Yesterday’s proceedings began before the jury entered the court room. Jose Baez argued, based on the defense’s anticipation that Dr. Arpad Vass would be taking the stand, that testimony of Dr. Vass should not be allowed to be admitted yet. Jose Baez based his argument on what has become a very old gripe he has that the defense has not been allowed access to the entire decompositional gas database created by Dr. Vass, but owned by the FBI. Please remember that the FBI has already stated, via Ashton approaching them on the subject, not Baez, that they would be willing to share the database with the defense.

So, the first thing one probably wondered when they were hearing Baez’s renewed whining on this issue was “…do what?” Are you saying you didn’t attempt to get the database even after Jeff Ashton did your work for you and approached the FBI about their willingness to share it with you? Or are you saying you tried to get the database and the FBI said, “Just kidding, we’re not going to share?” Let’s see if we can find out which it is.
