Ft Worth TX ---- Investigators are trying to
determine the circumstances surrounding the near-drowning of a
3-year-old girl in her mother's apartment Monday morning. The girl was
in "very serious condition" at Cook Children's Medical Center, according
to police. Police and firefighters who responded to the scene were told
that she nearly drowned in a bathtub in her mother's apartment in the
2800 block of Watermark Drive near Lake Worth. Her mother was at work,
and the child was in the care of her mother's boyfriend, police Sgt.
Chad Mahaffey said. Because of the nature of her injuries, crimes
against children detectives were brought into the case, he said. "We're
going to do many interviews, and we're going to look at the evidence,"
Mahaffey said. "As these two bodies of information accumulate, one from
the medical evidence, the other from the police investigation, we will
see how they fit together and determine if this incident occurred as it
was reported or if it was something else." No one else was in the home
at the time.

days after being found unresponsive in a filled bathtub was the victim
of an accidental or intentional drowning, authorities said Wednesday.The
Tarrant County medical examiner's office has now ruled the cause of
Abigail Fleming's June 2 death as "sudden unexplained child death with
history of drowning" and the manner of her death as "undetermined."Linda
Anderson, a spokeswoman for the medical examiner's office, said the
ruling indicates that while doctors believe the child died from injuries
suffered in the May 31 incident, the autopsy could not determine
whether the drowning was accidental or intentional.Abigail had
been in the care of her mother's boyfriend when the incident occurred
inside their apartment in the 2800 bock of Watermark Drive."There's
just not enough evidence to say that it was a homicide or accidental
so, of course, we have to follow what we have," Anderson said. "If the
police continue to investigate and they give us more information, then
of course the cause and manner can be changed."Sgt. Chad Mahaffey
said that the Police Department's crimes against children unit is
continuing to investigate and that no arrests have been made.Marissa
Gonzales, a spokeswoman for Child Protective Services, said the state
agency is investigating the mother and her boyfriend in connection with
Abigail's death. In addition, she said, CPS has an open investigation
involving a biological child of the boyfriend's "just based on risk
because [Abigail] had died in his care."Gonzales
said two complaints of neglectful supervision had been made against the
boyfriend in previous years in regard to his own child. In both cases,
she said, CPS investigators ruled the complaints "reason to believe."In
April, CPS opened an investigation involving Abigail after someone
filed a complaint with the agency that the girl had a bruise."Initially
in the investigation the decision was made to go ahead and have her
stay with a family member," Gonzales said. "After medical staff checked
her out and took into account the explanation for the bruise, they
decided it was consistent with the explanation."As a result, Gonzales said, Abigail was returned to the home May 27."The
decision was made that she could go ahead and go back to her mother's
care, though we would still be working with them," Gonzales said.The case was open at the time of Abigail's death, Gonzales said.

FWPD Investigating Memorial Day Toddler Drowning
Investigators in Fort Worth spent their Wednesday searching an apartment where a three-year old girl was found in a bath tub last week.
The little girl, Abigail Fleming, later died at a Fort Worth hospital. Now, neighbors are worried that Abigail's death was not an accident.
Crime scene investigators searched the apartment where the three-year old was found in a bathtub on Memorial Day. She was rushed to the hospital, the victim of an apparent drowning. But now, police say they aren't sure how she died.
A neighbor, who did not want to be identified, remembers when Abigail's family moved into the wildwood branch apartments near Lake Worth.
"She use to tell me all the time, me and my wife and my daughter, 'I love you, I'm leaving, hello, give me a kiss.' She was beautiful."
He says he fell in love with the little girl, and he was crushed when he found out she was gone. "I was like 'How can anyone be so negligent? How can that happen?'"
Police have not yet said what exactly what they were looking for in the apartment, but neighbors have their suspicions about what happened in that apartment.
This neighbor says Abigail became more reserved over the last month, and he and his wife would often hear her screaming. "By the time we got ready to go over there to knock on the door it had stopped."
This man misses his little jewel, who always brightened up his day. "I think about her all the time. All I can do now is pray."
Fort Worth police are still interviewing people, and are waiting for the medical examiner's ruling on what caused Abigail's death.
Neighbors say they haven't seen Abigail's mother or her boyfriend since she died. Police say no arrests have been made in this case.
