Multnomah County sheriff, DA to ask for about $438,000 to support Kyron Horman inquiry

Multnomah County Sheriff Dan Staton and Multnomah County District Attorney Michael Schrunk will ask the county this week for an additional $438,643 as a criminal inquiry into the case of missing 7-year-old Kyron Horman proceeds.

The proposal will go before the county board of commissioners on Thursday.

The sheriff's office is requesting $242,609 to support the salary of a one-year investigative technician and for four months of overtime, from July through October.

In its request, the sheriff's office says it has generated more than 3,000 leads that have filled 38 four-inch binders, and subpoenaed 200 sets of records, each record generating from 10 to hundreds of pages of paper.

Phone, e-mail, computer, financial and school records would likely be among the material subpoenaed, criminal justice experts say.

A lead investigator, two detectives and an investigative technician are assigned to examine all these records. The sheriff's office is seeking overtime money for these four positions for four months.

If the case concludes during this time, then the investigative technician's position would end, the sheriff's office said.

PORTLAND, Ore. - Six weeks have now gone by since Kyron

Horman mysteriously disappeared from outside Skyline School and his
parents want to thank all those who have been sending positive thoughts
their way.

Kaine Horman and Desiree Young sent the following statement through
their media liaison:

"Kaine and Desiree's main priority remains keeping their energy and
available time focused on assisting investigators in the search for
Kyron. Kaine and Kiara have returned home (and) are getting settled back
into the house. Kaine is spending time getting the house ready so that
Kyron has a comfortable and safe home to return to. The family sends
their deepest gratitude for your support and thanks everyone who is
keeping an eye out for Kyron."

Meanwhile, at the 'Wall of Hope' at Skyline School, Kyron's supporters
continue to leave words of encouragement for the family and messages for
Kyron.

"He's out there and it's just one day closer to him coming home," one
visitor to the wall told KATU News.
Over the weekend, Kyron's stepmother, Terri
Horman, moved out of the family's home and is now taking refuge
with her parents in her hometown of Roseburg. After Terri left, Kaine
moved back into the home with the couple's 20-month-old daughter and had
the locks changed

As part of our coverage
of the Kyron Horman case, we went to Roseburg last
month to talk to Ron Tarver, ex-husband of Terri Moulton Horman
and the father of her oldest child, 16-year-old James.
Tarver revealed
then to WW the answers to questions many observers had been
asking—when and why James had moved away from the Portland home he
shared until recently with the Hormans.
Tarver said Terri Horman had sent James to live in the southern
Oregon town of Roseburg last March because the boy’s grades at Lincoln
High School in Portland were dropping and he was acting out at home,
including butting heads with his stepfather, Kaine Horman.
Tarver said James was living nearby with Terri Horman’s parents but
frequently visited Tarver’s home.
With the latest
news that Terri Horman relocated over the weekend to her parents’
home in Roseburg, we wondered whether James is still living in that same
house. A judge has placed a restraining order on Terri Horman telling
her to stay away from Kaine Horman and their 19-month-old daughter,
Kiara.
Reached by phone today, Tarver tells WW James moved out of
Terri Horman’s parents’ house and into the Tarver house sometime in the
past month. Tarver declined to elaborate on when the move happened or
why, but he said it was before Terri Horman moved to Roseburg over the
weekend.
“This was all before that,” Tarver says. “He’s been with us for quite

i am wondering what the "probable cause" was on the RO - what evidence would LE have that is enough for probable cause but not enough for an arrest? any ideas?

Good question Ovie. This is the legal definition of probable cause.
PROBABLE CAUSE
A reasonable belief that a person has committed a crime. The test the
court of appeals employs to determine whether probable cause existed for
purposes of arrest is whether facts and circumstances within the
officer's knowledge are sufficient to warrant a prudent person to
believe a suspect has committed, is committing, or is about to commit a
crime. U.S. v. Puerta, 982 F.2d 1297, 1300 (9th Cir. 1992). In terms
of seizure of items, probable cause merely requires that the facts
available to the officer warrants a "man of reasonable caution" to
conclude that certain items may be contraband or stolen property or
useful as evidence of a crime. U.S. v. Dunn, 946 F.2d 615, 619 (9th
Cir. 1991), cert. Denied, 112 S. Ct. 401 (1992).

It is undisputed that the Fourth Amendment, applicable to the states
through the Fourteenth Amendment, prohibits an officer from making an
arrest without probable cause. McKenzie v. Lamb, 738 F.2d 1005, 1007
(9th Cir. 1984). Probable cause exists when "the facts and circumstances
within the arresting officer's knowledge are sufficient to warrant a
prudent person to believe that a suspect has committed, is committing,
or is about to commit a crime." United States v. Hoyos, 892 F.2d 1387,
1392 (9th Cir. 1989), cert. denied, 489 U.S. 825 (1990) (citing United
States v. Greene, 783 F.2d 1364, 1367 (9th Cir. 1986), cert. denied, 476
U.S. 1185 (1986)).

When there are grounds for suspicion that a person has committed a crime
or misdemeanor, and public justice and the good of the community
require that the matter should be examined, there is said to be a
probable cause for, making a charge against the accused, however
malicious the intention of the accuser may have been. And probable cause
will be presumed till the contrary appears.

In an action, then, for a malicious prosecution, the plaintiff is bound
to show total absence of probable cause, whether the original
proceedings were civil or criminal.

Do they KNOW Kyron is dead? Have they found his body? If the answer is NO, then I want to know why their playing a fricking cat/mouse game with this psychotic beotch?? This makes me so sick, just drag the psycho into a cell, lock it and throw away the key then, get off your dead ass and find Kyron.

kiwi, thanks for the informative post.

now i wonder what LE had to support the suspicion she is involved in kyron's disappearance? what could it be:
cell phone records, texts, etc.
receipts of what she did june 3, june 4
emails she may have sent or rec'd on the computer(s) in the house
witnesses who saw her june 3 and june 4

and do they know that the pic of kyron with the project was NOT taken that morning (because the man/child shown in the back of the photo said they weren't there on friday?)

wish we knew something...

PORTLAND, Ore. -- The Multnomah County Sheriff's Office received some unsolicited help from a former military investigator this week in the case of missing 7-year-old Kyron Horman.

Edward Dames, a retired remote viewer who once worked with the Army, worked with his team for three weeks to try to determine the physical location of the missing boy, who has not been since June 4 at Skyline School in northwest Portland.

Dames said the missing boy is located on private property roughly 10 miles south of the school.

"He's not where police are searching," he said. "(He's) not in the water and not that far away.

"A remote viewer is a specialized psychic once used by the CIA and U.S. military during the cold war. Dames was the inspiration for the movie "The Men Who Stare At Goats."

He said he uses a mental technique to locate a missing person's geographic location and then goes out into the field to find the target. However, Dames said he's unable to do so in this case because he said the boy is on private property, which can present unknown dangers for his team.

Dames' report was sent to the Multnomah County Sheriff's Office, which is the lead agency in the criminal investigation.

Multnomah County deputies confirmed they received the report, which Dames said pinpoints Kyron's location within 60 feet. A spokeswoman with the sheriff's office said an investigator is examining leads from the report and following up on anything it generates.

Dames said he often works on missing or exploited children cases when he has downtime between contracts. He said he has been involved "both quietly and not so quietly" with many cases over the years, but he "doesn't usually work with law enforcement agencies."

"It's totally a public service. I'm a parent," Dames said. "The idea that a child is missing and no closure to that hell would be hell on earth as a parent."

PORTLAND – The father of missing seven-year-old Kyron Horman attended three hours of meetings at the Multnomah County Sheriff’s Office Tuesday.

KGW’s live truck was parked outside the sheriff’s office as Kaine Horman entered the building around 6 p.m. and left around 9 p.m.

However, Kaine told KGW on the way out that he did not wish to comment on the three hours of meetings he had just attended.

Lt. Mary Lindstrand, a spokeswoman with the sheriff’s office, also told KGW she would not comment on why Kaine was there Tuesday.

Late Wednesday morning, Sheriff Daniel Staton released a statement to the media promising he was working to complete a thorough investigation, even if he could not elaborate on all the details.

“There are many decision points which are discussed and filtered among investigators, deputy district attorneys, command staff and other experts.

Our detectives and searchers are continuing to follow up on many leads to include establishing and verifying information relating to Kyron's activities prior to his disappearance,” he said in the statement.

Staton told KGW he would accept written questions from reporters and then a written statement would be released no later than Friday in responset o the questions submitted.

Sheriff Daniel Staton and Multnomah County Sheriff's Office understands that the community and media have many questions regarding the Kyron Horman investigation. We can ensure you that our primary goal is to complete a thorough investigation. As stated in prior press releases, there are many decision points which are discussed and filtered among investigators, deputy district attorneys, command staff and other experts. Our detectives and searchers are continuing to follow-up on many leads to include establishing and verifying information relating to Kyron's activities prior to his disappearance.

Multnomah County Sheriff's Office would like to provide the media the opportunity to submit questions they would like answered regarding Kyron Horman case. Please understand and remember this is an ongoing criminal investigation. There will be some questions that cannot be answered based on this fact.

Submit your questions to Kyron.case.questions@mcso.us. This email address will be accepting questions up to 2pm today, July 21, 2010.

A written statement will be released no later than Friday July 23, 2010 based on the questions submitted.

The Multnomah County Sheriff's Office would also like to announce that a press conference is scheduled for Tuesday July 27, 2010 at the Hanson Building located at 12240 NE Glisan Portland, Oregon. The exact time for this press conference will be announced by Friday July 23, 2010.

Present at this conference will be Chief Deputy Tim Moore and Lead Investigator of the Kyron case Sgt. Lee Gosson. The purpose of this press conference will be to provide an update of the case and respond to questions that were submitted regarding the case.

Okay Folks, Hot off the press and I was wondering about this question from the very beginning of Kyron missing. The news is coming out in bits and pieces and there is valid reasoning for this---FINDING KYRON!

PORTLAND, Ore. - There was no expectation on the part of Skyline School that Kyron Horman would be in class after the science fair the day he disappeared, according to multiple sources.

Prior to his June 4 disappearance, Kyron Horman’s stepmother, Terri Horman, informed his teacher he had a doctor’s appointment on Friday, the sources said, and it was why there was no expectation Kyron would be in class after the science fair. Once class began at 10 a.m., his teacher marked him absent.

“And the teacher said, ‘I thought he left with his mom,’ because they thought they had a doctor appointment,” Holm said. “And then at lunchtime, Kurtis ate lunch with him every day, he wasn’t there at lunchtime. And then I got a call at 4:30ish, saying he didn’t get off the bus, I guess. And Kurtis said, ‘Oh yeah, I knew he was already gone all day Mom.’”

KYRON HORMAN - 7 yo (2010) - Portland OR - Thread #2 126283 I'm really befuddled about this case. Kaine says there are a lot more opportunities to get Kyron's face out and recognized by people but, they aren't giving out any info, just doesn't make any sense to me.
What is the reasoning behind him saying "get his face out & recognized by people, especially outside the state"?

i think kh really thinks he was kidnapped and th is involved and knows information that might lead them to him and whoever took him. i cannot think of any reason that he would be insisting that kyron will be coming home.

Kyron look-a-like causes confusion with Portland man traveling in Texas

It's not just people in Portland or Oregon looking for Kyron - tips come in from around the country.

A local Portland man was recently traveling through Texas with his grandson and says he was stopped because the 11-year-old looks like Kyron.

Richard Blashill was traveling from Amarillo to El Paso on Monday with his 11-year-old grandson and daughter-in-law.

Blashill says he stopped at a convenience store for a few minutes and remembers there was a lady who wouldn't stop staring at him.

He couldn't figure out why, so they continued on.

The next thing he knows, police are pulling him over, asking him questions about Kyron Horman.

"They showed him (his grandson) a picture of Kyron and asked is that you? And he said 'no, that's not me' and they said why do you say that, and he pointed out two or three things, the widows peak on his head and the color of his eyes."

Blashill says the three of them were interrogated for close to two hours.

Ann Rule Called the Hormans Within Two Weeks of Kyron’s Disappearance

Law-enforcement sources have compared the Kyron Horman case to that of Diane Downs, the Oregon woman who shot her three children in 1983.

Ann Rule, the true-crime author who wrote the book on the Downs case, has already weighed in on Kyron’s disappearance.

And Oregonian columnist Anna Griffin wagers Rule is angling to write a book on the Kyron case as well.

Turns out Griffin is right. And Rule wasted no time in singling out the case for attention.

Kyron’s mom, Desiree Young, confirms to WW that Rule called the family just two weeks after Kyron’s June 4 disappearance. That was around the exact time we broke the story that investigators were focusing on Kyron’s stepmom, Terri Moulton Horman.

Young says the family spoke with Rule about the case during one phone conversation. Rule hasn’t called back since, Young says. On Tuesday, a judge set a hearing for July 22 over the restraining order.
Attorney Stephen Houze said Terri agreed to move out, give up rights to
custody, but the hearing will address financial and other issues. A
date of September 21 was set aside for the contempt of court hearing.
