Greeley CO ---- Police confirmed Thursday that a body recovered from
an irrigation ditch in northern Colorado is that of a 12-year-old girl
missing since March and she was the victim of homicide.Greeley
Police Chief Jerry Garner said the body recovered Wednesday is that of
Kayleah Wilson, of Greeley, who was last seen walking to a friend's
house for a birthday party.Garner said Thursday the coroner's
office ruled Wilson's death a homicide. He said police know the "manner
and cause" of death but he declined to provided details. No one has been
arrested, Garner said.The body had been in the irrigation ditch
"for some time" in an area that had been searched twice, Garner said.
Greeley is about 60 miles northeast of Denver.Police retrieved
the decomposed body from the ditch Wednesday, about a half-mile from the
home of the missing sixth-grader. A worker checking the ditch after
heavy rain found the body in about 3 feet of water, said Sgt. Joe
Tymkovich.Wilson's disappearance on March 28 spawned repeated
searches by police, Greeley residents and the FBI. Authorities said they
pursued more than 300 leads and knocked on the doors of about 1,000
homes.No one has been ruled out as a suspect, but investigators
have nothing that points to family members, Garner said.Tymkovich
said police are looking at a range of individuals who had the time and
opportunity to kill Kayleah and don't have good alibis."The
investigation has really turned a corner with the discovery of this
body," Tymkovich said.Authorities received additional tips on the
case after the body was recovered, and police will vigorously press the
investigation, he vowed."We don't give up on cases like this. We
don't give up," Garner said.Police met with Wilson's mother,
April Wilson, before the public announcement, the chief said."She's
upset as you would expect," he said.Family friend Cindy Rogers
said finding out about Kayleah "sure is devastating.""But now I'm
glad that it's her because now the community can lay her to rest,"
Rogers said. "She can go home to where she belongs."Rogers called
Kayleah "a very sweet, quiet young girl.""She loved to laugh.
She had a really great personality. She's going to be missed," Rogers
said.Authorities had stressed they didn't know if Kayleah Wilson
had run away or was abducted and did not issue an Amber Alert, which
notifies the public about a possible child abduction through text
messages, phone calls, radio and television broadcasts and highway
signs.Authorities said criteria for an alert include information
that a child may be in danger or if a suspect has been identified. The
criteria ensure that the public won't ignore alerts because they are not
broadcast often.In April, as leads from the public dwindled,
authorities increased the reward for information about Wilson to
$20,000. Investigators also described behavior that might point to a
possible abductor. They urged people to watch for someone who had missed
work, had unexplained injuries or shown an unexpected or sudden
interest in the case.About 150 people gathered at the ditch after
the body was found Wednesday evening, many of them carrying candles and
teddy bears.

Tied to the fence behind Brentwood Middle School in Greeley, pink
ribbons dedicated to the memory of Kayleah Wilson flutter in the wind on
Thursday morning. The ribbons were tied there Wednesday afternoon to
keep the sixth-grader on the minds of students over the summer. The idea for the
memorial was conceived before students learned of the discovery of a body.

An 18-year-old Colorado man has been arrested for allegedly having
sex with a 12-year-old girl whose decomposed body was recovered this
week in an irrigation ditch, police said.Greeley police Sgt. Joe
Tymkowych said the arrest of Robert Laurencio Montoya, a former
boyfriend of sixth-grader Kayleah Wilson, is unrelated to the homicide
investigation involving her death. Authorities said they know how the
girl died, but aren't releasing details."This arrest is separate

been missing since March when her body was found Wednesday in an
industrial area about a half-mile from her house. Montoya was arrested

bail was set at $100,000.His next court hearing is May 25.Tymkowych
said Montoya had previously been interviewed and cooperated with their

grassy banks."It's an open wound because whoever did this is
still out there," Melissa Lujan, whose daughter knew Kayleah said
Thursday. "You know it's bringing us together to where we watch our

kiss them before they leave but just knowing that somebody could do

An 18-year-old man who authorities allege
had a sexual relationship with Kayleah Wilson has been charged with
sexual assault on a child, Greeley police said this afternoon.
However, Greeley police said that the arrest of Robert Laurencio
Montoya is "separate and distinct" from the Kayleah Wilson homicide case
currently being investigated.

Sgt. Joe Tymkowych said that the arrest of Montoya culminated an
investigation in which probable cause was developed to believe Montoya
was involved in a sexual relationship with Wilson, who was 12.
Her body was discovered in an irrigation ditch on Wednesday morning,
about a half mile from her home.
The Weld County District Attorney's office said that Montoya
has been charged with two counts of sexual assault on a child.
One is sexual assault on a child, a class four felony. The second
count is sexual assault on a child, pattern of abuse, a class three felony.
Montoya was arrested on Wednesday and appeared in Weld County
District Court this morning, said Jennifer Finch, spokeswoman for
District Attorney Ken Buck. Montoya's bond was set at $100,000, which he has not made.
Wilson's body was discovered in an irrigation ditch by a ditch rider
at about 6 a.m. Wednesday in a pool about 10-feet wide and 3-feet deep,
just below an irrigation gate.
The area where the body was found had been searched extensively at
least twice by people looking for the 12-year-old.

Greeley Police Chief Jerry Garner said that heavy rains both Tuesday
night and several days ago may have "moved the body from a culvert or
hiding place" to a position in the ditch where it could be seen.
About 10 a.m., Wednesday the body was removed from the ditch and
taken to McKee Medical Center for identification.
On Thursday, Garner announced that the body was that of Kayleah Wilson.
"We've got a lot of work to do now," said Garner when he announced the identification and confirmed that
Kayleah had been murdered.
"We'll be talking to lots of people," he said.
The coroner determined that Kayleah's death was a homicide - but
Garner would not say exactly how she died.
He also would not say how long she might have been in the ditch,
which is half a mile from her home but not on the route to her friend's
house, where she was going to attend a birthday party.
Kayleah was last seen March 28, shortly after leaving her family's
apartment in the 2800 block of 28th Street.

The mother of Kayleah Wilson, whose body was found Wednesday in a west
Greeley irrigation ditch, issued a statement Saturday that she severed a
relationship 12-year-old Kayleah had with an older boy as soon as she
learned of it in February.

The boyfriend, 18-year-old Robert
Montoya, has been charged with sexual assault on a child in connection
with offenses ranging from Jan. 18, 2010, his birthday, to March 28, the
day Kayleah disappeared. Montoya is being held on $100,000 bond in the
Weld County Jail.

Montoya, who was arrested Wednesday night, is
considered a “person of interest” in regard to Kayleah, whose death is
being investigated as a homicide, Greeley Police announced Thursday.

Court
documents indicate Kayleah and Montoya started a sexual relationship in
October 2009.

“As soon as April (Wilson, Kayleah's mother) knew
about Robert and Kayleah, she severed the relationship, and that was in
February,” said Michelle Thompson, spokeswoman for April Wilson.
“Everyone was assuming April was allowing this relationship, when April
did not allow it whatsoever.”

As the law pertains to this case,
the alleged sexual relations between Kayleah and Montoya were illegal
because she was younger than the age of consent, which is 15, and
Montoya was more than five years her senior.

Police have arrested Kayleah Wilson's former boyfriend on charges of
sexual assault on a child, but say it is a separate case from the
12-year-old girl's homicide.

Greeley Police arrested 18-year-old Robert Laurencio
Montoya on Wednesday night just after 8:30 on charges of sexual assault
on a child. Montoya is still in the Weld County Jail in lieu of a
$100,000 bond.


He also faces a charge of sexual assault on a child
as a pattern of abuse. That means investigators believe there were at
least two occurrences of the abuse.

Montoya appeared in court on Friday morning for a
bond hearing and will be back in court on May 25.

He has not been named as a suspect in Kayleah's
murder. Investigators say they believe Montoya had a sexual relationship
with her.

Court records obtained by 9Wants to Know show
investigators think Montoya started having sex with Kayleah in October
of last year.

Kayleah's body was discovered in a Greeley drainage
ditch on Wednesday morning. Police say her death is not accidental.

She went missing on March 28 when she left her home
for a birthday party but never arrived.

"Just the past couple of months, he [Montoya] was
acting really weird," Kalyeah's friend, Shelly Culver, said.

Culver was in a few classes with Montoya. She says he
and Kayleah seemed to like each other a lot. Around the time of
Kayleah's disappearance, Culver says Montoya's personality changed.

"He e-mailed me on MySpace saying he was having a
panic attack. And that he didn't want anything to do with me or
anybody," Culver said. "He just said there was a lot going on and he had
a lot of problems."

It is unclear what sort of problems Montoya was
dealing with and if it was connected to Wednesday night's arrest.

"Getting a suspect in custody is always a priority to
any investigators trying to solve a case," Robinson said.

When she was found, investigators say Kayleah had
been killed some time ago. Her body was in an advanced state of
decomposition so the Weld County Coroner's office had to identify her
through dental records.

Investigators say they know how she died, but are not
releasing details.

Greeley Police say more officers are now on the case
after the discovery of Kayleah's body. Investigators plan to
re-interview all individuals and retrace their steps to make sure
nothing was missed.

Police say 15 to 17 detectives are working the case
daily along with FBI agents. The Colorado Bureau of Investigation is
conducting all evidence analysis of the body and evidence taken from the
area where the body was found.


A local funeral home is also covering all expenses
and a car dealership is giving April Wilson, Kayleah's mother, a used
car. A restaurant is also donating two days of proceeds to the Wilson
family.

April Wilson says she is touched to see this type of community support.

Greeley Police are still looking for additional tips
related to the investigation. Anyone with information is urged to call
970-350-9600. There is a $20,000 reward for information that leads to an
arrest and conviction.

A public memorial service will be held Tuesday afternoon for 12-year-old
Kayleah Wilson.

Over the weekend visitors came to Greeley from as far away as Nebraska
to pay their respects to the sixth grader, whose body was found in an
irrigation ditch last week.

A makeshift memorial was set up near the ditch for the Greeley girl, who
had been missing for nearly two months.

Police are still searching for her killer.

"Nobody really knew where she was at. It's hard to find her in the water
and it just hit me really hard, even though I didn't know her," said
Maria Ochoa, who came to Colorado from Ogallala, Neb.

The public memorial service will be 2 p.m. at the Clarion Hotel Ballroom
at 701 8th Street.

Wilson's 18-year-old boyfriend Robert Montoya will also be in court on
Tuesday. He is in jail and tentatively charged with felony sex assault
on a child. Greeley police say those charges are seperate from the
homicide investigation that was launched after the coroner determined
Wilson was killed.

Love and hope. In the uncertain times following the discovery of
12-year-old Kayleah Wilson's body, Pastor Arron Chambers of Journey
Christian Church knows that the community needs to hold on to the things
that are certain.

“Kayleah was a very loving person and the love
of this community has come through,” Chambers said. “We need to pray
for her family and pray for justice, that the FBI and the police will be
able to find whoever did this.”

Chambers will preside over
Kayleah's public memorial service at 2 p.m. today at the Plaza Hotel and
Conference Ballroom, where the public will get a chance to pay its
respects and reflect on the story that has gripped an entire community.

Kayleah
went missing on March 28 when she left her home alone and on foot to
attend a friend's birthday party near the Greeley Mall, sparking an
intense two-week search for the missing sixth-grader.

On Wednesday morning a body was found in an irrigation ditch about a
half-mile from Wilson's home, and on Thursday officials said dental
records confirmed the body was Kayleah's.

No arrests have been made in the homicide case, but Kayleah's boyfriend, 18-year-old Robert
Laurencio Montoya, has been arrested on suspicion of sexual assault of a
child and sexual assault on a child as a pattern of abuse in connection
with his alleged relationship with the girl.

Wilson's death has hit close to home for Greeley residents, with many people shocked that
something like this could happen in their midst. Chambers said he will
be talking today about coming together to overcome the fear and
uncertainty that has fallen over the community in the wake of such a
traumatizing event.

“We need to keep pulling together as a community,” Chambers said. “This should remind us that we need to
cherish our family and our kids. But we cannot let fear take over us.
This is still a great place to live, and we can't let one incident
change that.

“There are good people who are working on this,
trying to keep us safe and bring the people who did this to justice.”

In addition to Chambers, several other members of the community close to
Kayleah and her family will be speaking at the service. Chambers said
the family is especially grateful to the community for all of its
support and that they want this memorial service to be a celebration of
Kayleah's life.

“To many people, she's just a picture on TV or in
the paper,” Chambers said. “(Today) we want people to see the sweet
little girl behind the picture who loved her family and her community
and loved God.”

The 18-year-old boyfriend of murder victim Kayleah Wilson, 12, is in
jail today on $100,000 bond, facing a charge of sexual assault on a
child because of his relationship with the murdered girl.

Greeley police spokesman Sgt. Joe Tymkowych said Friday that the sexual assault
is not currently connected to the murder of Kayleah, whose body was
found earlier this week in a west Greeley irrigation ditch.

Robert Laurencio Montoya, 18, of Greeley is considered a “person of interest” in
the case, Tymkowych said. “...one of several persons of interest.” He is being held in the Weld County Jail on charges of the sexual assault on
a child and sexual assault on a child as a pattern of abuse.

All court records on the case have been sealed by the Weld District Attorney's Office.

Rumors of Kayleah's possible pregnancy have been
coming up in the case, but Tymkowych said he can't confirm those stories.


The girl disappeared March 28 on a Sunday afternoon when
she left her south Greeley home to meet a friend for a birthday
party.
She was never seen again until Wednesday morning, when her body was
discovered in the irrigation ditch.

It was so badly decomposed
that the exact date of death hasn't been determined. Police will not
release the cause of death, except to say it is now being investigated as a murder case.
