An 11-month-old Brooklyn boy drowned in a bathtub yesterday after his mother left him alone, law-enforcement sources said.
Elijah Pardella and his 3-year-old sister were being given a bath inside their East New York apartment, the sources said.
When
the mom, Angelica Huertas, 24, left the bathroom, she left the drain
unplugged. But Elijah sat on the drain and blocked it, according to the
sources.
When she returned, the tub had filled with water and Elijah was not breathing, the sources said. His sister was fine.
Investigators questioned Huertas and are conferring with the DA’s office on possible charges.

NEW YORK (CBSNewYork) – Police say they have charged the mother of an 11-month-old Brooklyn boy who drowned in a bathtub with endangering the welfare of a child.
Police say 24-year-old Angelica Huertas was charged Tuesday.
Authorities say 11-month-old Elijah Pardella was found unconscious just after 2:30 p.m. Sunday in the family’s Pennsylvania Avenue apartment. He was pronounced dead at Brookdale Hospital.
Police say Elijah and his 3-year-old sister were left alone in the bathtub for several minutes with the drain unplugged, but the water still running.
The investigation is still ongoing.

Prosecutors are declining to pursue charges against the mother of an 11-month-old boy who apparently drowned in a Brooklyn bathtub.
Angelica Huertas, 24, had been arrested on charges of endangering the welfare of a child earlier Tuesday, but the Brooklyn District Attorney's Office said later that it was declining to prosecute.
Prosecutors determined the death was "tragic and accidental."
Huertas left the room when her 11-month-old son Elijah Pardella and 3-year-old daughter were in the bathtub Sunday afternoon. When Huertas returned, Pardella was under water and not breathing. His sister was fine.
According to The New York Post, the mother had unplugged the drain before she left the room, but the baby boy sat on it, preventing the water from escaping the tub.
The boy was pronounced dead at Brookdale Hospital.
It was the second time in a week a Brooklyn child has died in a bathtub. On Thursday, a 5-year-old girl drowned in a bathtub in Bedford-Stuyvesant. Law enforcement sources described her death as a tragic accident.

If you are responsible for the death of a baby it appears many courts don't give a damn.

This is sad. I won't walk more than 10 feet from my daughter when she's in the tub and she's almost 3. I certainly wouldn't do it with an 11 month old especially one who is bathing with a 3 year old. The 3 year old could inadvertantly injur the child, and not just by sitting on the drain. WTH people?

That indeed is a travisty. A 11 month old should NEVER be out of your sight for any time. Even one minute.
