allen Ray Walker Jr. could face homicide charges.
After returning from work at about 3 p.m. Sunday, the infant's mother
checked on her child in his crib and saw he was pale and had a bruise
over his left eye, according to a probable-cause affidavit filed in the case.
The child was taken to an area hospital and later transferred to the Children's Hospital in St. Louis.
In an interview with police, Walker told police a Pack-and-Play fell on
the child but also admitted he didn't believe that would cause such
serious injuries. According to the affidavit, he also told police that
from the time the mother left for work he was the only guardian present
with the children.
Another infant was also being taken care of in the home.
In the affidavit issued by Cpl. Darren Estes, he writes that a treating
physician noted that a mark in the bruise above the infant's eye was
consistent with a wedding band. Police noted in the affidavit that
Walker was wearing a wedding band on his left hand while still at the residence.
An affidavit from two doctors treating the infant at Children's Hospital
in St. Louis says the infant suffered skull fractures, bleeding in the
brain, broken ribs and bleeding behind both eyes.
Dr. Adrienne D. Alzemis and Dr. Jamie Spurrier wrote the account of a
Pack-and-Play falling on the child is not consistent with his injuries.
"The presence of bilateral retinal hemorrhages is consistent with an
inflicted, forceful shaking mechanism," they wrote in the medical
affidavit. "The rib and tibial fractures are consistent with
non-accidental trauma."
In addition, the doctor's wrote they have cause to suspect the infant
was the victim of maltreatment or physical abuse.
Walker is being held on a $250,000 cash-only bond. Walker is prior
offender in Cape Girardeau County, pleading guilty to felony domestic
assault in June 2008.

The death of a 7-week-old infant has culminated in murder charges for
the baby's father, Allen R. Walker Jr., who prosecutors are saying
killed his son -- one of two twin boys -- by fracturing the baby's skull
and causing severe brain damage.
The infant died Thursday evening at Children's Hospital in St. Louis,
and an autopsy was performed Friday morning by Dr. Jane Turner, an
assistant medical examiner for St. Louis. After the autopsy report was
filed Friday afternoon, Cape Girardeau County Prosecuting Attorney
Morley Swingle upgraded the charges from first-degree assault to
second-degree murder and endangering the welfare of a child.
Swingle declined additional comment other than providing a news release
and a copy of the charges.
Walker remained in custody Friday at the Cape Girardeau County Jail in
Jackson on a $250,000 cash-only bond, set by Circuit Judge Ben Lewis.
Cape Girardeau County Coroner John Clifton said the autopsy shows
the baby's death was the result of intentional trauma.
"The child certainly did not die of natural causes," Clifton said.
"He also did not die from any accidental reasons."
Second-degree murder is a class A felony and carries a range of
punishment from 10 to 30 years or life in prison. Endangering the
welfare of a child is a class C felony, and Walker could be sentenced to
an additional seven years for that charge if convicted.
Reached at her office in St. Louis, Dr. Turner said her findings
do not suggest an accidental death.
"What I can say is that the autopsy confirmed the impressions of the
doctors at Childrens Hospital that this baby died of inflicted injuries
of the head," she said.
Turner said that she found skull fractures and hemorrhaging, or bleeding,
around the brain as well as in the retinas.
"Those types of injuries, retinal injuries, are seen in cases of
children who are shaken violently, but also are seen in children with
massive crushing injuries of the head," she said.
Turner has not finalized her investigation, she said.

twin boys. On Aug. 22, the infant's mother returned home from work and
checked on her child in his crib and saw he was pale and had a bruise
over his left eye.

Why was the mother working and the father not? We need to get back to normal society where males and females do the jobs we are meant to do. If someone told me the bloke next door was looking after 7 week old twins I'd be very concerned at his ability to cope. It would be difficult for a mother too. Yes, I know we're in a recession and lots of blokes are out of work - but then that's not the time to have children obviously. This trend needs to be talked about and babies need to be in a certified daycare centre if the mother or grandmother cannot care for them.

A Cape Girardeau man in custody at the Cape Girardeau County Jail for the alleged murder of his infant son is facing new felony charges after deputies reportedly found him in possession of marijuana.
Allen R. Walker Jr., who has been in jail since his August arrest, is charged with possession of a controlled substance at a county jail.
Capt. James Mulcahy said Wednesday that deputies made the discovery April 22 when releasing another inmate, Daniel McBrant. A corrections officer saw McBrant slide something under the door to another cell, according to an affidavit filed with the court.
After placing McBrant back in a different cell, deputy David Goehman went into the other cell, where Walker and another inmate were sitting. In a desk drawer, Goehman found rolled up paper, a cotton ball and a lighter. Two joints were found in the rolled-up pouch of paper, according to Goehman's probable-cause statement.
McBrant was serving a six-month sentence after having his probation revoked in November. He was charged with third-degree domestic assault in 2007.
McBrant has also been charged with possession of a controlled substance in a county jail. Both men's cases were bound over for trial at hearings Tuesday.
A jury is set to begin hearing testimony Oct. 12 in Jackson on Walker's pending second-degree murder and child endangerment charges. Police have accused Walker of causing fatal injuries to his 7-week-son, who died Aug. 26 at a hospital in St. Louis.
Walker's jury trial was first set for March, but less than a week before it was scheduled to begin he asked the judge presiding over his case, Benjamin F. Lewis, for time to hire a new attorney.
A Wednesday hearing has been set to determine whether jury selection will still take place in Scott County and if the trial will remain in Jackson. Judge Benjamin F. Lewis, who is presiding over the case, had previously agreed to have jury selection in Scott County per the request of Walker's former attorney.

Walker is represented by public defender Patty Tucka, who has not returned phone calls seeking comment.
