Beeville TX ---- Beeville authorities are investigating the suspicious death
of a 20-month-old child. Police said he died from a head injury and he
also had other injuries on his body, So far they haven't determined if
it's child abuse.
Authorities said nobody has been arrested, but several
people are being questioned in his death. They're hoping to find out
how the child got his injuries and if somebody is criminally
responsible.
"Personally, I don't believe I've ever worked a case
involving these types of injuries," said Lt. Rene Guerrero, a detective
with the Beeville Police Department.
The 20-month-old child's name is Elias Ramos Torres and he
died last Friday at Driscoll Children's Hospital. Torres was brought to
the hospital from his apartment at the Windsong Apartments in Beeville
with a head injury Wednesday and died from it two days later. When
doctors examined him at the hospital, they found other injuries to his
body.
The baby's father, who doesn't have custody of the child,
claims an autopsy showed the head injury was from blunt force trauma,
while his body injuries were a broken rib and burns on parts of his
body.
"The answer to why the mother isn't under arrest is because
we haven't determined that she caused any of the injuries," Lt.
Guerrero said. "We cannot rule out that it wasn't an accident and we
can't rule out it was a criminal act."
The mother wasn't available for comment, but police said she
has been cooperative. They said the mother wasn't home at the time the
child received the head injury.
CPS is helping out with the investigation and they have
removed an older brother from the home already.
Investigators said it's possible the boy didn't get these
injuries from child abuse. For now, they hope to finish the
investigation soon and determine if anybody will face criminal charges.

Daniel Torres claims he is the biological
father of baby Elias. He says he raised the boy for a year before the
mother moved away to Beeville. He's now left without Elias and his older
brother, but he has his little girl Navaiah.
"The only thing keeping me sane is that I still have my daughter. You
know kids are supposed to bury you, you aren't supposed to bury them. I
still want the person, whoever did it to pay," said Torres.
Investigators are still trying to find out where those internal
injuries came from. Torres says they should ask his mother.
"Knowing that there's old injuries, I mean he's been getting hurt and
little Elias must have pissed him off enough where they took him out,"
said Torres.
He says he saw some of the old injuries.
"On his right arm, he had a fork mark. I'm 100% that that's a fork
mark and on top of that, that fork mark had a scab," said Torres.
Although
the autopsy reports are still pending, Torres has a message for his
dead son.
"Daddy is sorry that he couldn't protect you, but I won't let it
happen to his brother or sister."
Back on May 12th, Elias' 28-year-old babysitter called 911 and told
paramedics the toddler was having trouble breathing.
The boy was first taken to a Beeville hospital and later transferred
to Driscoll Children's Hospital where he died the next day.
Doctors say Elias had a fractured skull, internal injuries, as well
as signs of older injuries.
His three-year-old brother Jeremiah has been placed in foster care,
and the boy's biological father is now trying to get custody of him.
We also learned today that Elias' 24-year-old mother has a history
with Child Protective Services.
Back in 2005, CPS looked into allegations that one of her children
had been abused.
In 2007, the agency looked into allegations of medical neglect but
nothing came of the investigation.
She was also arrested for possession of marijuana in 2007, and this
year CPS provided her with counseling following a report that she left
her child with no supervision.
Detectives will meet with the medical examiner next week to go over
the results of the autopsy of Elias and the toxicology results.
A court hearing is also set for May 28th in Bee County to determine
if three-year-old Jeremiah will be returned to his mother.

A Bee County judge has ruled that the brother of baby Elias Ramos
Torres, Jeremiah, will remain in foster care.
Three-year old Elias was flown to Driscoll Children's Hospital on May
13th, and died from a head injury. Staff at the hospital later found
other, older injuries on the boy's body. Police are investigating the
incident.
Elias's brother, Jeremiah, was taken into the custody of foster care
immediately following the incident, and a judge ruled on Friday, that he
will remain in foster care. Jeremiah's mother has been ordered to pay
$50 a week in child support and is being allowed visitation.
Torres, Jeremiah, will remain in foster care.

The head of the Beeville Police Department’s Criminal Investigation Division said Thursday that no one has been cleared in the investigation of the death of 20-month-old Elias Ramos Torres.
