Yesterday began with the hearing concerning the State’s motion to enter the 6 felony convictions of Casey Anthony due to Baez eliciting statements of Casey to witnesses that were not introduced during directs by the State. The State chose to give the defense a Mulligan and not pursue introducing the felonies at this time. One can’t help but think the reconsideration by the State may have been on the fear that if they did win this motion and introduced the felonies, it might be grounds for an appeal of a conviction later.
Judge Perry, after hearing the State’s position that they did not want to pursue the motion admonished the defense (which, by the way, did not include Baez yet…he came straggling in later) to be very careful in their questioning of witnesses about statements made by the defendant lest they wander by into this mine field. (And before the day was over, Jose Baez wandered like a blind and drunk village idiot right back into it, which forced Linda Drane-Burdick to offer an abbreviated “speaking objection” to warn Baez what he was about to open – which would be a can of whoop-ass in the legal sense).
