The divorce attorney for Terri Moulton Horman has filed a motion to delay divorce proceedings from Kaine Horman, citing intense media and police scrutiny of his client.
Attorney Peter Bunch filed the petition today in Multnomah County Circuit Court. Bunch states that the controversy surrounding Horman, "the center" of the criminal investigation into the disappearance last month of 7-year-old Kyron Horman, makes it "virtually impossible for me to proceed with divorce-related issues as I would ordinarily do."
Bunch also contends that Kaine Horman "grossly misstated" the amount of money paid to Terri Horman's criminal attorney, Stephen Houze. Kaine Horman's attorney, Laura Rackner, filed papers earlier this week saying that Terri Horman paid $350,000 to Houze.
Bunch contends in the motion to hold the divorce in abatement, that Terri Horman "did not borrow the money to pay for Mr. Houze's attorney fees, the money to not come from her funds, and she's not asserting that her attorney fees with Mr. Houze are any sort of marital debt."
Bunch also questions Kaine Horman's inability to pay his legal fees, saying that he is employed at Intel with a good salary and that he has sufficient savings to pay for the divorce.
"Accordingly, it is difficult to conceive that Petitioner is unable to meet his expenses and pay for his attorney fees."
Bunch also states that Terri Horman is unemployed, and unemployable, and has no independent source of money to pay her legal fees.
Further, Bunch says that custody issues and parenting time, which require an independent evaluator, would be compromised by police scrutiny.
"It is unlikely that any competent evaluator would agree to work on this matter" because "his or her work product could become part of the investigation..."
The document also states that Terry Horman stipulates that she will not claim any of Kaine Horman's post-separation assets, and "is prepared to stipulate to the entry of a divorce judgment...."

I hope it's ok to copy these posts from someone posting at Valhalls who has first hand knowledge of some facts. She sounds credible to me.
I was there Thursday morning and Friday. On Thursday am, I did not see
groups touring. On Friday, parents were invited from 8:00 to 10:00.
For the students, the school day started at 8:45 as usual. My kids
teacher did a short circle time, after which the students were divided
in groups of 4-6. Each group was chaperoned by a parent-volunteer or in
some cases an 8th grader. The older kids had notebooks that they used
to make their reports. At 10:00 all groups were back in the classrooms,
and the school continued “as usual”.
Maura said “Do you know where Kyron’s (Ms. Porter’s) second grade classroom is?”
From the main entrance (on the 2nd floor), you would take a left into
the long hallway. Kyron’s combined 2nd/3rd grade classroom is on the
far West end of that hallway, just before the stairs. From the stairs
there is an emergency exit that leads to tall grass, and a small hill
down to the soccer field.
The electrical displays were two (?) classrooms before Kyron’s. Just
before that on the right is the North exit door that leads to the
basketball court and wooded area in the back of the school.

Remember compared to PPS standards, Skyline keeps its classrooms
relatively small thanks to money raised by the PTO. The typical size is
about 23 kids. I can only talk about a different class, but I have

The kids have designated tables, and it is easily noted if one is
missing.

The divorce abatement, Kaine can contest, and for very good reason TH does not want to go to court. She does not want to answer questions of any sort. This has nothing to do with public scrunity. This is just too obvious.
The lawyer Kaine has is one smart "Cookie".
It's time TH comes out of the closet and comes clean.

It’s one of the most sensitive and most personal of all the unanswered questions swirling around the case of missing 7-year-old Kyron Horman.
If the suspicions of Kyron’s father, Kaine Horman, are true — he believes Kyron’s stepmom, Terri Moulton Horman, is behind the boy’s disappearance — then how does Kaine Horman feel about the fact that he brought her into the family?
And what does Kyron’s birth mother, Desiree Young, feel now about her ex-husband’s choice, as she works closely with him to learn what’s happened to Kyron?
We asked Kyron’s parents those questions in an interview earlier this week. We’re posting their answers below, or you can hear the audio clip here.
In a related note, both parents told WW they’re seeking counseling to deal with the emotional aftermath of Kyron’s disappearance.
WW: Kaine, people wonder if you feel badly for having brought Terri into the mix in the first place.
Kaine Horman: Every day.
How does that play out in your mind?
Kaine Horman: I feel responsible. I feel guilty. It’s my job to protect him, it’s my job to be there for him. I was there for him and someone got past and got him on my watch. I’m very upset about it, I’m very emotional about it. It’s not right. It shouldn’t have happened. We all trusted her. I feel partly responsible. I in a weird way, I almost wish that her plot that she originally put in place [allegedly, to hire a landscaper to kill Kaine] would have gone through, because he would still be here. So I live with that guilt every day, and you know what, I turn it around, and I [make] it into something positive to go help find him. … I’m not saying I feel directly responsible for it, but I feel really guilty about it. And I wish there was anything I could do to change places with him in any way, shape or form. My life to get him back, it doesn’t matter. I would do anything, I would give anything, and I always would. Up to this point I have always been there in that capacity. Anything bad that happens to him, I wish I could shoulder it for him, [that] I could take it away from him. I wish it would come to me instead of him. It just didn’t go that way this time, and I really wish it would have.
Desiree, do you have any thoughts about that?
Desiree Young: I think that all of us in this case that’s close to Kyron, all of us feel guilty to a certain degree about what it is that we’re going to feel guilty about. … I’ve been told by my counselor it’s very healthy and normal. It doesn’t feel normal, it doesn’t feel healthy, but you know, I feel guilty I wasn’t here to protect him. And that’s our job is to protect our son, and I feel like I failed in that.
Kaine Horman: I think that, you know, based on our history and everything that we’ve done, we have always done everything that we feel that we can do to do that for him, and limit the impact on the kids and really try hard to do everything we can to do what’s right for them. And up until this point I think we both felt, and I’ll speak for myself, but I think we both thought we were doing a pretty good job of that, and this happens, and I think we’re all – including Tony [Young, Desiree's husband] – I think we’re all just devastated, because we all worked so hard for them. And for us, we all get along, and that comes kind of naturally for us in this progression. But we go out of our way to make sure that they’re safe and taken care of and limit all this stuff. And to have this happen, I mean, we’re all just completely devastated by it.

Desiree Young: I think that all of us in this case that’s close to Kyron, all of us feel guilty to a certain degree about what it is that we’re going to feel guilty about. … I’ve been told by my counselor it’s very healthy and normal. Kaine Horman: I think that, you know, based on our history and everything that we’ve done, we have always done everything that we feel that we can do to do that for him, and limit the impact on the kids and really try hard to do everything we can to do what’s right for them. And up until this point I think we both felt, and I’ll speak for myself, but I think we both thought we were doing a pretty good job of that, and this happens, and I think we’re all – including Tony [Young, Desiree's husband] – I think we’re all just devastated, because we all worked so hard for them. And for us, we all get along, and that comes kind of naturally for us in this progression. But we go out of our way to make sure that they’re safe and taken care of and limit all this stuff. And to have this happen, I mean, we’re all just completely devastated by it.

Ovie I've been wondering that too. Could she be anticipating winning defamation cases? As it stands at present officials keep saying she is not a person of interest or a suspect and if she is never charged or found guilty I would imagine she can sue Kaine, Desiree and many others for their damaging public statements.oviedo45 wrote:i wonder who is paying Peter Bunch, her divorce atty?

As somebody noted recently, it is almost as though they have become the un-official spokespersons on the case. Thinking out loud - if TH planned to get rid of kyron, I've been wondering why she would do that after attempting to get rid of Kaine. Then I thought what if the plan to get rid of Kaine WAS STILL IN THE WORKS but the gardener was supposed to wait until after Kyron went missing? Maybe the gardener got cold feet after TH carried through with the first part of the plan - Kyron, and spilled the beans.

and this also protects the police dept - IMO I don't think TH will sue anyone right now, she doesn't even want to go to court to try to get visitation because she is afraid of being questioned - that's also why they are asking for the abatement, she doesn't want to have to go to court for anything, not custody, not divorce proceedings - but if she is asking for atty fees - she will need to go to court for that - so am not sure this is a consistent strategy -

i have thought that as well - and why would terri's mom lie and say he was camping and out of town, when he was at the house - odd that we aren't hearing anything at all about his actions on friday.......
