The father of missing Portland boy Kyron Horman has filed for divorce
and taken out a restraining order against his wife, according to local sources
Monday night.
A source close to the investigation told KGW Monday night that Kaine
Horman had moved out of the home with thier 18-month-old child.
Just hours earlier, Kyron's stepmother Terrie Moulton-Horman stated that
reports published by two Portland TV news websites Monday that
the father and child had moved out of their home were false.
Family members released a statement Monday saying they were in
support of the investigation. The statement was signed by Kyron's
father, stepfather and mother, but not Terrie Horman.
Terri Moulton-Horman said she was not aware a statement was coming out. A
source close to the investigation, however, said Kaine and the child
had moved out.
Kyron Horman's photo was on the cover of 'People' for the second week
in a row and the story that goes with it focuses on the attention that
has been placed on his step-mother, Terri Moulton-Horman.
Since Kyron vanished three weeks ago, she has been singled out in a
questionnaire sent to parents and staff of Skyline school.
Moulton's father, Larry Moulton, 72, told 'People' matter-of-factly
that "the finger points at stepmom, she's trying to be cooperative."

It could be that the report that Kaine moved out and filed for a divorce and restraining order came out before Terri even knew what happened. I am sure that if Kaine planned on taking Kiara out of the house, he did not tell Terri first, he probably went directly to the court to file the divorce and restraining order paperwork.

Wonder what he put on the restraining order? You have to list reasons why you are in jeopardy from the person you are filing against.

I think TROs may be standard in a divorce in Oregon . . .

§ 107.093¹

"After a petition for marital annulment, separation or dissolution is filed and upon service of summons and petition upon the respondent as provided in ORCP 7, a restraining order is in effect against the petitioner and the respondent until a final judgment is issued, until the petition for marital annulment, separation or dissolution is dismissed, or until further order of the court."

Here's a thought.....

Maybe Terri and Kaine were having problems before Kyron went missing, maybe Terri blamed those problems on Kyron and that's why she "got rid of him"????

that could be true - i think LE is doing a disservice to the community by not labeling her a POI - if she is then just come out and say it and if she isn't then CLEAR her and move on. This is getting ridiculous.

once divorced, can kaine testify against her? i am thinking that in the case of endangered children marital priviledge might be waived?

if his body has been found and they couldn't determine cod, could they have been waiting on tox reports? i find it hard to believe that kaine and desiree would not know though if it is true. i just find the timing of the divorce and moving out to be odd - they do a flurry of interviews last week - and then boom - he's out of the house with the baby - maybe she was having an affair?

I think LE knows that she will get a lawyer and stop cooperating as soon as they label her a POI or suspect. She is still keeping up the facade that she did not have anything to do with this, but that can't last for long. I am sure that LE has much more evidence than they have released to the public. I just hope they find Kyron soon.

In my opinion she needed to keep Kyron quiet. I think that he knew something that would be harmful to Terri or one of her loved ones (such as one of her bio kids).

that makes sense - but 4 weeks is a long time to wait for them to gather evidence to officially label her - but since she isn't going anywhere i guess they can assume they will get her when they have what they need. maybe they have proof she was on the island now - or they have nailed down her timeline and it doesn't match with what she said she was doing

so if kaine learned something from LE that caused him to take the baby and file for divorce, what could that be?

LE has evidence but not enough for arrest and they shared it with kaine, desiree, and the stepdad
LE tore her alibi to shreds (the questionairre)
LE has the body
LE has been monitoring th computer activity and learned something so devastating that Kaine had no choice to file for divorce

this is just so crazy - did we actually find the restraining order yet?

Ovie, You are right, it is most likely one of those things. It's crazy that Terri Horman killed this sweet little boy because she is such a narcissus.

I am sure that LE knows for sure that Terri is solely behind Kyron's disappearance. I do not know why they are waiting. May be they want find Kyron first.

This can't go on forever, if Terri tries to fight for some custody of her daughter, Kaine will be forced to release the information that he knows (if he has not already done so) to the court.

Isn't this kind of backfiring? Doesn't all this "lack of candor" with the public degrade trust in the authorities? I'm just losing my good sense of humor with all the secrecy.

I'm asking myself..."What could LE possibly know that would jeopardize the investigation if it were released to the public?"

Then I ask myself if this is some new investigative technique to get suspects to crack. Or in this case "non-suspects." It just does not make sense. None of it makes sense, there is something really major that we don't know, there HAS to be....

Maybe they aren't just after Terri, maybe there's a huge drug ring involved here, steroids....something like that....but why have everyone looking for Kyron if they've already found him just to bust a drug ring? No...pay no attention to me, I'm just thinking out loud...

....so he's suing for full custody. And it's going to be kinda hard for Teri to pay child support if and when she goes to jail....I still want to see the restraining order, just to satisfy my own curiosity.
