Terri Moulton Horman's attorney asks for more time for her to move out, cites threats against his client
Published: Thursday, July 15, 2010, 4:39 PM Updated: Thursday, July 15, 2010, 5:35 PM
Maxine Bernstein, The Oregonian
Andrew Burton/The OregonianKyron Horman's stepmother Terri Horman and Kyron's father, Kaine Horman at a June 13 press conference.
Kaine Horman appeared with his lawyer this afternoon at Multnomah
County Circuit Court , asking a judge to order his wife out of their
home as soon as possible.
A judge set a full hearing for 3 p.m. tomorrow.
Stephen Houze represented Terri Moulton Horman, who did not appear.
Kaine's lawyer said her client would like to get back in his home and get Kiara, 20-months-old, "back where she belongs."
She cited the need to bring back some routine for Kiara, as well as safety
concerns, noting that Kaine Horman is not sure who else Terri Horman
shared his new address with. He needs to recode the electric gate
outside their home, change locks, buy groceries and get back to work to
support the family, his lawyer Laura Rackner said.
"The child's best interest in this case is to be back home," Rackner told
the court." She's got a brother whose abruptly gone...Mr. Horman has to
get the child back into a routine, get her adjusted."
Houze said his client has agreed to leave the home, and was working with
attorneys to make sure Kiara and Kaine had the necessary possessions
they needed.
"It is simply a matter of logistics," Houze said. "It is not a simple matter to pick up everything and simply be gone."
He also said Terri Horman has been the subject of threats. He said there's
been "threats of harm routinely directed towards my client which I take
very seriously."
He blamed the threats on what he called a "media frenzy...a witchhunt" directed at his client.
Houze also said he didn't understand why Kaine would put his new address in
the restraining order petition, when he could have chosen not to do so.
He said he wonders how serious Kaine Horman's safety concerns are,
considering "they revealed to my client where he was staying."
"It is one of the upmost concerns of my client that her daughter be in a safe, well-cared for circumstance," Houze said.
"I suggest 96 hours, Monday afternoon."
Kaine Horman wore a gray sweatshirt, tan shorts and sneakers and wore a Kyron Horman green wristband.
Earlier in the week, the judge had set two court dates – July 22 and Sept. 21 –
to address Kaine Horman's pending motion to hold his wife in contempt
of court.
Kaine Horman's lawyer has asked the court to impose "remedial" sanctions against Terri Horman.
Kaine Horman left the house with their daughter on June 26 after
investigators told him that Terri Horman had solicited her landscaper
to kill him in an alleged murder-for-hire plot six to seven months
before his 7-year-old son Kyron disappeared at a school science fair on June 4.
In court papers seeking a restraining
order against his wife, Kaine Horman said he believes his wife is
involved in the disappearance of his son.
Rackner argued in a motion filed Monday that Terri Horman shared the contents
of a sealed restraining order – most notably her husband's new address
– with a man whom Terri Horman had developed an intimate and sexual
relationship with since her stepson Kyron's disappearance on June 4.
The man, Michael Cook, was a high school friend of Kaine Horman.
Terri Horman has alerted the court she would not contest the restraining
order, which prevents her from having any parenting time with her
daughter Kiara, 20 months old.
Terri Horman, 40, has not been charged with any crime. The investigation into the boy's disappearance is ongoing.

KATU News Director Don Pratt responds:
“KATU recognizes the seriousness of the search for Kyron Horman, and the intense interest it has generated in our community.
However, we are separate from the criminal investigation. Our reporting is independent. This request
puts us in the position of volunteering to become part of the criminal investigation. We can’t do that.
The usual way this works is that if someone wants copies of KATU material, they issue a subpoena. That
has not happened. If the request comes through the usual way, and we receive a subpoena, we will evaluate
it. As a general matter, we can only provide copies of materials that have aired for broadcast.”

Court docs: Kaine wants Terri out of the house now
Court documents reveal that Kaine Horman’s legal representatives are asking a judge to move up Terri Horman’s move-out date up to July 15 or 16. Terri’s attorney has said she will not contest the order to move out, but the original timeline was for moving operations to begin after a July 22 hearing on the matter.
The documents say that Kaine is now asking to push up the date “to protect the safety of Petitioner [Kaine Horman] and the children,” who were not specifically named.
The document went on to say that Terri Horman has “not provided information about when she will vacate the family residence.”
The documents were dated July 13 and the trial date was marked “none.”

Kaine Horman appeared in court Thursday with his lawyer, seeking to push
his wife out of their home immediately, while her lawyer urged a judge
to give her at least 96 hours, until Monday afternoon.
Multnomah County Circuit Judge Keith Meisenheimer said he'd decide after
a 3 p.m. hearing Friday.
Houze told the court he didn't understand why Kaine Horman would put his
temporary address in the restraining order petition, when he could have
chosen not to do so. He said he wonders how serious Kaine Horman's
safety concerns are, considering "they revealed to my client where he
was staying." He also argued that Terri Horman wasn't prohibited from
sharing the information, though a judge had sealed the order.
Rackner pointed out how unusual this case was, saying that Kaine Horman
was told by law enforcement officers June 26 to leave the home after
they informed him of his wife's alleged murder-for-hire plot against
him.
"He was told to get his daughter, get his things and get
out in a hurry," Rackner said.
This is a long article but I've snipped what I thought was new info. Here's the link to the whole thing.

15: Kaine Horman Answers Questions From FOX 12
POSTED:
7:23 am PDT July 16, 2010
UPDATED: 7:26 am
PDT July 16, 2010
PORTLAND, Ore. --
The following is a correspondence between FOX 12 and Kaine Horman on
July 15, 2010. The questions and answers have not been edited.
FOX 12: Kaine, we know that you are trying to fast
track the process of Terri
moving out of your house, can you explain why and what you want the
judge to know about why it's important for you right now?
Kaine Horman: In all cases occupation of the house
should have nothing to do with any adult - it should be about what's
right for the two children involved: Kyron and Kiara. We need the
weekend, primarily all of Saturday, to walk through, secure the house,
and make it usable (new locks on doors, re-code the electronic gate,
replace items that Terri has taken, etc). The services for the locks
and gate are not available on Sunday. Kiara will be moving into a more
regular schedule that will include day care and I am returning back to
work a little more starting next week. The use of Saturday at the house
will be key. Having Kiara back at home for 2 full days will make the
adjustment of life going forward much easier. If we wait until next
week it will be more difficult to schedule and have things reviewed and
secured right away and Kiara will have to adjust to being back home
while also attending a new day care. I think it is a priority to limit
the impact to her as much as we can.The big thing is to have the
house ready for Kyron. If they find him tonight, any time tomorrow, or
on the weekend (assuming Terri may stay in the house until Monday) then
where will he go? Another place that is not his home - which I do not
find acceptable. He needs to come home to HIS home, HIS room and not
anywhere else. The fact that Terri's legal representation thinks she
should stay until Monday leads me to believe they do not expect the
truth from her this weekend. Having the house available and ready for
our missing 7 year old son should far outweigh any adult need for the
residence. It cannot be ready for him while she is still in it. When
we left the house back in June I had 15 minutes to pack for Kiara and I
for an unknown location and an unknown amount of time. We've been gone
almost 3 weeks and while we don't have everything we could use (her high
chair, nice clothes for court, etc), we have what we REALLY need.
She's had a week to do the same - that should be enough. She will
always be able to request property from the house and have it picked up
in the future so there should be no need to delay further.
FOX 12: Kaine, what are your feelings about what came
out in the restraining order documents this week about Michael Cook's
involvement with Terri? His friend tells us that she believes he was
trying to play along with Terri's advances in hopes of getting
information about Kyron. Do you think there's any truth to that?
Kaine Horman: I have only seen Michael Cook once since
high school, which was during the week after Kyron when missing, so I
cannot really comment on his intent based on my knowledge of him. I can
say that I get briefed by law enforcement and lawyers once or many
times per day. If he was really trying to accomplish what is claimed I
think that law enforcement and lawyers would know about it and I would
have been briefed about his interaction and intent. I have received no
such briefing.
FOX 12: Desiree, Kaine and Tony -- all three of you are
becoming more and more vocal about the fact that you think Terri is
lying and that she's behind Kyron's disappearance. How do you think she
might be reacting to that? Do you think it's pushing her to start
cooperating with police?
Kaine Horman: I don't know that it is having much of
an impact to her directly. Her actions continue to paint
the picture of the person she has become. This continues to reinforce
what I think all 3 of us have believed for some time: that she
is involved and is the primary person responsible. Based
on briefings we've had recently she is still not
cooperating.
FOX 12: You've all said recently that you think someone
else besides Terri may have been involved in Kyron's disappearance. Do
you have any theories about who that may be?
Kaine Horman: currently I do not although i do
believe that it is someone that Kyron has met before, whether I know of
the person or they were only a friend of Terri's.

15: Kaine Horman Answers Questions From FOX 12
POSTED:

UPDATED: 7:26 am

She will

Kaine Horman: "Terri was a good person when we first met"

PORTLAND, Ore. -- In response to questions from KGW NewsChannel 8, Kaine Horman admitted he still wears his wedding ring, and says he and others who knew Terri Horman "did not see this coming."
Asked about his wedding ring, Kaine replied: "Yes I am still wearing it. I’m not sure why I have not removed it. The magnitude of Kyron being gone and our efforts to bring him home are of such higher priority in comparison I honestly have not even thought about it."
Kaine's 7-year-old son Kyron has been missing since June 4. Police have not named Terri Horman a suspect or person of interest but in court documents Kaine Horman stated that police provided him with probable cause to believe Terri had knowledge of Kyron's disappearance. In recent interviews, both of Kyron's parents have stated they are certain Terri was responsible for Kyron's disappearance.
In his response to questions from KGW, Kaine acknowledged that people have commented about 'how could he marry a woman like this' and how could he 'not see this coming.'
In response, he write: "Terri was a good person when we first met and for several years (I’d say up until 2008). She was always about children (teaching) and helping them grow and develop. Her attitude was always about those types of things first, her own self not even being a priority close to that.I believe that this is the Terri that everyone else saw and got to know as I did"
"Honestly everyone, including myself, that knew her or knows her did not see this coming. She was not the type of person we are seeing right now," added Kaine Horman.
"There were some signs of emotional distress here and there over the past year and a half but not enough of that directed at any one person to conclude she would be capable of anything even remotely close to events of the severity we have all seen"
"She recently got her teaching license re-instated and has been applying for teaching positions so even the state of Oregon didn’t see this coming," wrote Kaine Horman.
A hearing was set for 3 p.m. Friday to decide whether Terri Horman should be forced to immediately vacate the family's home in Northwest Portland.

Kyron Horman's step-mom agrees to move out Saturday
by David Krough and KGW.com Staff
Updated today at 1:54 PM
PORTLAND, Ore. -- Kaine Horman and his estranged wife, Terri Moulton-Horman came to an agreement for Terri to move out of the former family home in NW Portland by 3 p.m. Saturday.
Kaine believes his missing son, Kyron is still alive and wants him to have a safe home to return to. Kaine and his lawyer Laura Rackner and Terri's defense attorney Steven Houze made the agreement Friday, according to a source.
Kaine was told by police last month that Terri had tried to hire a man to kill him, according to a restraining order filed by Kaine. More: Murder-for-hire-plot Kaine's attorney said he wanted to be in the home by the weekend in order to re-key locks, find daycare for the couple's daughter and return to his job at Intel.
Houze said Terri has been the target of several threats.
Through her attorney, Terri has said that she would be willing to move out if Kaine would pay for the move. However, Kaine's attorney said he was not willing to give her any money until she cooperates with police, because Kaine believes Terri has information about Kyron's whereabouts after he disappeared from Skyline Elementary on June 4.
Terri's attorney Houze said the ability for her to move out was difficult due to the media "witch hunt" and news conferences held by the Hormans were "fanning the flames." He argued his client should be granted until Monday afternoon.
Kaine also recently filed papers to have Terri held in contempt of court and accused her of violating a sealed restraining order. That court motion also detailed an alleged sexual affair with one of Kaine's high school classmates, and a reported attempt to "abduct" the couple's young daughter Kiara.
Kaine Horman's attorney Laura Rackner asked a judge to hold Terri Moulton Horman in contempt of court for showing a then-sealed restraining order to Michael Cook. On Tuesday, a judge set a hearing for July 22 over the restraining order.
Houze said Terri agreed to move out, give up rights to custody, but the hearing will address financial and other issues. A date of September 21 was set aside for the contempt of court hearing.

Re: KYRON HORMAN - 7 yo - Portland OR
FCITC the way this is being handled is turning this into a complete mess IMO. I can understand LE wanting to keep what they have discovered so far in their investigation to themselves, but now that the Horman's have publicly released some of what they have been told by LE I think they should hold a press conference and clear it up. I have still got an open mind about TH being involved at this point becase we just don't have enough info to go on. It looks like LE have decided TH did this, probably with the help of someone else if we go by statements Kaine and D have said. Just because LE think TH did this is not enough for me to decide whether or not she did. It depends on what evidence they have as investigators often get it wrong. What I want to know is whether they have been able to verify the allegations the man made about TH trying to hire him for murder. I think LE have made a mistake going to Kaine and telling him to take Kiara and get out. If I were Kaine I would have wanted to keep her very close if I thought she held the answer to what happened to Kyron. He could have talked her into letting Kiara go to her parents and I would take the risk that she wouldn't try to murder Kaine under the spotlight. By alienating her and giving her no option but to get a lawyer they have stuffed up. If she was unaware that she was a suspect she may have made mistakes or contacted other involved parties if they exist.

Kaine Horman: currently I do not although i do

that it is someone that Kyron has met before, whether I know of

This statement means to me that most likely they think that Kyron may have left the school willingly with someone else other than TH. Why else would they feel that it must be someone Kyron had met before? There seems to be some evidence or reason for them to believe someone other than TH took Kyron. Does this mean that they have verified that TH did leave the school without Kyron? It looks like there is more evidence pointing towards someone other than TH, without being privy to everything LE have found. The only reason I think KH more than likely is involved is because of her behavior - her apparent inappropriate behavior under the circumstances is a big red flag.

Re: KYRON HORMAN - 7 yo - Portland OR
Terri Horman is, of course, the step-mother of missing 7-year-old Kyron Horman, who has not been seen since June Fourth. Terri Horman has not been named a suspect in Kyron's disappearance, but much of the investigation has shifted to her and what she may know. As of Friday night, she's believed to be staying with family in Roseburg.
The Roseburg neighborhood where Terri Horman's parents Larry and Carol Walton live was definitely visibly shaken Friday night. Many neighbors are reacting to the possibility that Terri might be moving in just a few houses down. Ordered by the courts, Terri Horman has moved out of the Portland home she shared with Kaine Horman. There weren't any signs of Terri's red Mustang in this Roseburg neighborhood. Reporters tried contacting Terri's parents at the residence she's rumored to be moving into, but no one opened the door or answered the phone.
Several neighbors in the area were reluctant to speak to reporters, fearing they'd upset Terri's parents. But the folks who did talk had mixed feelings when it comes to Terri's possible arrival.
Neighbor Tony Waller said, "Well after what happened to her step-son and everything like that, anybody with children would have their concerns."
After a short while in the neighborhood, the windows of the residence where Terri Horman is believed to be moving into became covered.Neighbor Carolee Harbour said, "I know if my child was in trouble, I know I'd support my child so, I don't disagree with them having her in the house."
Roseburg Police responded about the possibility of Terri Horman showing up in town. They say they are aware of it and don't expect any issues, but are ready if anything problems should arise.

Kaine Horman describes how Terri Moulton Horman 'vented' after flunking
her polygraph
Published: Friday, July 16, 2010, 9:48 PM Updated: Saturday, July 17, 2010, 12:47 AM
Kaine Horman said Terri Moulton Horman came home from taking her
first polygraph examination after Kyron's disappearance and "vented her
failed results to all family, friends, and law enforcement at the
house."
As the search for Kyron enters its sixth week, Kaine and
Kyron's mother and stepfather, Desiree and Tony Young, invited The
Oregonian and other media to submit written questions.
In his
responses sent late Friday, Kaine Horman touches on the strife in his
marriage, his belief that a third party was involved in his son's
disappearance and how he is now coping with being a single father.
» Timeline
» Stories
» Photos
» Videos
"Kiara and I have not discussed any of this yet," he wrote. "She
can't quite talk just yet and would not be able to understand verbally
what is happening yet. I am providing her with as much love, routine,
and support that I possibly can."
Kaine Horman moved out of his
family home June 26 with his 20-month-old daughter and has since gone to
court to force Terri to leave. She has gone to Roseburg, where her
family live.
The following are Kaine Horman's written
responses:
Q. Kaine, did you know the landscaper who was
involved in the alleged murder-for-hire plot? Did you ever meet him?
A:
No, I did not know we had a landscaper and have never met him
Q:
What are you reactions to this week's developments in court documents,
which said Terri Horman had struck up a relationship with Kaine's high
school friend, Michael Cook, and was sexting him days after you moved
out and filed for divorce?
A: We will deal with the issue as
part of the legal matters in front of us, it does not even approach the
priority of finding Kyron so we will deal with it then. I have only
seen Michael Cook recently since high school, which was during the week
after Kyron when missing, so I cannot really comment on any relationship
we had. We had just gotten reconnected and were trying to figure all
that out.
I am not aware that Terri had met Michael prior to
Kyron's disappearance.
Also Friday
Terri
and Kaine Horman reach settlement; she moves out and leaves for
Roseburg, where her parents live
Q: What were the "red
flags" or warning signs that Desiree Young thought she may have missed
prior to Kyron's disappearance? Desiree told the Today Show that Kyron
seemed increasingly unhappy when he left their home after his visits
with the Youngs. Kaine, did you see any warning signs and if so what?
A:
Desiree's quote was not taken in its entirety. As a younger boy, Kyron
can express distress when going from one household to the other if he
has been having a great time and is looking forward to upcoming
activities with that particular household. There was no abnormal amount
of this happening after he left Desiree's household or when he left ours
to go visit Desiree. He has been unhappy several times when he has had
to leave our house to go visit Desiree, nothing Desiree or I would deem
out of the ordinary.
Q: While you have said your marriage
suffered after Kiara's birth and Terri's post-partum depression, was
there any talk of separating or divorce before Kyron disappeared?
A:
Yes there was but we worked through them in a positive manner (at least
that was my impression.)
Q: Can you describe how Terri
Horman handled the polygraph requests? I believe you have said to others
that Terri walked out of a second polygraph, and then waited about 10
days before taking a third? Can you clarify this for us?
A:
She fully cooperated and took the first polygraph then subsequently
vented her failed results to all family, friends, and law enforcement at
the house. A few days later she cooperated and went to take a second
polygraph test but got up and walked out before the machine portion of
the test could be administered... again by her own statement to family,
friends, and law enforcement at the house ...She continually pushed back
and refused to repeat the second test for several days (approx. 8-10)
before going to take the test and then once again coming back to the
house and venting to all listeners.
Q: Kaine, when are you
planning to return to work?
A: The investigation is still
our top priority, we drop anything, anytime, anywhere to do what is
needed. In between those moments Desiree, Tony, and I have all been
trying to get back to work to some degree. We will need to continue to
be able to provide a home for Kyron when he returns so working even part
time will be essential...Because of both cases (criminal and divorce)
and becoming a single parent I have not had much time to work but I have
been getting some hours in each week for the past few weeks working
remotely.
Q: How is Kiara doing? What have you told Kiara
about why she can't see her mom? Have Terri's parents seen Kiara or will
they be able to and if so under what circumstances?
A:
Kiara is doing as well as can be expected given the circumstance. Kiara
and I have not discussed any of this yet, she can't quite talk just yet
and would not be able to understand verbally what is happening yet. I am
providing her with as much love, routine, and support that I possibly
can.
Q:Kaine, how is the rest of your family handling the
situation?
A: Not going to comment on behalf of others and
how they feel.
Q: What is your reaction to Terri's attorney's
characterization of the "witchhunt" aimed at his client?
A:
I think Terri's past (since Kyron went missing) and continued actions
are fanning the flames. All we have asked for is the truth. Until she
comes forward with that truth and Kyron is found then I doubt that
things will turn down in intensity.
Q: You have said in the
past that you believe someone else may have been involved , aside from
Terri, in Kyron's disappearance? What leads you to believe this and do
you still hold those feelings?
A: I can't comment as to all
of the reasons why based on the investigation but based upon briefings I
firmly believe that someone else is involved.
Q: Do you
expect to open your home, once you're back in it, for a more thorough
search of it by law enforcement? Do you know if they've combed through
the house carefully, with a dog?
A: We have fully cooperated
with law enforcement since Day One in any and all searches of the house
they have requested. They have done several thorough searches and I
will continue to provide them full access to the house as they need it.

I am
