Landscaper Terri allegedly tried to hire to kill Kaine appears before grand jury

The landscaper in the alleged murder-for-hire plot involving Terri Horman testified before the grand jury, sources told KOIN Local 6.
In a story first reported by The Oregonian, Terri Horman allegedly tried to hire a landscaper to kill Kaine Horman six to seven months before Kyron Horman disappeared.
KL6 has confirmed investigators used an undercover agent on June 26 in an effort to get Terri to open up about the alleged plot. When the agent and the landscaper arrived at the Horman residence on Northwest Sheltered Nook Road that evening, Terri called 911 to report trespassers on the property, foiling the sting.
Law enforcement has not commented about the sting or whether it resulted in any evidence useful in their investigation.
According to retired Portland Police Capt. C.W. Jensen, the grand jury is looking at this because it paints them a picture of Terri's character.
"What you are doing in a grand jury - in an investigative grand jury - is you are painting a picture of everyone and you want to have all four corners of the page and so that’s what you’re doing here," Jensen said.
Jensen said this alleged plot plays a big role because this is the most significant thing that happened before Kyron's disappearance.
After Kaine became aware of the alleged plot, he hired a divorce lawyer, moved out and took the couple's daughter, Kiara, with him.
In other news: Investigators seek more information about the Horman's white truck and Terri's whereabouts in the hours surrounding Kyron's disappearance.

PORTLAND, Ore. - A groundskeeper who works at Skyline School says he
never saw the Hormans' white pickup truck parked on a nearby access road
on the morning Kyron Horman disappeared.
Dave Stensen, a turf technician with the city of Portland, said he was not only at the school
on the morning of June 4, but also had to drive his truck up on that
gravel road to access the soccer field he was mowing.
On Wednesday investigators sought tips from anyone who may have seen the
white Ford F250 pickup truck Terri Horman was driving that morning.
They're most interested in any sighting between 8:15 a.m. and 8:45 a.m.
Sheriff's spokesman Capt. Jason Gates said investigators are looking for
"independent witnesses with independent recollections" in tracing the
whereabouts of the pickup.
Stensen said he used the access road to get his truck and mowing equipment up to the soccer field like he
always does. He said he cut the grass on the soccer field between
7:45 a.m. and 8:30 a.m. the morning of June 4 and never saw the
Hormans' truck on the road.
Based on the investigators' timeline,the window for the white truck to be on the access road narrows to the
15 minutes between 8:30 a.m. and 8:45 a.m.
If it had been there or nearby with anyone in it or around it, Stensen said he's sure he
would have noticed it.
"It would be impossible for me to either enter the field or exit the field if there was a car parked on the
gravel road itself," he said. "And then while exiting the roadway, if
there was somebody parked that close to that hillside, it would have
made it difficult for me to see who's coming down the hill (on Skyline
Boulevard). I mean, it would seem to me like I would have remembered,
'Oh, gee, yeah, there was a big white truck in my way when I left that
day.' I would say I'm certain that it wasn't there."
Stensen said he clearly remembers the morning, which didn't seem particularly
chaotic even with the science fair taking place.
"It seemed like just a pretty normal day," he said. "It was kind of damp and wet. It had
been wet for a while, and the fields were hard to mow. (I) noticed that
there was some children that came out the back door, and I thought,
'Please, don't come down and play soccer.' But they came out and looked
at some plants that were in the raised bed."
Stensen's own truck,which has a trailer on the back, would have been parked near the spot
on the access road, at least briefly as he came and went that morning.
He would've spotted it on his way in as he got out his truck to unlock the
padlock on the chain that allows him access to the field. He would've
spotted it his way out as he rounded the truck to put the chain back in
place.
Investigators are talking to Stensen and checking his information against what they've gathered. They said they find him
credible.
There was no activity Thursday from the grand jury hearing testimony in Kyron Horman's disappearance.

According to the family, some parents have expressed concerns about the
memorial being up when the school year starts, especially its emotional
impact on students.
Kyron’s memory and the need to remind people that he is still missing is
important, according to the family, but so is the need to do everything
possible to make the start of school as normal as possible for the students going there.
There is also a concern that an ongoing presence of strangers
coming to the wall might also fuel safety fears in students.
The wall has served as a backdrop for national media reporting on the
case. Letter left at the wall have been picked up by Kaine Horman and
taken home to Kyron's bedroom.
Visitors Saturday who learned of the news understood, but struggled with their emotions.
For Myrna and George Erhardt, the Wall serves as reminder to keep
their grandchildren close. Toni Renkin has a child about Kyron's age and
plans to visit the wall no matter where it moves. Stephen Ross said he
just wished he could have had a chance to meet Kyron and get to know him better.

It seems that the Administration of Skyline Elementary School is getting a passing grade, or should I say a pass, regarding the disappearance of Kyron Horman – the child who mysteriously disappeared under what was reportedly the school’s watch. I’m not prepared to discuss who did what and when. I would just like to focus on one particular aspect – the lack of appropriate security at the school to include closed circuit television cameras that would have monitored who entered and who exited the facility, and when.
As I recall, early on in the Horman investigation, the principal at Skyline stated that the cost factor was the reason the school didn’t have CCTV coverage. Of course, his facility was not unique in that respect. It seems that CCTV coverage of Portland schools has never been seriously considered. Not having that capability, or any other ingress and egress security controls in place, it would seem that Skyline’s principal (Ben Keefer) would have directed his staff and teachers to be particularly attentive to the comings and goings of students – as well as any peculiar circumstances regarding visitors. As a reminder, the day Kyron disappeared the school was holding a ‘science fair’ of which Kyron was a proud participant. There were, resultingly, many visitors to the school.
So why don’t Portland public schools, in this day an age, have in place a rather inexpensive camera system for monitoring the exits? Is it because of the cost? I don’t think so. One need only look around at mini-marts, gas stations, theaters, retail establishments, parking lots and many residences, to conclude that the cost for security cameras can’t be that much.
So what is the reason?

two areas investigators asked about during a Wednesday news conference.
Those two places were on an access road to the soccer field and
investigators say they want to talk to anyone who may have seen the

Stensen told a reporter earlier in the week that he cut the grass on the

Investigators say they are still hoping to speak with anyone who was at
the school the morning of June 4 and saw the truck that Kyron’s
stepmother, Terri Horman, was driving and anyone who was in it or around
it.
Investigators are still trying to identify that person in the Hormans’
truck and say that could be key information into Kyron’s disappearance.

Kaine Horman's lawyer has filed court papers objecting to his estranged wife's request to delay divorce proceedings, saying it would be detrimental to the welfare of the involved children and violate his due process right to the swift administration of justice.
Further, Kaine Horman's lawyer, Laura Rackner, said Terri Moulton Horman's request to delay the divorce while the criminal investigation into stepson Kyron's disappearance proceeds could occur "indefinitely."
"There is no guarantee when the criminal aspects of this case will be resolved (i.e in one , two, five or even ten years) or how long media interest will continue,'' Rackner wrote, in an Aug. 11 court filing. "Wife has not demonstrated why her personal interests should outweigh the best interests of the children.''
Rackner continued to urge the court to have Terri Horman identify the source of the money she's using to pay criminal defense lawyer Stephen Houze. Although Terri Horman's lawyer described in court papers the reported $350,000 Rackner cited in an earlier legal filing as "grossly overstated,'' Rackner in response has submitted a copy of a June 30 e-mail exchange between Terri Horman and Michael Cook in which Terri Horman reportedly cited that figure to Cook.
"Hey on a side note, the news channels all just announced you've got Stephen Houze! That's awesome (it's in the news so I figured I can text it),'' Cook reportedly texted to Terri Horman at 11:20 p.m., according to Rackner's Exhibit A filed in court.
"Yep, guess how much he costs?" Terri wrote back.
"Zillions?" Cook asked.
"350K," Terri Horman replied later.
Most of their text messages, presumably obtained from investigators, were redacted in Exhibit A filed in court.
Terri Moulton Horman's lawyer had argued that it would be impossible to proceed with divorce-related issues considering the ongoing criminal investigation into the disappearance of Kaine Horman's son, 7-year-old Kyron, and the "intense scrutiny and speculation" into his client. Terri Horman's attorney, Peter Bunch, said the resolution of custody and parenting time would require an evaluation of each parent by a psychologist.
"The evaluator must be independent, and the evaluation process must be free of outside influence, such as media attention and the scrutiny assocated with this case,'' Bunch wrote in a filing at the end of July. "Because of the current investigation, and actions taken by the police, it is evident that the evaluator, and his or her work product, could become part of the investigation, which would completely disrupt the evaluation process.''
On June 28, Kaine Horman filed for divorce and a restraining order against his wife, two days after authorities told him that a landscaper had said Terri Horman approached him in late 2009 and offered to pay him to kill her husband. Kaine Horman left the house with their young daughter, Kiara. He has since returned, forcing Terri Horman out of their home on Northwest Sheltered Nook Road.
No arrests have been made in the disappearance of Kyron, last seen at his Skyline School science fair on June 4.
An Aug. 25 hearing is scheduled in Multnomah County Circuit Court on the pending divorce and restraining order matters.

"I thought he'd be home. I'm gonna go school supply shopping this week, make sure he's ready for school... just continuing to hope and pray every day that he's coming home," Kaine told KGW in an exclusive interview Monday morning. "I have a phone with me 24/7 - when I sleep, everywhere I go, just waiting for that call so we can go pick him up and move on."
Kaine collected gifts and well-wishes at the Wall of Hope created outside Kyron’s school Monday. He continues to be touched by all the strangers reaching out to support Kyron and his family.
Kaine said he supports plans to move the Wall of Hope to another location before school starts in September, although he doesn't yet know where it will be moved to.
“I think our primary concern is safety. Obviously we’re in a situation where a child has gone missing from school and the last thing we want to do is have a bunch of strange adults up on school grounds during the school day,” Kaine said. “Obviously they’re coming to pay their respects to Kyron and pray for him but at the same time, it puts a lot of additional people on school grounds that aren’t normally here, so there’s a lot of concern for the safety of everybody first.”

PORTLAND –DeDe Spicher told PEOPLE magazine that she has nothing to hide and neither does Kyron Horman’s step-mother, Terri Moulton Horman.
She made the statement in an interview with PEOPLE that appeared in the latest issue of the magazine on newsstands and also online.
Police recently circulated a new flier in the investigation into the disappearance of seven-year-old Kyron Horman which prominently featured both DeDe and Terri. The flier showed photos of the women and asked if anyone could share tips on either of their whereabouts on June 4, the day Kyron vanished.

Asked by PEOPLE in an exclusive new interview whether she thinks Terri was involved in Kyron's disappearance, DeDe Spicher, 43, said, "I just really don't. In my heart, I really don't. In all of these years [as her friend], I have not seen anything that would lead me to believe that she is capable or motivated in any way to do something like this."
DeDe and Terri were both unaccounted for during the same period of time the day Kyron disappeared, based on information revealed by investigators and on information from KGW sources.

The sources told KGW that DeDe was doing gardening work not far from the Horman family home on June 4, but was unaccounted for during a three-hour period from 10 a.m. to 1 p.m. She could not be reached by cell phone during this time either, according to sources.
Asked about her own whereabouts on that day, DeDe told PEOPLE that she was at a 38-acre nursery preparing for a garden tour the following day. "I never left the property that day," she said.

Spicher says the police "wanted me to tell them Terri did it."
"They wanted me to tell them that Terri did it or that Terri knew something," she told People magazine in an exclusive interview. "I told them everything that I knew, over and over again. But I didn't tell them what they wanted to hear."
Spicher, speaking for the first time since she was named as a possible accomplice by Kyron's parents, also told the magazine that she does not believe Terri Horman, the boy's stepmother, had anything to do with the second-grader's June 4 disappearance.
"I just really don't. In my heart, I really don't," Spicher, who has not been named a suspect in the case, told People. "In all of these years [as her friend], I have not seen anything that would lead me to believe that she is capable or motivated in any way to do something like this."
Terri Horman had been questioned repeatedly by police and publicly accused by her estranged husband, Kyron's father, and the boy's biological mother. She had not been charged in the case or in an investigation into allegations that she attempted to hire a landscaper to kill her husband, Kaine Horman, before Kyron vanished.
Terri Horman's lawyer said little but has denied his client was invovled in Kyron's disapperance and called the public speculation a "witch hunt."
But police continue to increase pressure on both Terri Horman and Spicher. They released a flier last week asking residents if they had seen the two women together the day Kyron disappeared. Spicher has also been called to testify before a grand jury.
Spicher told People that she was at a large nursery preparing for a garden tour on June 4 and never left the property, a direct contradiction to witnesses who have told police that she left work that morning and was unaccounted for, for more than an hour and a half.
"The irony here of course is that no one is able to corroborate her story," Bruce McCain, a retired captain with the Multnomah County Sheriff's Office, told "Good Morning America."
"She said she's fully cooperating, but there's mixed signals here," McCain said, noting that Spicher has retained a lawyer who has been negotiating with prosecutors ahead of her grand jury testimony.
"She the only witness that we know of that's lawyered up," he said. "For someone that's got nothing to hide and is fully cooperative, that's a strange way to show it."
After news of the disapperance broke and Kaine Horman left their home with the couple's young daughter, Spicher said she moved in with Terri Horman for 11 days.
"There's this horror that my friend is going through," she said. "If I thought for a second that she was capable of [foul play], I would not have been there. She would not have been my friend in the first place."

Online, Terri Horman recently wrote that "they are blaming me in the blogs. I just want to scream."
Court documents released in June added to the growing list of odd behavior coming from Terri Horman. Her husband claimed in a filing in which he attempted to have his wife held in contempt for violating the emergency restraining order granted June 28 that she tried to "abduct" her 20-month-old daughter from a gym day care after the emergency restraining order was granted.
And while the rest of the family was consumed by the search for Kyron, Terri Horman was allegedly carrying on an affair with 37-year-old Michael Cook, a former classmate of Kaine Horman's, according to the documents. The affair purportedly began four days after Kaine Horman moved out and investigators, according to the court papers, said they've "obtained hundreds of text messages, as well as several photographs of respondent [Terri] in various stages of undress and graphic sexual activity."
The court documents accused Terri Horman of sharing sensitive information with her new boyfriend about the police investigation into Kyron's disappearance.
The new allegations came hours after Terri Horman's attorney sent a letter to the judge stating that she would not contest the restraining order that would keep her away from her daughter, or her husband's request to move out of the family's Portland home.
Cook told a local television station that he was planning to hire an attorney, but while there was "inappropriate communication" with Terri Horman, he never had sex with her.

An ex-boyfriend of DeDe Spicher said he was stunned when he learned that investigators were interested in the whereabouts of Spicher on the day Kyron Horman, 7, disappeared from Skyline School.
Jason Wishert, who has volunteered as a child's advocate in Multnomah County for more than a decade, said he dated Spicher for about 10 months, and they had even talked of marriage, but their relationship fell apart in early August 2009.
Wishert, 41, said he called the Multnomah County Sheriff's Office tip line soon after hearing Spicher's name in the news.
"My mouth was agape. I couldn't believe what I was seeing," Wishert recalled. "I thought, 'Oh my gosh, there's two things that investigators should look at.' "
He provided investigators with the name of a close confidante of Spicher, and an address in the 12700 block of Northwest Bishop Road in Washington County where Spicher had lived with an aunt after she moved to Portland from Klamath Falls. The Bishop Road address was one of the addresses investigators searched.
Investigators looking into the disappearance of Kyron Horman have searched Spicher's Tualatin condo, the garden property where she was working June 4, and her aunt's address as they seek to determine Spicher's movements the day Kyron disappeared. Kyron was last seen at Skyline School the morning of June 4.
Spicher, 43, is a friend of Terri Moulton Horman, Kyron's stepmother. Spicher told People magazine in this week's edition that she never left the Northwest Old Germantown Road property where she was working on June 4. She also said she spent 11 days living with Terri Horman at the Horman's Northwest Sheltered Nook Road home to support her friend shortly after Kaine Horman filed for divorce and a restraining order on June 28.
Law enforcement also circulated a questionnaire to residents of Northwest Old Germantown Road on August 7 and 8 with photos of Horman and Spicher, asking if they'd seen either woman between 9:45 a.m. and 1 p.m. on June 4.
Wishert said he met Spicher in the fall of 2008 when they were classmates in a chemistry class at Portland Community College's Rock Creek campus and soon became study partners. He described her as a "high-energy, dynamic" person who had just completed the Portland Marathon, and a Centurion cycling event.
"I was attracted to her intelligence, high amount of energy and straight forward, matter-of-fact attitude," he said.
She was committed to exercise and a special diet, preparing her meals, mostly cooked vegetables, ahead of time in Tupperware containers.
He said Spicher's personality changed when she lost a receptionist job at QuadRep Northwest in January 2009. She lived on unemployment, stopped working out, and gave up her diet, he said.
Spicher most recently had obtained a gardening internship. Wishert also said Spicher on the side started her own house-sitting and pet-sitting service.
Wishert said he doesn't know Terri Horman. He described Spicher as having a "good constitution" and intelligent but "emotionally gullible."
Wishert wrote an account of his relationship with Spicher, which he sent to The Oregonian.

Am I getting this right?!@! Wishert dated DD 10 months, 2008-8/2009. TH has known DD 7 years, best friends and Wishert did not know TH? And Wishert and DD were so close they even spoke of marriage? An ex-boyfriend of DeDe Spicher said he was stunned when he learned that investigators were interested in the whereabouts of Spicher on the day Kyron Horman, 7, disappeared from Skyline School.
Jason Wishert, who has volunteered as a child's advocate in Multnomah County for more than a decade, said he dated Spicher for about 10 months, and they had even talked of marriage, but their relationship fell apart in early August 2009.
Wishert, 41, said he called the Multnomah County Sheriff's Office tip line soon after hearing Spicher's name in the news.
"My mouth was agape. I couldn't believe what I was seeing," Wishert recalled. "I thought, 'Oh my gosh, there's two things that investigators should look at.' "
He provided investigators with the name of a close confidante of Spicher, and an address in the 12700 block of Northwest Bishop Road in Washington County where Spicher had lived with an aunt after she moved to Portland from Klamath Falls. The Bishop Road address was one of the addresses investigators searched.

Statement Analysis
DeDe Spicher's statements are in italics, with analysis and commentary in bold type.
"We were very worried for her life. There were death threats against her. And again, whoever has taken Kyron is still out there and could be after her, too," Spicher, 43, tells PEOPLE in an exclusive new interview.
Note "we" being plural; weakening commitment to the statement. This may indicate that fear for Terri's life may not have been the reason why Spicher went to stay with Terri. Note the death threats were against "her"; Terri, and not DeDe Spicher.
"and again" sensitive repetition regarding the person who took Kyron is noted. This person (gender free)"could" be after Terri, "too" (in addition to DeDe?. This may indicate where DeDe is going with regard to her concerns about safety: is it that she is just concerned about Terri's life since Terri had "death threats" against her? Or, is this about something else; drama, perhaps?
A longtime friend of Terri's, Spicher stayed with her for 11 days beginning June 28, shortly after Terri's wife Kaine left her.
"When Terri's parents had to leave to go back home, they asked if I would stay with her to help keep her safe," she says. "And I said of course I would."
DeDe says that she went there on the request from Terri's parents so that she could "keep" Terri "safe". Note "of course" is sensitive, within itself; meaning that emotion is tied to it and that the reader should accept what is being said. She stayed for 11 days. It would be interesting to know if her departure correlated with the time frame where Terri was "sexting" Kaine's high school friend.
She continues: "I dropped everything I was doing, and I went to see what my friend needed. And that's when I learned she had been served with the divorce papers, there was a restraining order and a story about a murder-for-hire or something. So, it was clear that she was very distraught."
"I dropped everything" disturbs me that DeDe would employ these words. It indicates being busy with something, dropping what was in her hands, and rushing to her side.
Isn't this exactly what police have speculated that DeDe did on June 4, 2010, while gardening?

She already knew what her friend needed: to be kept safe. She told us that this is what the parents had requested. DeDe Spicher's choice of words is disturbing and sounds more fitting to June 4, 2010, then to the situation, which would have been well known by the time Kaine moved out, her family stayed with her, and then they moved out.
DeDe Spicher, unawares, may be presenting what she did, and what her thinking was on June 4.
DeDe Spicher said that she "never" left the property that day. In Statement Analysis, we do not accept "never" as a substitute for the word "no", but we do not know how the People magazine reporter framed the question.
Spicher describes being in "crisis mode" with Terri during that time at her home outside Portland, Ore. They tried to avoid the media circus during the day – with no cable TV, they looked at articles online, but learned to avoid the reader comments – and guarded against any potential intruders at night.
Horman slept upstairs, while Spicher stayed downstairs, closest to the door. "I was trying to find a way to protect us if someone should come in, and the only thing I could think of was my fire extinguisher in my car," she says. "So, I slept with my fire extinguisher next to the bed."
This is strange. Spicher wants it known that they "slept" in separate bedrooms on different floors. She said she was "trying to find a way to protect" but her protection wasn't related to Terri (death threats) but "us". We see now that DeDe considered herself part of the drama. The only thing she could think of was "my" fire extinguisher.
I find this strange.
Because she says "my" fire extinguisher, does it mean that she brought it from home over to Terri's house? If not, it has a deceptive feel to it, for possessive pronouns are ingrained in us since childhood. We take possession of what is ours and not what is not ours. If she brought it from home, it is odd, but the pronoun "my" fits. If she did not bring it from home, (nor paid for it new from a store), we may consider this to be deceptive on her part.
Notice this was done in case "someone" came in, rather than the kidnapper or the "person" who took Kyron.
In most all cases of unknown kidnapping, the potential perp is said to be male. He is "the bad guy", or the "bad man", or "he might try to kill me". The fact that this is gender neutral is an another indication (see previous analysis) that Spicher knows who took Kyron. When an assailant is unknown, most times the male pronoun is indicated.
The pair also assumed they were under surveillance. "Any conversations that we wanted to have, we'd go out into the yard," Spicher says. "When we were in the house, we'd talk about the kids, we'd talk about her marriage, talked about her family."
Here we come upon described behavior that points to guilt.
If you were the innocent step mother of a missing child, would you care if your conversations were recorded? In fact, as a parent, you would likely insist that police record every call to and from the home in order to pick up any information that may prove helpful.
Note: we discussed previously that "and that's all I know" is a deceptive statement. Honest people continue to search their memory, self correct, and continue to report anything they remember about an important issue. This is why calls are recorded for the innocent as well as for the guilty; this is why someone "racks their brains" trying to remember, even taking notes in order to provoke the memory. This is why they don't say, "and that's all I know about that" because an honest person will leave open the possibility that, with effort, they will remember yet another detail to help. In Statement Analysis, always note the attempt to close dialog with "that's all I know" or "that's it" or "there's nothing else to tell you.." as a strong indicator of deception, and poke around for more information.
Spicher said they went to the yard to have conversations, but then specifically names topics that they discussed in the house.
DeDe Spicher is withholding critical information from law enforcement regarding the disappearance of Kyron Horman.
This is another indicator that Desiree Young was truthful when she reported that DeDe Spicher had encouraged community members to withhold information from the police by buying throw away cell phones.
"She would go through some of [Kyron's] old drawings, some pictures, and she would go through photos and albums of him and Kiara," Spicher says. "She was very sad and worried about both of them. I can't even begin to understand what that must've felt like."
She went through: old drawings, some pictures, photos, albums of his and Kiara.
She was "very" sad and worried about "both" of them.
DeDe Spicher, in spite of being such a close friend that she would "of course" drop everything and stay with her, wants us to believe that she cannot "even begin" to "understand" what "that" (distance) felt like. "That" appears to refer to going through old drawings, some pictures, photos, albums, of both.

It is significant that Terri Horman took a photo on June 4, and while in transit, showed an acquataince the picture, which the woman described as unusual, and posted it immediately on Facebook.
It would appear to me that Terri Horman shared this plan of alibi building with DeDe Spicher.

PORTLAND, Ore. - Investigators have learned they have reason to believe it was not DeDe Spicher, the friend of Kyron Horman’s stepmother Terri Moulton Horman, who was seen in a truck the morning Kyron disappeared, according to sources.
Investigators are working on following up on tips they received since last week’s news conference about the person seen on June 4. Those tips are in addition to the 4,000 they have collected so far.
They also want to know if a third person is tied to Kyron’s disappearance.
According to sources, investigators have witnesses who saw an adult in and around the truck in front of Skyline School between 8:15 and 8:45 that morning.
Investigators aren’t identifying the gender of the person in the truck but have reason to believe the person may not be Spicher.
They have linked Spicher and Horman through fliers they distributed that ask for information about both women and the Hormans’ truck. Terri Horman drove the white Ford F-250 pickup truck to the school that morning for Kyron’s science fair.
Terri Horman claims to friends she left the school around 8:45 in the morning and went to two different Fred Meyer stores.
The flier distributed about Spicher and Horman asks about a window of time starting an hour later, from 9:45 a.m. to 1 p.m. The overlapping time for which Spicher and Horman are both unaccounted, as far as investigators are concerned, is between 10:15 a.m. and 11:30 a.m.
At 1 p.m., Spicher was apparently accounted for once again at the nursery where she was working.
At 11:39 a.m. Terri Horman checked in at the 24-Hour Fitness in Beaverton to work out.
DeDe Spicher insisted in a People magazine interview she remained at work that day, which is an assertion criminal defense attorney, Lisa Ludwig, said is possibly strategic. She said Spicher may be testifying, in a sense, to the public about her own innocence.
“You are going out on a limb when you say, ‘I know exactly where I was for that full amount of time, I’m positive about it.’ You really are committing to that, and if you’re contradicted about any part of it, it makes you look like a liar,” Ludwig said.
Ludwig also said that law enforcement can’t focus too closely on one theory.
“If you commit to one theory and pursue it to the exclusion of others, you can really make big mistakes. I’ve seen that happen,” she said.
In the People magazine interview Spicher alluded to Terri Horman’s innocence. The magazine reported Wednesday that after Kyron disappeared, Spicher says: “We were very worried for her life. There were death threats against her. And again, whoever has taken Kyron is still out there and could be after her, too.”
Investigators have not named any suspects or persons of interest in the disappearance of Kyron and they have not made any arrests.

Skyline. But teachers, principals, administrators and parents have
been discussing how they can make it as normal as it can be. Many parents

parent Don Kruger said he knows that’s all part of the new reality at the school, given the situation.
“I think we're going to go back to school the first day and the media
is going to be across the street and there's going to be a lot of attention,”
he said. “But I think we're kind of used to it and I think we'll be ok.”Classes will resume on September 7th
but school officially opens next Monday for registration.The Wall of Hope outside the school will also be
moved to a new location before the start of classes for security reasons, according to Kyron's
