"Baby John" FAIN - 5 Months - /Convicted: Amanda Fain - Clovis NM
Police have arrested the 21-year-old mother of a 6-month-old boy hospitalized in Lubbock with life-threatening injuries.Amanda Fain was charged Thursday night with abuse of a child resulting in great bodily harm.She is being held at the Curry County jail on $100,000 cash-only bond, jail officials said.Police responded to Fain’s residence at 405 Johnson St. Tuesday morning for a report her infant son was gasping for breath.The boy was later airlifted to a Lubbock hospital, where he received a poor prognosis.Police Capt. Patrick Whitney said as of Friday, the child’s condition had not improved.The investigation is ongoing, Whitney said, and detectives continue to interview friends and family.“There was probable cause to believe that she caused the injuries to the child,” he said. “The motive or why at this point I can’t say; I don’t know.”Fain’s other children were removed from the home and are in the custody of the state, Whitney said.If the child does not survive, Whitney said, the charges could be modified to child abuse resulting in the death of a child, which is a special charge similar to murder but specifically addressing a case involving a child victim.And the potential for other charges exists as the investigation continues, he said.A 1-month-old girl injured in an unrelated case is also showing no improvement, Whitney said.Officers were advised Tuesday by emergency room staff at Plains Regional Medical Center of healing fractures they found in X-rays of the girl.She was transported to the same children’s unit at the Lubbock hospital where the boy was taken and underwent brain surgery.Whitney said there have been no charges filed in connection with her injuries and the investigation is ongoing.

An examination by doctors found a 6-month-old boy, whose mother is in jail charged with abuse, had multiple broken bones, bruises and other injuries, some of them weeks old.
Amanda Fain, 21, was arrested Thursday night for child abuse resulting in great bodily harm and is being held on a $100,000 cash-only bond at the Curry County Adult Detention Center.The injuries the 6-month-old suffered were extensive and took place over a period of days and weeks, according to an affidavit filed in Curry County Magistrate Court.The child was transported from his family’s home at 405 Johnson St. to Plains Regional Medical Center Sept. 28 after a 911 call indicated he was gasping for air.He was stabilized at PRMC, then airlifted to a Lubbock Childrens' unit, records show.Doctors identified numerous injuries in various stages of healing, including; bruising on his head, torso, face, arms, legs and feet, human bite marks, burn marks on his shoulder, stomach and groin area, cuts and abrasions and a broken leg, healing neck fractures and internal bleeding beneath the skull.Investigators photographed the injuries and presented Fain with 11 photos during an interview, the affidavit said. She explained each injury, records show, telling investigators she felt “overwhelmed” with the crying from her children and put him into bed “harder than usual,” and that she didn’t realize how hard she had bit her son’s toe.Fain has four other children who were removed from the home following the incident and are in the care of child services.The oldest of the children, a 4-year-old boy, told investigators the children bit and hit each other and his mother had hurt the 6-month-old in the past with several different objects.Staff at the Lubbock hospital where the boy is being cared for reported the child “coded” Thursday and was resuscitated but had “minimal probability” of survival, the affidavit said.Monday, police Capt. Clovis, NM ~ Ninth Judicial District Attorney Matthew Chandler announced today
that Amanda Fain, age 21, was sentenced to serve twenty-four (24) years
in prison for four (4) counts of Child Abuse.
On September 27, 2010, Clovis Police Department was dispatched to a
call of a 6-month old baby that was not breathing. Upon entering,
officers made contact with the mother and four other children under
4-years of age. The residence was noted to be extremely dirty with a
foul order. The baby was not responsive to the emergency response team
and was immediately transported to the hospital. During initial
examination, doctors found bone fractures, human bite marks, multiple
bruises on the head and face, sores on the feet, and cigarette burns all
over the 6-month old’s body. The baby was found to have suffered a
traumatic brain injury that was causing severe swelling. The baby was
in critical condition and was flown to Lubbock for stabilization.
Detectives questioned the mother, Amanda Fain, about the baby’s
injuries. At this time, the father of the child, Jonathan Grubbs, was
incarcerated at the Curry County Detention Center and away from the
home. During the interview, Fain eventually admitted to slamming and
hitting the baby numerous times and biting his toe out of frustration.
She also disclosed that the other children in the home would jump on the
baby and hit the baby with objects. The baby survived the ordeal and
was eventually released from the hospital.
Ninth Judicial District Attorney Matthew Chandler stated, “There's no
excuse to intentionally hurt a child. Fain will spend the next
twenty-four years in a prison cell and our hope is the child will
someday fully recover from this brutal abuse.”
Amanda Fain was sentenced by the Honorable District Judge Teddy
Hartley to serve twenty-four (24) years in the Department of
Corrections. The Court also ordered that upon completing her
twenty-four (24) year sentence, Fain also faces an additional five (5)
year period of intensively supervised probation. Chief Deputy District
Attorney Andrea Reeb prosecuted this case on behalf of the State.
