A York County judge rejected a no contest
plea in a child abuse case this morning, telling the prosecution and
defense he was not provided with enough compelling evidence to reach a
decision.Brandon Scott Krichten was charged with aggravated assault, simple
assault, reckless endangerment and endangering the welfare of a child
after doctors examined 3-week old Jordan Krichten on March 28, 2009, and
determined his broken collar bone and broken legs were the result of
physical abuse, according to court records.Krichten, 28, of Dover, appeared in Common Pleas Court before Judge
Gregory M. Snyder today. In a negotiated agreement, Krichten attempted
to enter a no contest plea to endangering the welfare of a child in
exchange for a sentence of three years probation. The assault charges
were to be withdrawn in the agreement.Senior prosecutor Jennifer Russell told Snyder that Krichten was
pleading no contest because he had suffered a diabetic blackout when
Jordan was in his sole custody and the injuries occurred.Doctors at Hershey Medical Center, where the child, now 1, was treated,
determined the injuries were the result of "rough handling," Russell
said.Since then, Krichten had cooperated with the police investigation,
complied with all Children and Youth requirements and only has
supervised contact with Jordan, Russell said.First assistant public defender Clasina Mahoney told Snyder the child
also has evidence of a genetic disorder that may have contributed to the seriousness of the injuries and that
Jordan has recovered from his injuries.No expert medical evidence was provided to the judge."It's not just a matter now that the child is OK," Snyder said. "I'm not
satisfied it's the appropriate resolution. I don't know enough about
these things to know if it is appropriate at this time."Snyder returned the no contest plea document to Krichten and scheduled
the case for the July criminal court term.
